NEW BUSINESS: DISCUSSION OF HIRING INDEPENDENT LEGAL COUNSEL APPROVING TRAVEL EXPENSES ADJOURN NOTE: ANYONE WHO MAY WISH TO APPEAL ANY DECISION WHICH MAY BE MADE AT THIS MEETING WILL NEED TO ENSURE THAT A VERBATIM RECORD OF THE PROCEEDINGS IS MADE WHICH INCLUDES THE TESTIMONY AND EVI- DENCE UPON WHICH THE APPEAL WILL BE BASED. SPECIAL COUNCIL MEETING CITY OF SEBASTIAN FEBRUARY 21= 1984 SPECIAL COUNCIL MEETING, CITY OF SEBASTIAN, CITY COUNCIL CALLED TO ORDER BY MAYOR PAT FLOOD, JR. AT 7:00 P.M. PRESENT: VICE MAYOR ROBERT FITZMAURICE COUNCILMAN RICHARD SZELUGA COUNCILWOMAN DOROTHY MCKINLEY COUNCILMAN JAMES GALLAGHER CITY ATTORNEY DANIEL KILBRIDE MAYOR PAT FLOOD, JR. MINUTES: SPECIAL COUNCIL FEBRUARY 21, 1984 MAYOR FLOOD RECOMMENDED TO THE COUNCIL THAT MR. RUSSELL PETERSEN, ATTORNEY AT LAW BE HIRED AS AN INDEPENDENT LEGAL COUNSEL TO ASSIST VICE MAYOR FITZMAURICE IN THE INVESTIGATION OF THE SEBASTIAN POLICE DEPARTMENT, TO ASSURE THE INVESTIGA- TION WILL BE CONDUCTED WITHIN THE LOCAL BOUNDARIES OF THE CITY CHARTER AND THE LAWS OF FLORIDA. MOTION BY COUNCILMAN GALLAGHER, SECONDED BY COUNCILWOMAN MCKINLEY, THAT THIS CITY COUNCIL INVITE THE STATES ATTORNEY, THE GOVERNOR, THE FLORIDA DEPARTMENT OF LAW ENFORCEMENT TO DO A THOROUGH INVESTIGATION OF THIS CITY INCLUDING ALL SUBSIDARIES, THE GOLF COURSE INCLUDED. --MAYC4~- FLO~-t~ MOTION NOT CARRIED. ATTORNEY KILBRIDE RECOMMENDED TH~E~NCIL CONSIDER HIRING LEGAL COUNSEL, SINCE THE POLICE DEPARTMENT HAS PETITIO~D COMMUNICATIONS WORKERS OF AMERICA CONCERNING UNIONIZATION. IN VIEW OF T.TE~_~IME FRAME, ATTORNEY KILBRIDE STATED MOTION BY VICE MAYOR FITZMAURICE, SECONDED BY COUNCILMAN GALLAGHER, TO BRING L OTE.'-- VZ'RE', AYOR FIrZ, A RI C ATTORNEY LINN. NAYS: COUNCILWOMAN MCKINLEY MOTION DIED. THE FOLLOWING DISCUSSION PERTAINS TO THE RECOMMENDATION OF HIRING MR. RUSSELL PETERSEN , ATTORNEY AT LAW, AS AN INDEPENDENT LEGAL COUNSEL TO ASSIST VICE MAYOR FITZMAURICE . MOTION BY COUNCILMAN SZELUGA, SECONDED BY COUNCILMAN GALLAGHER, THAT THE FLORIDA DEPARTMENT OF LAW ENFORCEMENT CONDUCT THIS PARTICULAR INVESTIGATION. COUNCILMAN GALLAGHER WITHDRAWS HIS SECOND. COUNCILMAN SZELUGA WITHDRAWS THE MOTION. MOTION BY COUNCILMAN SZELUGA, SECONDED BY COUNCILMAN GALLAGHER, THAT THE FLORIDA DEPARTMENT OF LAW ENFORCEMENT CONDUCT A THOROUGH INVESTIGATION OF CERTAIN ACTIVITIES OF THE POLICE DEPARTMENT RELATIVE TO POLICE OFFICERS RESIGNING AND ALSO TO INVESTIGATE THE RELATIONSHIP AND THE ACTIVITIES BETWEEN THE OFFICE OF THE MAYOR AND POLICE DEPARTMENT. IN RESPONSE TO COUNCILMAN GALLAGHER'S QUESTION, ATTORNEY KILBRIDE STATED THAT HE WAS NOT CERTAIN WHETHER THE F.D.L.E. IS THE PROPER AGENCY TO INVESTIGATE, SINCE WE ARE DEALING WITH A MANAGEMENT QUESTION AND THE BASIC RESPONSIBILITY OF THE F.D.L.E. IS TO INVESTIGATE CRIMINAL VIOLATIONS. HE RECOMMENDED THAT THE COUNCIL CONSIDER SOME OTHER AGENCY TO INVESTIGATE. ROLL CALL VOTE: A YES: VICE MAYOR FITZMAURICE COUNCILMAN SZELUGA COUNCILWOMAN MCKINLEY COUNCILMAN GALLAGHER MAYOR FLOOD NAYS: NONE MOTION CARRIED. MINUTES: SPECIAL COUNCIL FEBRUARY 21, 1984 MAYOR FLOOD WITHDRAWS HIS REQUEST FOR MR. FITZMAURICE TO GO ON WITH THE INVESTIGA- TION AND ALLEGATIONS AT THIS TIME. THERE BEING NO FURTHER BUSINESS, MEETING ADJOURNED AT 5 :lO P.M. CITY CLERK MAYOR MINUTES APPROVED AT REGULAR COUNCIL MEETING ON APRIL ll , 1984.
