MAYOR CRAGG CALLED THE MEETING TO ORDER AT 10:30 A.M.
PRESENT.
ALL COUNCIL MEMBERS WERE
THE PURPOSE OF THE MEETING WAS TO DISCUSS THE L. E. MYERS CO. REQUEST TO PARK AN
OFFICE TRAILER AND HEAVY DUTY EQUIPMENT BEHIND THE UNION 76 STATION ON U.S. #1.
MAYOR CRAGG RECITED ALL THE POINTS BROUGHT OUT AT THE MONDAY NIGHT COUNCIL MEETING
ON FEBRUARY 14TH AND REPEATED THE MOTION MADE AT THE MEETING. HE MENTIONED THAT HE
HAD DISCUSSED THIS WITH ATTORNEY VOCELLE.
MAYOR CRAGG ALSO MENTIONED THAT MR. EARMAN, OF EARMAN OIL CO., HAD REACHED AN AGREE-
MENT WITH L. E. MYERS CO. TO ALLOW THEM TO PARK ON SAID PROPERTY AND THEY IN TURN
WOULD PURCHASE GAS AND OiL, ETC. FROM THE INSTA-MART WHILE TRUCKS WERE ALLOWED TO
PARK THERE. MR. CRAGG READ THE DETAILS FROM THE C-1 RETAIL REQUIREMENTS IN THE
ZONING ORDINANCE # 202, QUOTING ..... "LIMITATION OF USES: EXCEPT FOR AUTOMOBILE
PARKING LOTS, DRIVE-IN BANKS, AND THOSE LISTED IN SPECIAL EXCEPTIONS, ALL ACTIVITIES
OF PERMITTED USES, INCLUDING SALE, PREPARATION, AND STORAGE SHALL BE CONDUCTED EN-
TIRELY WITHIN A COMPLETELY ENCLOSED BUILDING", PLUS ITEM # 14 ON PAGE 24, DATED
JANUARY 14, 1974, QUOTING ....... "RETAIL SALES STORES - ONE (1) SPACE FOR EACH TWO
HUNDRED (200) SQUARE FEET OF RETAIL FLOOR SPACE". MR. RUSSELL NORRIS, HEAD FOREMAN
OF L. E. MYERS CO., SAID THAT THE HOURS THE TRUCKS WOULD BE IN USE WOULD BE 8:00 A.M.
TO 4:30 P.M. OTHERWISE THERE SHOULD BE NO ACTION AROUND THE TRUCKS AND EQUIPMENT
WHILE THEY ARE PARKED OVERNIGHT. THE TRAILER WILL BE PARKED ELSEWHERE. MR. EARMAN
REMARKED THAT IF THERE SHOULD BE ANY TYPE OCCURRENCE AFTER HOURS, IT WOULD BE A
POLICE MATTER AND THE LOCAL PO~'~ W-~-UL~--~-~E~-~A~-~ OF IT. MR. NORRIS ASSURED THE
COUNCIL THAT HIS WORKERS SHOULD''~T GiVE~----~A_~ ~R~BLE. COUNCILMAN SZELUGA REMARKED
THAT IF THERE WERE ANY COMPLAIN US OW DISTURBAN~E~ THE CITY CAN DEMAND THE REMOVAL OF
MOTION BY COUNCILMAN SZELUGA TO RESCI'NiL'THE--~NTIB~-MOTIOAUMADE AT THE REGULAR COUNCIL MEETING OF
FEBRUARY 14TH, WHICH READS AS FOLLOWS: "MOTION TO DENY THE L. E. MYERS CO. REQUEST TO PARK ANY

tisement; and affiant further says that he has neither paid nor promised any person, firm or
corporation any discount, rebate, commission or refund for the purpose of securing this adver-
tisement for publication in the said newspaper.
