CiTY COUNCIL CHAMBERS 1225 MAIN STREET, SEBASTIAN, FLORIDA ALL PROPOSED ORDINANCES AND INFORMATION ON ITEMS LISTED BELOW MAY BE INSPECTED IN THE OFFICE OF THE CITY CLERK, CITY HALL, 1225 MAIN STREET, SEBASTIAN, FLORIDA. PURPOSE: Consider Closing Runway 13-31, Sebastian Municipal Airport 1. Mayor Votapka called the special meeting to order at 7:03 p.m. 2. The Assistant City Manager led the Pledge of Allegiance. 3. ROLL CALL Present: Also Present: Vice Mayor Robert McCarthy Councilman Lloyd Rondeau Councilman Frank Oberbeck Councilman Robert McCollum Mayor Richard Votapka City Manager, Robert McClary Assistant City Manager, JoAnne Townsend City Clerk, Kathryn O'Halloran Deputy City Clerk, Sally Malo Mayor Votapka announced the purpose of the meeting and turned over the introduction to the City Manager who, after giving a brief history of events leading to this special meeting, recommended that Council concur with the recommendation of the FAA and Special Legal Counsel, Eliot Cutler to take no action on 1 Special City Council Meeting February 21, 1990 Page Two Resolution No. R-90-11 at this time and allow for public input. The City Manager read a letter to the Assistant City Manager from James E. Sheppard, FAA (see attached). Mayor Votapka read Resolution No. R-90-11 in its entirety. 4. PUBLIC INPUT ON AGENDA ITEMS ONLY The following addressed Council regarding Resolution No. R-90-11. George Reid, 202 DelMonte Road, Sebastian; Robert Musante, 7925 126th Street, Roseland Road; Kathleen Hoffman, 11 Sunset Drive, River's Edge; Sam Marshall, 902 Jamaica Street, Sebastian; Steve Johnson, 12385 Roseland Road, Roseland; Art Lemire, 374 Citrus Avenue, Sebastian; George Metcalf, 425 Pine Street, Sebastian; Earl Masteller, 869 Robin Lane, Sebastian; Ruth Paasch, 219 Cedar Street, Sebastian; Anne Putman, 563 Cross Creek Circle; David O'Donnell, 2450 53rd Avenue, Vero Beach; Walter Lund, 561SW Jay Street, Sebastian; John Reid, AOPA, Marco Island; Larry Brown, 44 Sunset Drive, River's Edge; Frank DeJoia, 11625 Roseland Road; Robert Blumfield, 3945 Peppertree, Grant; John McCrory, 821 Foster Street, Sebastian; Robert Weston, 737 Albatross Terrace, Sebastian; Arly Buck, 35 Sunset Drive, River's Edge; and Don Hall, 114 Crawford Drive, Sebastian. During public input a dialogue took place between Council and employees of Pro-flite and Flight Safety who expressed a willingness to meet with staff to try to alleviate flight training problems at the airport. Mayor Votapka closed public input at 8:42 p.m., called recess at 8:43 p.m. and reconvened the meeting at 8:57 p.m. All members were present. RESOLUTION NO. R-90-11 - Closing Runway 13-31, Sebastian Municipal Airport A RESOLUTION OF THE CITY OF SEBASTIAN, INDIAN RIVER COUNTY, FLORIDA, PERTAINING TO THE SEBASTIAN MUNICIPAL AIRPORT; PROVIDING FOR THE TEMPORARY SUSPENSION OF AIRCRAFT USE OF RUNWAY 13-31; DIRECTING THE CITY MANAGER TO REQUEST THAT A SAFETY STUDY BE CONDUCTED BY THE FEDERAL AVIATION ADMINISTRATION OF THE OPERATION OF RUNWAY 13-31; DIRECTING THE CITY 2 Special City Council Meeting February 21, 1990 Page Three MANAGER TO PROVIDE NOTICE OF THE TEMPORARY CLOSING OF RUNWAY 13-31 TO THE PUBLIC; PROVIDING FOR THE MAINTENANCE OF RUNWAY 4-22 DURING THE PERIOD OF TIME THAT RUNWAY 13-31 IS CLOSED; PROVIDING FOR REPEAL OF RESOLUTIONS OR PARTS OF RESOLUTIONS IN CONFLICT HEREWITH; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. Each Councilman expressed his views on the matter. MOTION by Oberbeck I move we dismiss Eliot Cutler as Special Legal Counsel immediately. MOTION DIED for lack of second. Discussion followed on what action should be taken. MOTION by Oberbeck/McCarthy I move we that we defer to a time uncertain Resolution No. R-90-11 pending the outcome of the meeting with Flight Safety and Pro-Flite and other training schools and hold Mr. Cutler in abeyance until such time. ROLL CALL: Vice Mayor McCarthy - aye Councilman McCollum - aye Councilman Oberbeck - aye Councilman Rondeau - aye Mayor Votapka - aye MOTION CARRIED 5-0. McClary ~ Jo Anne Townse~ Proposed Closi~of Runway 13-31 Attached you will find a letter I received late this afternoon from James Sheppard, Manager of the Orlando Airports District office of the Federal Aviation Administration. As you can see, Mr. Sheppard believes your adoption of a resolution temporarily closing Runway 13-31 violates the terms of the Quitclaim Deed as well as the Standstill Agreement. Upon receipt of this letter, I contacted our special legal counsel, Eliot Cutler. Mr. Cutler believes the Council may discuss the proposed resolution and may listen to residents' concerns; however, he believes the Council should NOT take any formal action on the proposed resolution tonight. Accordingly, I would respectfully request the Council to defer formal consideration of this matter. Box 780127 sebastian, FL 32978 Dear Ms. Townsendt This concerns the proposed Airport Resolution to be considered by City Council this evening. We have no information that use of Runway 13/31 is unsafe. Therefore, we cannot concur in the closure of the Runway. For the City of Sebastian to declare the Runway unsafe and to close it without specific supporting information, is contrary to the terms and conditions of the Quit Claim Deed. It is also contrary to the Agreement in Principle Between the City of Sebastian and the Federal Av].ation Administration. Therefore, the p~oposed Airport Resolution should be rejected.
