SPECIAL COL~&'CIL MEETING - JANUARY 16, 1978
MEETING WAS CALLED TO ORDER BY MAYOR PAT FLOOD, JR., AT 10:05 A.M.
PRESENT: VICE MAYOR LEWIS GRAY, COUNCILMEN EVERETT GASS AND JOHN R. JOACHIM, CITY ATTORNEY
L. B. VOCELLE. ABSENT: COUNCILMAN CLIFFORD HOOSE.
MEETING WAS CALLED TO DISCUSS THE PROPOSED ANIMAL AND FOWL ORDINANCE, THE ILLEGAL DUMPING OF
TRASH, AND THE ZONING AND PLANNING COMMISSION PROCEDURE FOR SELECTION OF NEW MEMBERS.
MR. VOCELLE STATED THAT LEGAL AUTHORITY IN THE FORM OF AN ORDINANCE IS NEEDED TO RESTRICT THE
RUNNING OF ANIMALS AT LARGE. THE ORDINANCE SHOULD PERMIT IMPOUNDING OF ANIMALS BY THE POLICE
DEPARTMENT. THE CITY ALSO NEEDS AUTHORITY TO ENTER INTO AN AGREEMENT WITH THE HUMANE SOCIETY
OF VERO BEACH AND TO PAY THEM A REASONABLE FEE. LEGAL AUTHORITY IS NEEDED TO PERMIT COLLEC~-
ION OF SPECIFIED FEES FROM OWNERS OF ANIMALS WHO WISH TO RECLAIM THEIR PETS. THE OWNERS
WOULD HAVE TO COME TO THE CITY CLERK'S OFFICE TO SHOW PROOF OF OWNERSHIP AND THAT THE ANIMAL
HAS BEEN GIVEN NECESSARY SHOTS AND HAS A CURRENT COUNTY LICENSE. THE ORDINANCE SHOULD READ:
"THE CHIEF OF POLICE IS HEREBY APPOINTED AS IMPOUNDING OFFICER OF THE CITY OF SEBASTIAN. HE
AND HiS OFFICERS ARE DESIGNATED TO RECEIVE, CATCH, PICK-UP AND IMPOUND ANY ANIMAL, INCLUDING
DOGS OR ANY OTHER DOMESTICATED (WILD?) ANIMAL SUBJECT TO RABIES OR KNOWN TO BE A RABIES
CARRIER, ROAMING AT LARGE, AND TO DELIVER IT TO THE HUMANE SOCIETY IN VERO BEACH. THE
HUMANE SOCIETY IS HEREBY DESIGNATED AND APPOINTED AS IMPOUNDING AGENTS FOR THE CITY OF
SEBASTIAN." THE CITY COUNCIL WILL HAVE TO DETERMINE FEES AND HOW MUCH TO PAY THE HUMANE
SOCIETY. ORDINANCE MUST INCLUDE: "SUBJECT TO AGREEMENT WITH THE HUMANE SOCIETY".
THE FOLLOWING FEES WERE QUOTED FROM THE VERO BEACH AGREEMENT WITH THE HUMANE SOCIETY:
1ST OFFENSE - $10.00 PER DAY PLUS $2.00 FOR HOUSING; 2ND OFFENSE - $15.00 PER DAY PLUS $2.00
FOR HOUSING; 3RD OFFENSE - $25.00 PER DAY PLUS $2.00 FOR HOUSING. MR. VOCELLE ALSO STATED

MOTION MADE BY COUNCILMAN JOACHIM, SECONDED BY VICE MAYOR GRAY, FOR CITY ATTORNEY TO DRAW UP
EMERGENCY TRASH ORDINANCE TO PUT MORE TEETH IN THE LAW. SHOULD BE READY FOR NEXT WORKSHOP
MEETING. CARRIED.
MOTION MADE BY COUNCILMAN JOACHIM, SECONDED BY COUNCILMAN GASS, TO ADOPT THE PROCESS PROPOSED
BY THE ZONING AND PLANNING COMMISSION FOR SELECTION OF PROSPECTIVE MEMBERS. CARRIED.
COUNCILMAN GASS MADE A MOTION WHICH WAS UNANIMOUSLY CONSENTED TO BY THE MEMBERS OF THE
COUNCIL TO BRING UP OTHER SUBJECTS.
MAYOR FLOOD STATED THAT HE WAS IN RECEIPT OF A LETTER FROM SENATOR JIM GLISSOM REQUESTING
THAT THE COUNCIL SEND HIM A RESOLUTION STATING THAT THEY AGREE WITH HIS PROPOSAL TO PRESENT
LEGISLATION THIS YEAR THAT IF THE STATE MANDATES THINGS FOR THE CITIES AND COUNTIES THEY HAVE
TO FUND IT. MOTION MADE BY COUNCILMAN JOACHIM, SECONDED BY COUNCILMAN GASS, THAT WE DRAW UP
A RESOLUTION STATING THAT WE AGREE WITH SENATOR GLISSOM AS PER HIS FILE 11-371-8. MR. VOCELLE
STATED THAT HE THOUGHT IT WOULD BE SUFFICIENT TO WRITE A LETTER ON CITY STATIONERY ACKNOWLEDG-
ING RECEIPT OF HIS LETTER AND THAT COUNCILMEN AT A SPECIAL CALLED MEETING APPROVED PROVISIONS
OF IT. COUNCILMAN JOACHIM MADE A MOTION, SECONDED BY COUNCILMAN GASS, THAT WE NOTIFY SENATOR
GLISSOM BY LETTER FROM THE CITY CLERK. CARRIED.

COUNCILMAN JOACHIM STATED THAT THE NEWLY FORMED POLICE COMMITTEE HAS BEEN WORKING TO
IMPROVE ON OUR REGULATIONS. THERE WAS SOME DISCUSSION AS TO WHETHER OR NOT THE COM-
MITTEE COULD INITIATE, WITHOUT THE CONSENT OF THE COUNCIL, A PROGRAM OF PROGRESSIVE
STEPS FOR ADVANCEMENT IN THE POLICE DEPARTMENT. THERE IS NO PROVISION FOR THIS
ARRANGEMENT AND THE WHOLE PROCEDURE NEEDS RE-STRUCTURING. MR. VOCELLE VOICED THE
OPINION THAT ANY DEPARTMENTAL PROCEDURE CHANGES SHOULD BE DECIDED AND APPROVED BY
COUNCIL. MAYOR FLOOD SUGGESTED THAT THIS MATTER BE BROUGHT UP AT THE WORKSHOP MEETING
AND PUT ON THE AGENDA OF THE NEXT CITY COUNCIL MEETING. COUNCILMAN JOACHIM STATED THAT
HE PREFERS A SPECIAL MEETING AND THE MAYOR AGREED THAT THIS WOULD BE DONE.
