A RESOLUTION OF THE CITY OF SEBASTIAN, FLORIDA,
ESTABLISHING ENGINEERING PERMIT FEES AND PENALTIES
RELATING TO DEWATERING INSPECTIONS, AS REQUIRED PURSUANT
TO CITY OF SEBASTIAN CODE OF ORDINANCES §54-2-7.15; ADOPTION
OF RECITALS; PROVIDING FOR CONFLICTS, SCRIVENER'S ERRORS,
SEVERABILITY AND AN EFFECTIVE DATE.
WHEREAS, the City of Sebastian provides service to residents, nonresidents and to owners of
real property lying within the municipal limits of the City of Sebastian as well as to businesses and
owners of structures within the City including but not limited to dewatering inspection services as
provided for in the City's Code of Ordinances, §54-2-7.15; and
WHEREAS, Florida Statute §166.222 provides that the governing body of a municipality may
provide a schedule of reasonable inspection fees in order to defer the costs of inspection and
enforcement of its codes; and
WHEREAS, it is in the best interests of the City to include within the fee schedule work requiring
review by the City Engineer as provided in Land and Development Code §54-2-7.15.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
SEBASTIAN, FLORIDA, AS FOLLOWS:
Section 1. RECITALS/LEGISLATIVE FINDINGS/INTENT.
(a) The City Commission of the City of Sebastian hereby adopts and incorporates the recitals
above in the Whereas Clauses to this Resolution and City Council Agenda Memorandum
relating this Resolution.
(b) The above recitals set forth in the Whereas Clauses of this Resolution are adopted by the
City Council as the true and correct legislative findings and the intent of the City Council.
Section 2. CITY OF SEBASTIAN ENGINEERING PERMIT APPLICATION FEES
SCHEDULE: The City Council of the City of Sebastian, hereby establishes the following fees for
Engineering dewatering inspection permit applications pursuant to City Code of Ordinance 54-2-7.15.

*INSPECTION FEES ARE NON-REFUNDABLE*
Section 3. PENALTIES. Any person who commences any work dewatering before
applying for the necessary permits shall be subject to a penalty of one hundred percent (100%) of the
usual permit fee, in addition to the required permit fees. The payment of such penalty shall not relieve
any person(s) from complying with the requirement of the Code of Ordinances or this resolution in the
execution of the work, or from any other penalties of the Code of Ordinances.
Section 4. CONFLICTS. All Resolutions or parts of Resolutions in conflict herewith
are hereby repealed.
Section 5: SCRIVENER'S ERORS. Sections of this Resolution may be renumbered or
re -lettered and corrections of typographical errors which do not affect the intent may be authorized by
the City Manager, or the City Manager's designee, without need of further action of City Council by
filing a corrected copy of same with the City Clerk.
Section 6: SEVERABILITY.
If any phrase, clause, sentence, paragraph or section of this Resolution shall be declared invalid
or unconstitutional by the judgment or decree of a court of competent jurisdiction, such invalidity or
unconstitutionally shall not affect any of the remaining phrases, clauses, sentences, paragraphs or
sections of this Ordinance.
Section 7. EFFECTIVE DATE. This Resolution shall take effect on October 16,
2024.
The foregoing Resolution was moved for adoption by Councilmember _Dixon
The motion was seconded by Councilmember Jones and, upon being put to a vote, the
vote was as follows:
