Construction Board — Fill One Expired, Regular Member Plumber Position and One Expired, Regular Member Contractor Position The City Clerk explained the terms of both James Fortier and Richard Wilcher have expired but they are both willing to serve another term on the Construction Board. MOTION by Mayor Dodd and SECOND by Council Member Jones to reappoint James Fortier and Richard Wilcher to the Construction Board. The MOTION carried by a unanimous voice vote of 3-0. 24.008 C. Annual Report from the Planning and Zoning Commission Ms. Kautenburg, Chairperson of the Planning and Zoning Commission, noted that the Planning and Zoning Commission is an advisory board to the Council. They study the requests presented to them, the blueprints and the plans, and balance the requests against current zoning and the City's strategic plan. She commended City Staff and the Commission for doing a marvelous job and getting a tremendous amount of work done. In the past year, the Planning and Zoning Commission has dealt with five conditional use permits, three site plans, two accessory structure reviews, two Land Development Code amendments, two special use permits, five rezoning requests, and three small scale comprehensive plan future land use map amendments. Ms. Kautenburg noted that their meetings are open to the public, and there is time for input from citizens on every topic. Mayor Dodd asked for public feedback, and Damien Gilliams criticized the Planning and Zoning Commission for allowing out-of-town food trucks for up to three days because this action was not supportive of existing brick -and -mortar businesses within the community. This also results in sales taxes revenue not being kept within the community. Mr. Gilliams claimed that the Planning and Zoning Commission "picks and chooses the winners of this community" and that affects whether people want to do business in Sebastian. Mayor Dodd responded to the criticism by giving kudos to the Planning and Zoning Commission for upholding the Ordinances of the City of Sebastian. He stated that any business interested in changing their business model is welcome to submit a new site plan to the Growth Management Department in order to accomplish their plans. Mayor Dodd recessed the City Council meeting and convened the Community Development — Agency meeting at 6:45 p.m. The City Attorney reminded the Mayor that due to the absence of two Council Members this evening, any non -procedural action items going forward would need affirmative votes of three or more Council Members to proceed. The City Manager mentioned that he had been heard from Council Member McPartlan and he should be available on Zoom shortly. 10. COMMUNITY REDEVELOPMENT AGENDA A. Consideration of a Sign and Landscape CRA Grant for Commercial Dumpster Improvements at Davis House Inn Regular City Council & CRA Minutes October 16, 2024 Page 7 The Community Development Director explained this is a request to make use of the facade improvement program that allows the Community Redevelopment District to use up to $1,500 in funds to improve properties. All requirements for the funding have been met and Staff recommends approval. Mayor Dodd asked for public input, and Mr. Gilliams commented that he would like some help from the City with the dumpster on his commercial property, as well as with his hookup from septic to sewer which he has been trying to do since 2015. MOTION by Council Member Jones and SECOND by Vice Mayor Dixon to approve the CPA grant for the commercial dumpster improvements for the Davis House Inn passed with a unanimous voice vote of 3-0. B. Consideration of Issuance of a Purchase Order in the Amount of $22.236.42 to Jordan Power Eauinment for the Purchase of Scae Zero Turn Stand -on Mowers for the Parks and Recreation Department to Handle CRA Landseaning The Community Development Director explained that the Parks Department will now be providing its landscaping services in house and lawnmowers were needed. The purchase of the lawnmower will help the City to reduce costs for landscaping. MOTION by Vice Mayor Dixon and SECOND by Council Member Jones to approve the purchase of the lawnmowers. Mayor Dodd asked for public input, and Mr. Gilliams said he has been mowing the right of way near his property for over 32 years and he is glad the City will be handling some of its own mowing responsibilities now. Roll call: Mayor Dodd - aye Vice Mayor Dixon - aye Council Member Jones - aye Motion carried. 3-0 Chairman Dodd adjourned the Community Development Agency meeting at 6:52 p.m. and - reconvened the City Council Meeting. 11. PUBLIC HEARINGS 24.167 A. Second Readina and Adoption Hearine of Ordinance No. 0-24-18 Rescinding Ordinance No. 0-97-42 Vacating Public Roads in a Portion of Sebastian Highlands Unit 17 The Community Development Director noted this was the second and final reading of Ordinance No. 0-24-18, which rescinds Ordinance No. 0-97-42 in accordance with the developer's agreement for the Sebastian Overlook. Rebecca Miller of MPLD Consulting, representing the applicant, was available for questions. Vice Mayor Dixon asked how the City's ability to check on the project would be impacted once these roads were vacated according to this ordinance. Mayor Dodd clarified that the ordinance rescinds the vacating of the roads and now classifies the area as public growth.
