P. Lawson Clerk k.G. Roberts Councilmen S. A. Park and ,~. C. Braddock were found to be absent. Minutes of the previous meetins of January 9th and 16th, were read and approved. President of the City Council W. A. Martin asked Councilman Lawson to take chair. MOTION made.by Councilman M~rtin, seconded by ounc~lman Hardee, th':~t on' September 5th, 1927 a motion was made and passed providing ffbr'tth~ employment of an assit.:.~nt clerk, to be employed durin6 street and sidewalk construction, and Whereas, said construction will l~_~ve been completed by January 31st, 1928, therefore Be It Resolved, that the assistant' clerk's services, be'discontinued January 31st, in accord.anco with action of September §th, 1927'. Motion carried. MOTION made by Councilman Hardee, seconded by C ' ouncilm~n Lawson, tt~:~t on and '.~fter February 1st, 1928, all outside of City electric light consumers, that have paid for electric~lig~t extensions~ be the same rate basis as consumers of electricity in the ~ity putof on Sebastian. Motion carried. MOTION n~ade by Councilman Hardee, seconded by Councilman Lawson, 'that C. T. Nelson's propositon as follows: "To be subject to all police calls at any time and to take care of City sanitary work as hereto- fore at a salary of $50.00 per month beginning February 1st, 1928," be, and the same is hereby accepted, all previous agreements regard- ing salary between the City and Mr. Nelson being hereby cancelled- Mot i on c err ie d. RESOLUTION NO. ~ "! s~-'~c ended by The following resolution was introduced by Counciln~n Hardee, ~ Councilman Lawson~ Whereas, there is existing a deficit in the general funds of the City of the City of Sebastian, and the City is in need of funds to pay current expenses; ,~nd ~aereas, the Indian River County Bank has agreed to loan the City the sum of $2,500.00 (Twenty Five Hundred Dollars) u'~on certain conditions; Therefore, Be It Resolved, by the "CitY Oouncil of the City of Sebastian, that sa~d City do borrow the sum of $2,500.00 from the Indian River County Bank and t~t the Mayor and City Clerk of said City be, and they are hereby directed and empowered to execute, on behalf of the City, two promissory notes each in the Sum of $1,250.00, one due in three months and one due in six months after date, bearing interest at the r~te of 8% per annum, and deliver same to said Bank upon receipt of said sum of $2,500.00; and Be It Further Resolved that said sum so borrowed shall be used for the purpose of paying current expenses of said City and that all ?ands derived by said City from taxation levied for General purposes collected after the passage of this resolution shall., after paying actual necessary operating expenses of said City, bo segregated.and kept as a spl~cial fund for 'the payment of said notes when the same become due, until the saree shall have been paid. A. }~artin Nays: None Thereupon tho resolution was declared adopted. MOTION m~ide, by Councilman Hardee and s~oeonded by Councilman Lawson that the Mayor, President of the City Council and the City Clerk, executedan agreement with ~r. W. E. Feazel, Sr., for the City, which agreement is in words and fibres as follows: THIS AGREEIv~INT, made and entered into this ~4th day of Janu~ry, 19~8, by and between the City of Sebastian, Elorida, a municipal corporation, hereinafter called party of tho first part, and ~m. E. Feazel, Sr., hereinafter ca~od p~u~ty of,~tho second ~art; ~?ITNESSETH, Y~ '~ issue four certain Time'Warr~nts of said City of ~oba~tian, ~"lorida, each in the principal sum of ~1,000.00; each to boar interest at tho rate of 8% per ann~, payable 'semi-annually, and each becoming due ~nd payablo On the E~th day of J~e, 19~; said Time Warrants being of tho issue of 19E8, and numboro~ 1, ~ a~d 9 respectively; said Time Warrants being in the total ~ount of ~&,000' .00; ~d~ ~EREAS, the party of the second part purchased said Time V~arrants for value, and is the holder and owner of oach and all of said Time Warrants at this date; ~d, ~EREAS, tho said party Of the first part is unable to ~ko pa~ent of said Time Warrants~ a~ this time, and the parties are dosirous of effocting an arrangement ~heroby said Time Warrants shall bo paid in a manner satisfactory to both partios; therefore, in consideration of the premisos, and in consideration of the mutual covenants and promises by each party herein contained, and in consideration of the. forebearance of tho party of the second part, and in consideration of the payments to him m~do by tho party of tho first part, tho p~ties do agree as ~ollows: That interest on ~id Timo Warrants, and oath of them, has b~en paid in full to this date,~receiPt of said intorast being herewith acknowledged by the party of.the' second p~rt; that the sum of $~00.00'has been paid by tho party of the ~i~s~L'~p~$t$o~'~e p~ty of tho second part;this day upon"'the principal sum of said Time Warrants, leaving bala~e due thereon of $~00.00; the party of the first part does agrao'to pay said. balance in the following manner: ~ $800400 on ~y 2~, 19~ ~00~.00 on Sept ~00~00 on J~ ~; 19~ ~00~00 ~ on l~ay ~&; 19E9 $~00,00 'on Sept ~00400 on Jan E~, 19S0 ~00.00 on May ~&, 1950. The party of the first Part does further agree to pay the interest on each and all of said Time Warrants each four months from and after this date on the unpaid balance thereof at the rate of 8% per annbum. In consideration of the agr~:e~mot on the part of the party of the first part as aforesaid, and the prompt performance of the ~ame, the party of the second part does agree not to attempt to collect said Time Warrants, other than in the manner and at the time herein provided, and does agree to accept payments thereon as herein provided, and does agree not to re0uire other or additional payments thereon during the life of this agreement; Provided that time is of the essence of this contract, and should the party of the first part fail in making any of tho payments herein agreed by it to be made, or fail in any respect to fully perform its obligations herein contained, then, and in that event, this agreement shall become immediately null and void, and 'the party Of the second part shall bo entitled to collect said Time Warrants as a whole, and each and all of said Time Warrants shall revert to their status as before the execution of this agreement, excepting only the crediting of any payments made thereon.
