Sebastian Gets 15 Days
To Respond To Lawsuit

Sebastian received a 15-day res-
pite Thursday from its deadline to
respond to a court order relating to
the airport lawsuit.
Circuit Judge Paul Kanarek
agreed to an extension of 15 days
instead of the 20 days the city had
asked for, said Assistant City
Attorney Vincent Torpy Jr. The
new deadline is Oct. 13.
The order requires the city to
either adopt an ordinance
implementing the airport charter
amendments or show cause why it
should not do so.
Sebastian's new attorney on the
lawsuit, Nicholas Tsamoutales, has
been boning up on the case for a
week, Torpy said. Although Tsa-
moutales was hired Wednesday to
replace the city attorney on this
case, he has been reviewing the file
since he became a candidate for
the job, Torpy said.
The city attorney withdrew from
the case last week because it is
probable he will be called as a wit-
ness based on a legal opinion he
rendered that the provisions of the
charter amendment were open to
legal challenge.
The lawsuit was brought by resi-
dent Burt Snell, who is trying to
force the city to adopt an ordinance
putting into effect the changes.
In doing so, Snell hopes the Fed-
eral Aviation Administration,
which objects to landing fee and
noise provisions, would step in
andtake the airport away from the
city.
