MINUTES OF PUBLIC HEARING OF JANUARY 14, 1974 AND MINUTES OF REGULAR MEETING OF JANUARY 14, 1974 WERE APPROVED AS READ. MINUTES OF SPECIAL MEETING OF JANUARY 30, 1974 WERE ALSO APPROVED AS READ. MOTION 8Y VICE MAYOR YATES AND SECONDED BY COUNCILMAN KINARD THAT JANUARY 8iLLS IN THE AMOUNT OF $3,373.76 8E APPROVED AS READ. CARRIED. MR. KOHL, RESIDENT OF SEBASTIAN HIGHLANDS, SPOKE OF HIS DISAPPOINTMENT THAT THE CITY COUNCIL HAD SO QUICKLY ACCEPTED GDC'S OFFER TO GIVE THE YACHT CLUB TO THE CITY. HE FURTHER STATED THAT THE MATTER IS NOW BEFORE STATE OFFICIALS IN TALLAHASSEE. VICE MAYOR YATES REPORTED CONSTRUCTION IS PROGRESSING SATISFACTORILY ON THE NEW COMMUNITY BUILDING AND REMODELING OF CiTY HALL. CHIEF CUMMINS REPORTED 131 COMPLAINTS WERE ANSWERED DURING JANUARY BY THE POLICE DEPARTMENT. THESE DID NOT INCLUDE TRAFFIC STOPS. A TOTAL VALUATION OF $195,326.88 HAS BEEN STARTED IN JANUARY FOR NEd CONSTRUCTIONS, ADDITIONS & REPAIRS. MAYOR CRAGG REPORTED THE CITY ISSUED 141 BUILDING PERMITS IN 1973 FOR A TOTAL VALUATION OF APPROXIMATELY $2,400,000. MR. SKIP GRAY, CHAIRMAN OF THE PLANNING & ZONING COMMISSION, STATED THERE WOULD BE A PUBLIC HEARING ON FEBRUARY 21, lg?4 WITH A ZONING MEETING TO FOLLOW. MR. VOCELLE, ON BEHALF OF THE CITY, HAS FILED A MOTION TO DISMISS THE AMENDED COMPLAINT ON THE ANNEXATION SUIT FILED BY DR. FISCHER AND MR. GROVER FLETCHER, AS NELL AS A MOTION TO STRIKE VARIOUS PORTIONS OF THE AMENDED COMPLAINT. THIS WILL BE HEARD BY JUDGE SMITH, PROBABLY ONE DAY THIS WEEK. MAYOR CRAGG MADE THE FOLLOWING ANNOUNCEMENTS: T~O ADDITIONAL NAMES HAVE BEEN ADDED TO THE CEMETERY COMMITTEE, DAN POTTINGER AND FLORENCE PHELAN. AT THE WORKSHOP MEETING LAST WEEK, IT WAS AGREED TO ADOPT COUNCILMAN KINARD'S SUGGESTION THAT AN A~ARDS~ COMMITTEE BE ESTABLISHED. THE PURPOSE OF THE COMMITTEE dILL BE T~REVIEW ALL 8IDS AND MAKE RECOMMENDATIONS TO THE COUNCIL. THE COMMITTEE WILL BE COMPRISED OF MEMBERS OF THE FINANCE COMMITTEE, PLUS THE DEPARTMENT HEAD CONCERNING THE BID. A FRANCHISE CHECK WAS RECEIVED TODAY FROM THE FLORIDA POWER & LIGHT COMPANY WHICH SHOWS A CONSIDERABLE INCREASE OVER THE lg?2 FRANCHISE ~EE. ANOTHER INDICATION OF THE GROWTH OF SEBASTIAN. COUNCILMAN FLOOD WILL ATTEND THE FLORIDA LEAGUE OF CITIES ANNUAL CONFERENCE MEETING IN TALLAHASSEE ON MARCH 11-12, 1974. IN THE MINUTES OF THE REGULAR MEETING OF JANUARY 14, 1974, A MOTION WAS MADE TO DECLINE MEMBERSHIP IN THE EAST CENTRAL FLORIDA REGIONAL COUNCIL. HOWEVER, MAYOR CRAGG HAS BEEN ADVISED HE dILL BE ASKED TO REPRESENT THE COUNTY ON THE PROJECT COMMITTEE, ALONG WITH VAL BRENNAN OF VERO BEACH. WITH REFERENCE TO THE ENFORCEMENT OF SHRUBBERY PLANTINGS AS IT PERTAINS TO THE NEd ZONING ORDINANCE, MR. VOCELLE VOICED THE OPINION THAT UNDER THE ENFORCEMENT PROVISIONS OF THE ORDINANCE, THE MAYOR OR BUILDING OFFICIAL, OR ANYONE DULY DESIGNATED BY THE CITY COUNCIL, IS DIRECTED TO ENFORCE THE ORDINANCE. HE SUGGESTED THE BUILDING OFFICIAL GIVE VERY CAREFUL SCRUTINY TO THE TYPE OF PLANTS OR SHRUBBERY THAT MAY BE INCIDENT TO THE RESIDENCE OR COMMERCIAL BUILDING FOR ~HICH AN APPLICANT IS REQUESTING A BLDG PERMIT. R~UL~B MEETING FEBRUARY ~l~ 1~74 ~c~nt'd) MAYOR CRAGG WILL REQUEST THE BUILDING INSPECTOR TO MAKE A TOUR OF THE CITY TO DETERMINE IF ANY PLANTS OR SHRUBBERY DO OBSTRUCT TRAFFIC OR TRAFFIC VISIBILITY, AND ASKED THE MEMBERS OF THE COUNCIL TO SUBMIT TO THE BUILDING OFFICIAL A LIST OF ANY KNOWN VIOLATIONS. THE BUILDING INSPECTOR CAN THEN GET TOGETHER WITH THE POLICE CHIEF OF ANY VIOLATIONS. VICE MAYOR YATES HAS ADVERTISED THE GARBAGE TRUCK FOR SALE IN A PALM CITY NEWSPAPER (FLORIDA EQUIPMEN EXCHANGE ADVERTISER WHICH HAS WIDE DISTRIBUTION THROUGHJTHE STATE. ND ACTION WAS TAKEN ON ELECTRICAL PERMITS - THIS WILL BE 8RDUGHT UP AT THE NEXT REGULAR MEETING. A MDTIDN WAS MADE BY CDUNCILMAN HDDSE AND SECDNDED BY CDUNCILMAN KiNARD TD TRANSFER $4,000 FROM THE CEMETERY SAVINGS ACCOUNT TD THE CEMETERY CHECKING ACCDUNT TO TAKE CARE OF CURRENT BILLS. CARRIED. MOTION BY COUNCILMAN HOOSE, SECONDED BY COUNCILMAN FLDOD, THAT THE CEMETERY COMMITTEE, WITH THE COUNCIL'S CONSENT, BE GIVEN THE POWER TO PROMULGATE, FRDM TIME TO TIME, RULES AND REGULATIONS FUR THE SEBASTIAN CEMETERY. CARRIED. CDUNCILMAN HOUSE STATED THE RULES AND REGULATIDNS COVERING THE CEMETERY, DATED DECEMBER 8, lg5g THi OF APRIL 9, 1973, WILL BE REVIEWED AND A NEW SET OF RULES AND REGULATIONS ESTABLISHED AND PRESEN TO THE COUNCIL AT A LATER DATE. MR. VOCELLE COMMENTED THAT ANY NEW RULES WOULD NULLIFY THE OLD RULES IF THEY WERE IN CONFLICT. MOTION BY COUNCILMAN. FLOOD, SECONDED BY COUNCILMAN KINARD, TO ACCEPT THE PROPOSED CITY INSIGNIA WITH TI EXCEPTION THAT THE WORDING #HOME OF PELICAN ISLAND# BE PLACED IN SMALL 8LOCK LETTERS AT THE BOTTOM OF THE INSIGNIA INSTEAD OF ENCIRCLING IT. CARRIED. A DISCUSSION ENSUED CONCERNING MR. STEVENSON'S RECENT VERBAL REQUEST TO REMOVE 16 TREES ON THE CITY RIGHT-OF-WAY IN FRONT OF HiS PROPERTY. NO ACTION WILL BE TAKEN UNTIL MR. STEVENSON SUBMITS A LETTER TO THE CITY CITING HIS PURPOSE FO~WANTING THE TREES REMOVED. MR. W. C. BETZ, CHAIRMAN OF THE BOARD OF ADJUSTMENTS, ADVISED THAT GDC'S REQUEST FOR A VARIANCE ON PARCEL #E, BLOCK 409 (305 MANLY AVE.) HAD BEEN APPROVED, BUT ADDED IT IS OF THE UNANIMOUS OPINION THAT ANY FURTHER VARIANCE REQUEST WILL BE LOOKED UPON WITH DISFAVOR. A LETTER WAS RECEIVED FROM MR. W.E.DUNKELBERGER REQUESTING VARIANCES ON LOTS 4 & S, BLOCK 7, HARDEE ADDITION, PRESENTLY ZONED R-1M, MOBILE HOME. MR. DUNK£LBERGER WANTS TO PUT TWO SMALL TRAVEL TRA] ON HIS LOTS. ATTORNEY VOCELLE STATED THAT ~NASMUCH AS THIS WAS NOT A HARDSHIP CASE, IT SHOULD BE DIRECTED TO MR. SKIP GRAY, CHAIRMAN OF THE PLANNING & ZONING COMMISSION. VICE MAYOR YATES SUGGESTED A SPOT CHECK BE MADE TO RiD THE CITY OF ALL JUNK CARS AND OTHER LARGE ITEMS, SUCH AS DISCARDED REFRIGERATORS, ETC. MAYOR CRAGG WILL ATTEND A MEETING OF THE gl1 COMMITTEE ON TUESDAY, FEBRUARY 12, 1974, AT 1 P.M. MOTION TO ADJOURN. City Clerk
