Mayor Harris called the meeting to order at 7:00 P.M. 2. Attorney Palmer led the Pledge of Allegiance. 3. Invocation was given by Reverend Donald Swope, Sebastian Presbyterian Church. 4. ROLL CALL Present: Absent: Councilman Robert McCarthy Councilman George Metcalf Mayor L. Gene Harris Attorney Thomas C. Palmer Vice Mayor Kenneth Roth (excused) Councilman Peter Vallone (excused) 5. PRQQ~AMATION~/ANNOUNCF~ENTS Mayor Harris requested that the PBA contract with two Police Department lieutenants be added to this agenda. MOTION by McCarthy I move we add the proposed PBA contract to this agenda under New Business. MOTION died for lack of a second. Mayor Harris announced that former Councilman Randy Yoakum had passed away. Councilman Metcalf announced that the revised city base maps and the eight atlas series would be ready the first of the following week. 6. CQM~ITTEE REPORTS When questioned by Louis Priore about an alternate and new regular member for the Board of Adjustment, Mayor Harris said to advertise in local newspapers. 7. INTRODU~T!QN OF BUSINESS FROM THE PUBLIC Mayor Harris opened the introduction of business from the public at 7:10 P.M. Joseph Morizowsky questioned whether the rough road sign on Barber Street was placed there by GDC. Mayor Harris said the city had placed it there. Mr. Morizowsky then questioned why trucks were now allowed on Schumann Drive. Earl Masteller questioned the procedure the city would use for the reproduction of base maps. Attorney Palmer said the city can buy copies from Lloyd at their cost. Mr. Masteller suggested taking a print Indian River Blueprint. Charles Polari, Italian/American Club, urged Council to look favorably on their request for lease amendment. Bob Fullerton recommended approval of purchase of available properties. Art Hallgren, Vice Chairman of the Construction Board, requested financial assistance for special counsel regarding Sebastian Collection of Fine Homes. Councilman McCarthy said since there was no backup for this item it be placed on the March 9, 1988, agenda. Mayor Harris closed the introduction of business from the public at 7:28 P.M. 8. ProPOSed Pgrch~Be of CAVC0RP Property Attorney Palmer had drafted a contract to hold the Boone property for one month at a cost of $100 which Pat Flood of Flood Realty said was unacceptable to the property owner. He said the property owner may accept $1000. MOTION by McCarthy/ I move we place the proposed purchase of the Boone and CAVCORP properties on the March 9, 1988, agenda. MOTION died for lack of a second. Attorney Palmer said these items automatically go to the next agenda if not acted upon tonight. Sebastian Volunteer Ambulance Squad ~ Request for FuRding for Bul. k Mailin~ MOTION by McCarthy/Metcalf I move we approve the request of the Sebastian Volunteer Ambulance Squad and authorize a loan of $1500 for bulk mailing to be paid back from the proceeds of the fund raiser. R-88-26 (Discussion Only) A RESOLUTION OF THE CITY OF SEBASTIAN, FLORIDA, ADDING A NEW JOB DESCRIPTION TITLED "HEAVY EQUIPMENT OPERATOR" TO PART V OF THE CITY OF SEBASTIAN STANDARD OPERATING PROCEDURES; PROVIDING AN EFFECTIVE DATE. E. RESOLUTION NO. R-88-25 (Discussion Only) A RESOLUTION OF ~{E CITY OF SEBASTIAN, FLORIDA, ADDING A NEW JOB DESCRIPTION TITLED "BUILDING MAINTENANCE TECHNICIAN" TO PART V OF THE CITY OF SEBASTIAN STANDARD OPERATING PROCEDURES; PROVIDING AN EFFECTIVE DATE. 87.027 88.047 Attorney Palmer stated that during CWA union negotiations in 1987 the city agreed to enact job descriptions for "Heavy Equipment Operator" and "Building Maintenance Foreman. He said that since the job descriptions have not been enacted the CWA has filed a grievance and was about to go into arbitration. He said enacting the job descriptions now would moot the arbitration. He said no city staff member is currently slotted for either position. DiSCuSsion followed on qualifications for the for "Heavy Equipment'Operator". Councilman McCarthy recommended that Resolutions R- 88-25 and R-88-26 be sent back to be reworked. Ge ORDINANCE NO. 0-88-15 (Second Draft - Set First Reading for 3/9/88) AN ORDINANCE OF THE CITY OF SEBASTIAN, FLORIDA, ADDING A NEW SUB-PARAGRAPH (D) (8) TO SECTION 20A-3.4 AND THEREBY REQUIRING THAT AT LEAST 30 PERCENT OF LOTS IN THE RS-10 SINGLE FAMILY RESIDENTIAL DISTRICT BE MAINTAINED AS PERMEABLE AREA AND 20 PERCENT BE LANDSCAPED; ALSO AMENDING SECTION 20A-13.2 AND THEREBY REQUIRING A MINIMUM NUMBER OF TREES TO BE MAINTAINED ON SINGLE FAMILY RESIDENCES, ALL IN THE CITY'S LAND DEVELOPMENT CODE; ALSO ADDING PARAGRAPH (D) TO SECTION 20A-5.2 ALLOWING MECHANICAL EQUIPMENT IN SIDE YARDS. After some discussion on Ordinance No. 0-88-15, Attorney Palmer was instructed to amend the ordinance regarding the implementation of these code amendments for all zones in the City with fully detached single family and duplex residences and bring it back for first reading on March 23, 1988. 4 88.044 87.047 87.146 QRD/~NAN_C~ NO. 0-88-11 (Memo from Building Official - Options to (C)(4) (lst reading set for 3/23/88) AN ORDINANCE OF THE CITY OF SEBASTIAN, FLORIDA, ADDING A NEW PARAGRAPH (D) TO SECTION 20A-5.16 OF THE LAND DEVELOPMENT CODE AND THEREBY SPECIFYING RESTRICTIONS ON BOATS WITHIN ALL RESIDENTIAL DISTRICTS; ALSO ADDING A NEW SECTION 20A-5.16.1 AND THEREBY ADDING RESTRICTIONS ON LARGE TRUCKS AND HEAVY EQUIPMENT ON PUBLIC PROPERTY OR RESIDENTIALLY ZONED PRIVATE PROPERTY; PROVIDING AN EFFECTIVE DATE. Attorney Palmer was instructed to amend the ordinance using the first option from the Building Official's memo dated February 25, 1988 for first reading on March 23, 1988. Chapter 170 regarding a special assessments program. 10. MAYOR'S MATTERS Mayor Harris urged all people to support the Vero Beach High Achievement Awards. 11. PARKS AND RECREATION COMMITTEE Request t0 Reserve Community C~nte~ for Movie Viewing Every Friday 0r Satu~a~ Night for Children and Allocation of Funds for Chaperones Mayor Harris instructed Nate McCollum of the Parks and Recreation Committee to contact North County Recreation and the PTA for personnel and equipment and report back to Council with a full plan for approval. 88.059 88.060 88.061 Councilman McCarthy suggested that Parks and Recreation consider using the Council Chamber instead of the Community Center. e Req~s~ R~view of General Development Contracts for ~xiste~ce of Clause re: Recreation and/or POQ1 Facilities Nate McCollum said a member of Parks and Recreation Committee was under the assumption that General Development Corporation was supposed to have provided the city with a recreation and/or pool facility. Mayor Harris instructed Attorney Palmer to contact the General Development Corporation Land Sales Board. Request bddktiQ~! Work at Hardee Park ~ Six Items This item was referred back to Jerry Thomas to review and report back to Council at the March 9, 1988 Regular meeting. Jerry Thomas said he was scheduled to meet with Karen Economu of North County Recreation. Mayor Harris called recess at 9:00 P.M. and recalled the meeting at 9:08 P.M. Ail members present at recess were present at recall. E. Discussion/Action ~ Paving 0~ Barber Stregt After some discussion on a special assessment for paving Barber Street and recommendation by Earl Masteller that the city could pave Barber Street without going out to bid by using the state contract, Mayor Harris instructed Jerry Thomas to contact Jim Davis, County Engineer, to get information on the state contract, and report back to Council on March 9, 1988. Pat Flood, former Mayor, said there is an ordinance on the books regarding the use of trucks on Schumann Drive but that it is no longer enforced. Louis Priore said Main Street is in worse condition than Barber Street. 7 88.062 88.063 88.064 88.065 Veto Beach fLi_gtl School AG_ademic Achievement Awards B~nqu~ - Mayor Harris This item was addressed under Mayor's Matters. l%equest from Attorney Ste~I1 Lulich - Am_eD~nt to Italian/American Club Lease Attorney Lulich requested that the lease be amended and that a clause be added that a cap of not more than 100% be placed on the amount of the renewal lease. Attorney Palmer said he concurred with the request. MOTION by McCarthy I move we approve the requested amendments to the Italian/American Club lease and add a cap clause that the lease renewal increase will not exceed 100% of the previous year's lease amount. MOTION died for lack of a second. This item was automatically carried over to the March 9, 1988, Regular meeting. Earl Masteller recommended standardizing all city leases.
