Mayor Votapka called the meeting to order at 7:02 p.m. t The City Manager led the Pledge of Allegiance. ANNOUNCEMENTS/PROCLAMATIONS 90.038 A. 90.039 90.038 Proclamation - National Burn Awareness Week 2/4/90 - 2/10/90 Mayor Votapka deferred this item for arrival of the recipients. 6. PUBLIC INPUT A. Non-Agenda Items Paul Lindsay - Sebastian - Discuss Legal Notices (Letter from Lindsay dated 1/22/90) Paul Lindsay, 632 Wallace Street, Sebastian, Publisher, Sebastian Sun, appealed to Council to instruct the City Clerk to place at least half of the city's legal notices in the Sebastian Sun. Melvin Atkins, 255 Delaware Avenue, Sebastian, Advertising Manager, Press Journal, cited the Press Journal's increased circulation as a reason to continue its services for legal ads. Following some discussion on the matter, Council left it to the discretion of the City Clerk to decide which newspaper to use, however, she was advised to use both to advertise special matters. Am Proclamation - National Burn Awareness Week 2/4/90 - 2/10790 Mayor Votapka read and presented the proclamation to Everett Gass and Pete Williams of the Sebastian River Shrine Club. B. Agenda Items Todd Smith, 121 Ocean Drive, Sebastian, and Paul Mitchell, 124 Hincemon Avenue, Sebastian, expressed their displeasure with the condition of streets in unit 17. 7. WORKSHOP ITEMS 2 City Council Workshop February 7, 1990 Page Three 89.019 A. Discuss Street and Drainage Acceptance - Unit 17, Sebastian Highlands (City Manager Recommendation dated 1/31/90, City Manager Memo dated 1/31/90, Memo from City Engineer dated 1/31/90, Letters to GDC dated 9/20/89 and 9/28/89, Letter from GDC dated 10/5/89, 1979 Contract) The City Manager gave a history of the agreement between the City of Sebastian and General Development Corporation (GDC) for acceptance of streets and drainage in units 16 and 17 and explained his proposal to GDC for upgrade and acceptance of unit 17 as spelled out in his memo dated January 31, 1990 (see attached). The City Engineer presented graphics showing the areas of unit 17 in question and explained the engineering analysis required. The City Planner addressed Vice Mayor McCarthy's concerns regarding whether or not there is sufficient right-of-way on Stratton Avenue for future use. He said right-of-way would have to be increased on Stratton Avenue for it to function as a major collector as described in the city's comprehensive plan and that since Stratton Avenue is indicated as a collector loop in the county impact fee ordinance it should be, by all indications, subject to impact fee moneys for acquisition of right-of-way. George Kulczycki, GDC, expressed his willingness to go forward as soon as an analysis can be done. Mr. Kulczycki was given authority at this meeting by GDC officials to cap engineering analysis costs at $15,000. Mayor Votapka advised that staff review the cost figure to be certain that $15,000 might not be too limiting. Ralph (Cap) Cain, Assistant Vice President in charge of Community Affairs, GDC, said as soon as the city accepts improvements in unit 17 it will begin in unit 16. Vice Mayor McCarthy recommended that other issues regarding acquisition of Stratton Avenue right-of- way, public service tracts, and property adjacent to Barber Street Sports Complex be addressed at this time. 3 City Council Workshop February 7, 1990 PaGe Four The City Manager said GDC had expressed an interest in working with the city on these issues and that staff could address them before the next meeting and report to Council, although backup won't appear in Council packets. Council concurred. This item was placed on the February 14, 1990 agenda. 90.040 Discuss RebroadcastinG City Council MeetinGs on the Following Day (Requested by Vice Mayor McCarthy - No Backup) Following a discussion on the matter of rebroadcastinG City Council meetings and input from Ken Vickers, General Manager, Falcon Cable, Council concurred that Mr. Vickers would install an audio switching mechanism in City Council chambers at Falcon's expense and that when the installation is done, rebroadcasts will be aired on the Friday mornings following meetings. 89.228 Review Personnel Re-Classification Requests (City ManaGer Recommendation dated 2/1/90, Summary of General Fund Requests, Memo from City Manager dated 11/29/89) Following discussion of recommended personnel re- classification requests, the item was placed on the February 14, 1990 agenda for action. The City ManaGer said a budget amendment would be prepared. Mayor Votapka called recess at 8:40 p.m. and reconvened the meeting at 8:54 p.m. Ail members were present. 89.156 Review Ordinance No. O-90-01 - Contractor Licensing (Staff Recommendation dated 1/18/90, O-90-01) City Council reviewed the ordinance and minor amendments were made. Council concurred with the recommended action of the City Manager to schedule first readinG of the ordinance, although it was set for February 28, 1990 to allow time for correction by the City Attorney. The City Manager said recommendations would be presented to Council regarding additional personnel for the Department of Community Development at or prior to second reading of the ordinance. 4 City Council Workshop February 7, 1990 Page Five 90.041 E. DiScuss Planning and Zoning Recommendations Re: Utility Poles in City Right-of-Way and Drainage Ditches (Staff Recommendation dated 2/1/90, Memo from Director of Community Development dated 2/1/90) City Council did not concur with the recommendations of Planning and Zoning to require placement of all utility poles in dedicated city right-of-way, since the City Attorney said he felt that utilities have a property interest in ad3acent utility easements, and to require placement in city right-of-way could be construed as a taking. Council also did not concur with the recommendation for forty foot instead of thirty foot clearance for utility lines over drainage ditches. 90.019 Review Annexation Committee Report (City Manager Recommendation dated 2/1/90, 10/27/89 Annexation Committee Meeting Minutes, Map) Council concurred that the annexation committee pursue the annexation of enclaves in the city but cease any further investigation of annexation of property west of city limits to 1-95 at this time. 90.042 Discuss City Board Handbook (City Clerk Recommendation dated 1/4/90, Memo from City Clerk dated 1/4/90, Proposed Handbook was distributed to Council 12/4/89) Following some discussion, the City Clerk was directed to redraft Resolution No. R-89-13 regarding procedures for city board appointments for review at the April 4, 1990 workshop and to distribute the proposed Board Handbook at this time. At this time, City Council addressed City Manager's Matters. 11. CITY MANAGER MATTERS The City Manager stated that Attorney Nash's firm would be unable to represent the city if there is action relative to Mercedes Homes, since Mercedes is a client of his firm. Therefore, legal counsel may need to be retained. The City Manager recommended the appointment of Attorney Tsamoutales. He also said he would place the appointment on the February 14, 1990 agenda. City Council Workshop February 7, 1990 PaGe Six The City ManaGer, in response to the Mayor's concerns regardinG lack of notification of the recent plane crash at the airport and request for establishment of a notification policy, said he had requested input from department heads on establishment of such policy. In response to Vice Mayor McCarthy, the City ManaGer said 911 calls are received by the Sheriff's Department and routed to Sebastian Police if in the city's jurisdiction. In response to Councilman Oberbeck, the City Attorney said the mutual aid agreement is in the process. 8. MAYOR'S MATTERS Mayor Votapka said he was informed by Jim Davis, County Public Works Director, that the county has encountered a problem with FEC Railroad and DOT on the CR 512 crossinG; said Mr. Davis could meet with the City ManaGer and possibly prioritize riGht-of-way acquisition in regard to Stratton Avenue; and, requested discussion of extendinG use of the existinG library buildinG to the Sebastian Historical Society. Council concurred with waitinG until the new library is opened to discuss the matter. MOTION by McCollum I move we extend the meetinG fifteen minutes. MOTION DIED for lack of a second.
