Mayor Conyers called the meeting to order at 7:00
p.m.
The Pledge of Allegiance was recited.

Proclamation - Urging Citizens to Fly U.S. Flags
i__~n Honor of S~rvice People in Middle East
Mayor Conyers read the proclamation, presented it to
members of the American Legion and VFW and named area
residents serving in the Middle East.
Eldon Loud accepted the proclamation and commended
City Council and staff for their support in the
display of flags.

7. WORKSHOP ITEMS
Review Request for Fence at Schumann Park
(Staff Recommendation dated 1/29/91, Sketch
dated 1/29/91
The City Manager presented the request and expressed
concern for precedence setting. A brief discussion
ensued.
Vice Mayor Oberbeck suggested that the fence be six
feet in height and seventy-five to eighty feet in
length.
The City Attorney said any vote should be a straw
vote only and that the item should be placed on the
next agenda.
MOTION by Oberbeck/McCollum
I move we put up a six foot high nine gauge
chain link fence approximately eighty foot long
between the basketball court and Lot 1 Block 558 at
Schumann Drive and put it on the agenda.

The City Manager said if this motion passed it was
his intent to place it on the next meeting agenda.

The City Manager gave a lengthy presentation on the
GDC report (see attached).
George Kulczycki, GDC responded to questions of
Council and explained procedures that would be
followed in the event of a negotiated agreement
between GDC and the City.
The City Manager requested that Council members
scrutinize the report and meet with him to
express their Droperty priorities.
Council members and staff expressed interest in
a public forum to get residents' input.
Mayor Conyers called recess at 8:08 p.m. and
reconvened the meeting at 8:23 p.m. All members
present at roll call were present when the meeting
reconvened.
Public Works Weekend Duty (City Manager
Recommendation dated 1/31/91)
The City Manager explained the proposed weekend duty
program to Council and requested, if Council
concurred, direction to proceed with the draft of a
policy statement for Council review.

Implement Volunteer Program (City Manager
Recommendation dated 1/31/91)
Chief Petty defined the proposed volunteer program
for City Council.
The City Attorney advised that adequate background
checks be conducted, and adequate training and
workers compensation be provided.
Chief Petty stated that he would require funding for
drug testing.
It was the consensus of Council that the City Manager
proceed to draft the volunteer work program and bring
it back to Council for review.

8. MAYOR'S MATTERS
Mayor Conyers requested additional lighting in the
west City Hall parking lot; requested Council
approval for him, the City Manager and the Director
of Community Development to attend the March DCA
awards ceremony in Tallahasse and recommended that a
local awards ceremony be held to recognize all
participants in preparation of the Comprehensive Land
Use Plan.
The City Manager said additional lights will be
installed in both parking lots. Council concurred
that the Director of Community Development should
attend the Growth Management workshop in Tallahassee
being conducted in con3unction with the awards
ceremony. The City Manager stated that, in
accordance with the Charter, unanimous consent of
Council is required for the Mayor's expenses for
attendance.
Appoint Catherine Mitten - Representative to
National Organization on Disability (Schum Letter
dated 1/28/91, Representative Designation Form)
Mayor Conyers appointed Catherine Mitten as
representative to the National Organization on
Disability. Vice Mayor expressed his regret at
George Schum's resignation.
9. COUNCIL MATTERS
A. Vice Mayor Oberbeck
Vice Mayor Oberbeck announced the public meeting on
the North County Sewer Project on March 14, 1991 at
7:30 p.m. at the Sebastian Community Center; stated
that Robert Brodie, although resigned from the
Riverfront Committee, had offered continued input;
stated that action is being taken regarding parking
of tractor trailers on U.S. 1; noted that City of
Sebastian signs' population figures are outdated and
requested status on the cemetery maintenance bids.
The City Manager said the cemetery maintenance bids
were scheduled for the next meeting.

B. Councilman McCollum
Councilman McCollum requested Council input on the
possibility of the Riverfront Committee, when it has
completed its study, looking at long range plans of
the city in regard to tax base expansion.
Vice Mayor Oberbeck said cooperation is needed
between the Chamber of Commerce, Council of 100 and
City Council.
C. Councilman Powell
Councilman Powell questioned the status of the
abandoned 76 station on U.S. 1 and stated that the
Little League had begun its season at Barber Street
Sports Complex.
The Director of Community Development noted that the
abandoned station has been a continuing problem and
that he would look into whether it can be taken to
Code Enforcement.
D. Councilman Rondeau

10. CITY ATTORNEY MATTERS
Charter Provisions Re: Contracts (Staff
Recommendation dated 1/3/91, City Attorney Letter
dated 1/23/91, City Attorney Opinion dated
1/18/91, Section 2.06 City Charter)
The City Attorney advised that there are conflicts in
Charter sections 2.06, 2.10 and 3.04 that need to be
addressed. He recommended that, if Council concurs
that it was the public's intent at the time the City
Manager form of government was established that the
City Manager should sign all contracts other than
those approved by Council, Council should consider a
referendum to amend the Charter.
Mayor Conyers said he had no problem with a
referendum but requested that he be notified to sign
all contracts until the charter is amended. The City
Attorney concurred.

The City Clerk was directed to contact the Supervisor
of Elections to ascertain the next possible date and
cost for a referendum question. The City Clerk and
City Attorney said there were other charter
provisions in conflict that needed to be addressed.
The City Manager requested that Council think about
where some some practical lines can be drawn
regarding signature of contracts.
CITY MANAGER MATTERS
The City Manager said it was his intent to continue
business as we have been and any written contracts
under the purview of this ordinance will be given to
the Mayor for signature.
Being no further business, Mayor Conyers adjourned
the meeting at 9:20 p.m.
