Mayor Harris called the meeting to order at 7:00 P.M. 2. Councilman Vallone led the Pledge of Allegiance. Invocation was given by Dr. Stan Sanford, First Baptist Church of Wabasso. 4. ]~ CALL Present: Vice Mayor Kenneth Roth Councilman Robert McCarthy Councilman George Metcalf Councilman Peter Vallone Mayor L. Gene Harris Attorney Thomas C. Palmer 5. PROCLA~ATIONS/~NNOUNCEMENTS Mayor Harris announced that Scott Stepp, candidate for City Engineer position, would like to visit the city again before making his decision. Attorney Palmer read a proclamation, proclaiming February "American History Month". Mayor Harris presented the proclamation to Betty Bock, Colonial Dames. Vice Mayor Roth said the press had undermined the authority of City Council by writing an article about the counteroffer from Robert McClary for the position of City Manager before Council was aware of it. 6. ~ OPENING 1. TWO Milita~ Trucks L Offers for Purchas~ Attorney Palmer opened and read the one bid as follows: From W.E. Strauss of Sebastian, FL White Truck ........... $321.41 Olive Truck ........... $289.56 MOTION by Roth/Vallone I move we refer the one bid from W.E. Strauss for $321.41 and $289.56 for the two military type trucks to staff for their review and recommendation to Council. VOICE VOTE on the motion carried 5-0. 7. COM~ITTEE RE~ORTS None. 8. iNTRODUCTION OF BUSINESS FRQM THE PUBLIC Florence Rinkel asked when her road would be fixed. Mayor Harris said Jerry Thomas, Acting Public Works Director, was working on it. Dr. Beller suggested a one on one debate between citizens and candidates in an open forum. Mayor Harris said the Council does not set procedures for candidates. Chuck Neuberger said a contractor had received a permit to work in Mr. Neuberger's home without holding a City Contractor license. The Building Official said he would look into it. 9. The Building Official said the Historical Society still had to go through site plan but that a Special USe Permit could be granted. MOTION by McCarthy/Roth I move we accept the conceptual plan for the Sebastian River Area Historical Society museum, instruct the City Attorney to draft a resolution for Special Use Permit and schedule the Public Hearing for March 23, 1988. Councilman McCarthy said the plan was well thought out. VOICE VOTE on the motion carried 5-0. Propgsed Golf Course l~rant Lease --Mayor Ha~ i s After a discussion Mayor Harris instructed the City Attorney to amend the lease regarding the tenant's responsibility for sewer costs and bring back to Council at a later date. Attorney Palmer said he could bring it back to the next meeting. Ce Airport Advisory Board _- Recomnl~]%~atiQn on Bids for Wastewater ~reatment Plant (Re~endation will be distribut~ Before Meeting) MOTION by Metcalf/Vallone I move we accept the recommendation of the Airport Advisory Board to award the purchase of the Wastewater Treatment Plant to Allen's Environmental Equipment for $1500. ROLL CALL: Councilman Vallone - Aye Vice Mayor Roth - Aye Councilman McCarthy - Aye Councilman Metcalf - Aye Mayor Harris - Aye MOTION CARRIED. First reading on Ordinance No. 0-8-13 was set for 2/10/88. E. Discussion/Action on ~£Q~i~ AVailable to City as Follows: 1. Boone Property - Flood Realty 2. CAVCORP Property 3. Marker 68 Marina - Coulter Properties, Inc. MOTION by Vallone I move we accept the proposal for the purchase of the Boone Property. MOTION died for lack of a second. Discussion followed on the three available properties. MOTION by Vallone I move we purchase the Boone Property as proposed by Flood Realty with funds from unencumbered reserves. MOTION died for lack of a second. MOTION by Vallone/Metcalf I move we postpone action on three properties available until the City Manager is on board. Mr. Coulter, Marker 68 Marina, and Dr. Fischer, CAVCORP, addressed Council regarding their properties. ROLL CALL: Vice Mayor Roth - Nay Councilman McCarthy - Nay Councilman Metcalf - Aye Councilman Vallone - Aye Mayor Harris - Nay MOTION FAILED. 88.033 MOTION by McCarthy/Roth I move the Mayor, City Attorney and Finance Director negotiate for the purchase of the Boone Property, CAVCORP property and Marker 68 Marina and bring information back to Council. ROLL CALL: Councilman Vallone - Aye Vice Mayor Roth - Aye Councilman McCarthy - Aye Councilman Metcalf - Aye Mayor Harris - Aye MOTION CARRIED. 11. MAYOR'S MATTERS None. 12. CITY COUNCIL MATTERS Following a request by Councilman Vallone, Mayor Harris instructed the City Attorney to meet with the Building Official and Construction Board to discuss performance bond requirements for local contractors and bring back information to Council. 13. ~ITY ATTORNEY'S MATTERS None. Mayor Harris called recess at 9:11 P.M. and recalled the meeting at 9:18 P.M. All members present before recess were present at recall. 14. NEW BUSINESS A. ~3B_~ I~ WQRI~S 1. Letter from Public Works Employees re: jerry Thomas -_ Hire Permanently MOTION by Vallone/Roth I move we postpone action on the hiring of Jerry Thomas until the City Manager brings it back to Council. Councilman Vallone said Mr. Thomas is not qualified for the position. Request for Lease of Backhoe MOTION by Vallone/McCarthy I move we approve the rental agreement with John Deere for a backhoe for Public Works with an amendment to paragraph 5 to allow the City to return the backhoe to John Deere after one year with no penalty. Attorney Palmer advised that specific groups be grandfathered instead of in general all non-profit groups. Mayor Harris said he would meet with the City Clerk and compile a list of groups who maintain they had an agreement with GDC and the City to use the Community Center and Yacht Club for free and bring it back to Council. MOTION by Vallone/Metcalf I move we accept the proposal from Robert McClary for the position of City Manager. Mayor Harris said he would contact Mr. McClary to request a copy of his drafted employment agreement. ROLL CALL: Vice Mayor Roth - Aye Councilman McCarthy - Aye Councilman Metcalf - Aye Councilman Vallone - Aye Mayor Harris - Aye MOTION CARRIED. Request for Special Use ~e~i~ - Vicker's Sandmine - Recommendatign from plajlnin9 and Zoning Randy Mosby, Mosby and Associates, addressed Council regarding the request. MOTION by McCarthy/Roth I move we approve the request for Special Use Permit for Vicker's Sandmine contingent upon receipt of state permits, and set it for public hearing on March 9, 1988. VOICE VOTE on the motion carried 4-1. (Vallone - Nay) Mayor Harris adjourned the meeting at 10:30 P.M.
