MOTION' E.:ide by Councilm::::in Br:iddock, seconded by Councilman Park, that the
City of Se'bastian accept City Engineer, Z"~iller Hallowed' final
estimates of Street and Sidewalk construction contract with the
Y. B. McCrary Engineering Corporation as of February 15th, 1928.
Mot ion unanimously carried.
~i,{0TION made by Councilraan Hai~dee'and seconded by Councilman Lawson,that
certified check of ~1,000.00, deposited with the City by tho J. B.
McCrary Co. with their bond bid December 12'th, 1927, be returned to
the J. B. McCrary Company.
Motion carried.
Letter in reference to ditch court of the ot.and::~rd 0il Co. property in
the' City of oobaot~an, ~ · ~' "was read and referred to the Street and ~.~!ley
Committee for infor~m~tion and to report their findings at the next re~%iular
me e ting.
RESOLUTION NO. ~'~ ~. k3
Upon motion made by Councilman Braddock and seconded by Councilman ~'ark,
the followings resolution was unamiously adopted:
Be It Resolved, by the City Council of the City of Sebastian, :~ municipal
corporation of the state of Florida;
1. That the Said City hereby aonsents to and agrees to enter into an
acreem~nt with the Florida East Coast Railway Company, a corpOration, wherein
and whereby said City is gr,inted the right and privileges to cross the right-
Of-way and under the tracks of said Railway Company with a two thousand five
hundred (2~00) volt subgrade electric wire, encased in conduit, located at a
point two thousand nine hundred and sixty-one (~961) feet southerly from
Said Railway Company's },{ilo post ~212, under the terms .and conditions alll
as appears in copy of said agr.;~ement, attach~,.d hereto and made a part of this
resoldt ion.
2. That the l~ayor, with the attestation of the City Clerk be, and they
each are, hereby authorized and directed to execute said agreement for and
on'behalf of the City of Sebastian, a municipal corporation of the State of
Florida.
Those voting in favor of the above resolution were:
Ayes: Councilmen W. A. Martin, R. O. Hardee, W. C. Braddock, P. P
Lawson and S.'A. Park.
Those voting against the nbove resolution wore: None.

tho following resolution was unanimously adopted:

corporation of th.e State of Florida;
1. That the said City hereby consents to and agrees to enter into an
agreement with Florida East Coast Railway Company, a corporation, vcherein and
whereby Said City is granted the right and privilege to erect, maintain and u~
a whiteway standard at a point two thousand two hundred sixty six and three-
tenths (2266.3) feet southerly from Failway Company's Mile Post $214, under
the terms and conditions all ,is appears in copy of said.%<~roement, attached
hereto and made a p~t of this resolution.
2. That the Mayor, with the attestation of thc City Clerk be, and they
each are, hereby authorized and diroct.u'd to execute said agreement for and
on 'behalf of the City of Sebastian, a municipal corporation of the State of
Florida.
