PROCLAMATIONS AND/QR A~QUNCEMENTS Mayor Harris introduced Councilman Ormond, of Cardiff, Wales and presented him with a Sebastian pin and cap. Councilman Vallone said the North County is over their official goal for United Way donations and thanked Dan Pruess for his efforts. CQIV%MITTEE REPORTS Councilman Metcalf said distribution of the Comprehensive Land Use Plan update was essential for Planning and Zoning, the Building Official, and the Engineering/Public Works Department and recommended spending the $25.20 for each additional copy. Mayor Harris said this is only a progress report not a final copy. It was decided to give the Planning and Zoning Commission Council copies. 8. PUBLIC INPUT ON ~NDA ITEMS Mayor Harris opened the Public Input on Agenda Items at 7:37 P.M. Dolores McCarthy said she hoped people would vote yes on the airport referendum question. Mayor Harris said the matter is already settled and that Council's only obligation is to place the question on the ballot. Arthur Lemire recommended that the library building be used for the Police Department. Councilman Vallone questioned what fees were being referred to by St. Sebastian Church for their annual festival. Mayor Harris told them their was a license fee for carnivals in effect. Request from St. Sebastian Church - Waiver of Fees for Sixth Annual Festival -2/11 thru 2/14/88 VOICE VOTE: Vice Mayor Roth - Aye Councilman McCarthy - Aye Councilman Metcalf - Aye Councilman Vallone - Aye Mayor Harris - Aye MOTION CARRIED. Councilman McCarthy questioned whether Councilman Metcalf's request to attend the seminar was in line with 7 1/13/88 Council attendance or would a Public Work's person or other department head be better served by attending. Councilman Metcalf said he wanted to learn if any basic procedures had been changed. MOTION by Vallone/Metcalf I move we approve expenses for Consent Agenda item J. OLD BUSINESS: Architect -- Polic~ ~acili~y MOTION by Metcalf/Vallone I move we start negotiations with Stottler, Stagg and Associates for the police facility. A discussion took place on the procedures that were followed in arriving on a firm to negotiate with. Block and Associates for the police facility. Vice Mayor Roth said for the record that Council went through the proper procedure, rated the firms and chose C.E. Block. Consideration ~ Formal Agreement with ~l~ and Associates for Preparation of ~ Base ~latt~ MOTION by Vallone/Roth I move we approve the formal agreement with Lloyd and Associates for preparation of City Base Maps for $5900. Discussion took place on proprietary rights to the maps. Attorney Palmer told Councilman McCarthy that the City can obtain mylars of the base map from Lloyd and Associates to make copies. Attorney Palmer said Dave Reber of Lloyd and Associates suggested that the City purchase County Atlas mylars. MAYOR'S MATTERS Mayor Harris said the matter regarding Open House signs had been before Planning and Zoning and had resulted in a tie vote. The item was placed on the January 27, 1987 agenda. Mayor Harris said he had received a copy of notice of hearing from Attorney Russell Peterson to the attorney for Gerald Nappi. 12. COUNCIL MATTERS Discussion took place on a memo from Jerry Thomas, Public Works Director and Bruce Cooper, Building Official dated January 11, 1988 regarding drainage ditches. The Building Official said he was meeting with local contractors on January 18, 1988 at 7:30 P.M. to get their input. Councilman Metcalf said he had received a letter from ICMA with a sample employment agreement for the City Manager. He requested that Pete Knowles come to the next Council workshop. Mayor Harris said he would like to read the sample agreement before any discussion takes place. 1/13/88 13. CITY ATTORNEY MATTERS None. 14. NEW BUSINESS Wide Trailer - Police Depart~B~ - Funding Mayor Harris explained that an estimated $12,000 to $15,000 would be needed to move and upgrade the trailer for use at the Police Department. MOTION by Vallone/McCarthy I move we authorize the necessary funds for the moving and upgrading of of the double wide trailer for the Police Department from reserves not to exceed $15,000. Vice Mayor Roth questioned if any laws would be broken by installing the trailer at the Police Department. The Building Official said he had some concerns but that State Statutes allows some variations on a temporary basis and that he would look into it. R-88-16 (ADOPTION) A RESOLUTION OF THE CITY OF SEBASTIAN, FLORIDA, PROVIDING FOR THE HOLDING OF A REFERENDUM BY VOTER PETITION ON THE 8TH DAY OF MARCH, 1988, ON A PROPOSED AMENDMENT TO PARAGRAPH 7 OF SECTION 1.02 OF THE CITY CHARTER AND THEREBY PROHIBITING THE CITY FROM DOING CERTAIN SPECIFIED CAPITAL PROJECTS AT THE SEBASTIAN MUNICIPAL AIRPORT UNLESS ANY SUCH ACTION OR ACTIONS ARE FIRST AUTHORIZED BY A REFERENDUM ELECTION; DESIGNATING THE POLLING PLACES, THE FORM OF THE OFFICIAL BALLOT, THE MANNER OF CONDUCTING THE ELECTION; PROVIDING FOR THE RETURN AND CANVASSING THE ELECTION; PROVIDING AN EFFECTIVE DATE. MOTION by Roth/McCarthy I move we adopt Resolution No. R-88-16 as read by the City Attorney by title only. 10 3/13/88 88.003 Councilman Vallone said he would not support government by referendum. Councilman Metcalf said he would go on the record as voting no. Vice Mayor Roth said there was reason for discussion since it was mandated by Charter resolution that Council approve this. Attorney Palmer said Council has a legal obligation to pass the resolution although members may lobby against its approval. He said if the motion is defeated the Council could be in violation and could be sued unless it had a good legal reason for denial.
