PUBLIC HEARING, MARCH lO, 1975
PUBLIC HEARING CALLED TO ORDER BY MAYOR F. EUGENE CRAGG AT 7 P.M. TO BRING TO THE
PUBLIC'S ATTENTION THE PROPOSED CITY ORDINANCE ON "INSPECTION FEES AND MOBILE HOME
TIE DOWN SPECIFICATIONS. MRS. PHELAN, CITY CLERK, READ THE PROPOSED ORDINANCE
ADOPTING THE RULES OF THE DIVISION OF MOTOR VEHICLES, CHAPTER 15C-1.10 AS AMENDED
AUGUST 6, 1974,ESTABLISHING THE INSPECTION FEES AND AN EFFECTIVE DATE. VICE MAYOR HOOSE
SUGGESTED INCLUDING THE WORD "INSPECTIONS."
THERE WAS NO FURTHER RESPONSE AND THE MEETING WAS ADJOURNED.

THE MEETING WAS CALLED TO ORDER BY MAYOR CRAGG.
PRESENT:
VICE MAYOR CLIFFORD HOOSE, COUNCILMEN "SKIP" GRAY, JAMES C. KINARD AND
PAT FLOOD, JR., AND MAYOR CRAGG.
MINUTES OF REGULAR MEETING OF FEBRUARY 10, 1975 AND SPECIAL MEETING OF FEBRUARY 26,1975
were approved as printed.
MOTION BY VICE MAYOR HOOSE, SECONDED BY COUNCILMAN KINARD, TO PAY FEBRUARY BILLS
AMOUNTING TO $5,535.45. CARRIED.
VICE MAYOR HOOSE REPORTED PLANS FOR THE CENTENNIAL + 10 CELEBRATION ARE PROGRESSING AS
SCHEDULED AND DISCUSSED PREPARATIONS BEING MADE FOR THE PARADE AND THE MISS SEBASTIAN
CONTEST. HE URGED EVERYONE'S COOPERATION AND ATTENDANCE AT ALL EVENTS AND TO ENTER
THE ARTS & CRAFTS CONTEST, THE PIE AND CAKE BAKING CONTEST, AND THE AMATEUR TALENT SHOW.
COUNCILMAN GRAY ANNOUNCED A STREET DEPARTMENT COMMITTEE MEETING WILL BE HELD IN CITY HALL
ON MARCH 11, 1975, AT 8 P.M. TO GO OVER PLANS AND SPECIFICATIONS FOR THE NEW TRACTOR
AND MOWER FOR THE CITY. RECOMMENDATIONS WILL BE SUBMITTED AT THE NEXT COUNCIL MEETING.
COUNCILMAN KINARD EXPECTS TO HAVE THE PUMP MOTOR BACK AT THE CEMETERY BY NOON TOMORROW.
MR. ED KARR REQUESTED PERMISSION TO PLACE A MOBILE HOME FOR RENTING PURPOSES IN THE
REAR OF HIS STORE. THIS MATTER WILL BE TURNED OVER TO THE V ARIANCE BOARD FOR REVIEW
AND RECOMMENDATIONS. COUNCILMAN FLOOD ASKED IF THIS REQUEST HAD COME TO THE CITY
COUNCIL AS IT WAS HIS OPINION THAT ALL SUCH REQUESTS BE SUBMITTED TO THE COUNCIL FOR
REFERRAL TO THE APPROPRIATE BOARD FOR ACTION AND/OR REVIEW.
THE CITY ATTORNEY STATED THAT AS A MATTER OF POLICY, ALL REQUESTS FOR ZONING CHANGES
AND VARIANCES MUST BE DIRECTED TO THE COUNCIL WHICH, IN TURN, WILL TURN IT OVER TO THE
APPROPRIATE BOARD FOR REVIEW, STUDY AND COMMENT. MAYOR CRAGG STATED THIS WOULD
BE THE PROCEDURE TO BE FOLLOWED IN THE FUTURE.
THE BUILDING DEPARTMENT REPORTED $37,825 IN NEW CONSTRUCTION DURING FEBRUARY. INCLUDED
WAS A SINGLE FAMILY RESIDENCE VALUED AT $16,500 WHICH MR. MUMM DID NOT FEEL WAS A
REALISTIC VALUATION AS THE HOUSE WILL PROBABLY SELL FOR $25,000 TO $30,000. HE
SUGGESTED THE CITY CHANGE ITS PRESENT PERMIT FEE ORDINANCE BASING THE COST ON SQUARE
FOOTAGE BASIS OR CUBIC FEET. HE FEELS THE CITY IS LOSING REVENUE UNDER THE PRESENT
SYSTEM. MAYOR CRAGG CONCURRED AND SAID A COMMITTEE WILL BE ESTABLISHED AS SOON AS
POSSIBLE TO START WORK ON MR. MUMM'S RECOMMENDATIONS - OR ANY RECOMMENDATIONS THE
COMMITTEW EARED TO ADD OR DELETE.
THE POLICE CHIEF REPORTED 154 COMPLAINTS ANSWERED DURING FEBRUARY, NOT INCLUDING TRAFFIC
STOPS.
IN VIEW OF SGT BILLINGSLEY'S RESIGNATION BECAUSE OF OUTSIDE BUSINESS INTERESTS, A WRITTEN
TEST WAS OFFERED TO FILL THE POSITION. TWO PEOPLE TOOK THE TEST AND OFFICER JOHN MELTON
MADE THE HIGHER SCORE. BASED ON THIS AND HIS PAST WORK RECORD, CHIEF CUMMINS RECOMMENDED
THATOFFICER MELTON BE PROMOTED TO THE RANK OF SERGEANT AT A BASE PAY OF $168.86 WEEKLY.
MOTION BY VICE MAYOR HOOSE, SECONDED BY COUNCILMAN KINARD, THAT OFFICER JOHN MELTON
BE PROMOTED TO THE RANK OF SERGEANT AT THE SALARY CITED ABOVE. CARRIED,
CHIEF CUMMINS INTRODUCED TWO NEW MEMBERS OF THE SEBASTIAN FORCE - PATROL OFFICERS
JOAN ALLAN AND JOHN PORTER.
MAYOR CRAGG WILL WRITE A LETTER OF APPRECIATION TO MR. ARAND FOR HIS CORDIAL INVITATION
TO THE CITY OFFICIALS TO PARTICIPATE IN THE CENTENNIAL + 10 PARADE.
THE ORANGE HEIGHTS PROPERTY OWNERS ASSOCIATION HAS NOTIFIED THE CITY CLERK THAT THE
BULLETIN BOARD WAS RELOCATED ONFEBRUARY 22, 1975 IN ACCORDANCE WITH THE COUNCIL'S
REQUEST - 20' TO THE SW OF ITS PREVIOUS LOCATION, AND THAT "NO PARKING" SIGNS WILL BE
POSTED ON THE EAST SIDE OF TEMPLE STREET. MRS. PHELAN WAS ASKED TO CHECK WITH
CHIEF CUMMINS REGARDING THE POSTING OF THE SIGNS.
MR. M. R. CALVIN REQUESTED APPROVAL TO BUILD A NEW DOCK ON LOT l, BLOCK 2, INDIAN RIVER
HILLS SUBDIVISION. IT WILL BE APPROXIMATELY 100' LONG AND 4' WIDE, FOR PRIVATE USE
ACROSS FROM HIS HOME AT 425A NORTH INDIAN RIVER DRIVE. MR. CALVIN ASKED PERMISSION TO
CONTACT THE CORPS OF ENGINEERS REGARDING THIS.

REQUEST SUBJECT TO THE APPROVAL OF THE INTERNAL TRUST FUND AND THE CORPS OF ENGINEERS.

HUD HAS REPLIED TO MR. VOCELLE'S LETTER OF MAY ll, 1974 IN WHICH HE INDICATED THE
FLOOD BOUNDARY MAP FOR THE CITY OF SEBASTIAN DID NOT ACCURATELY REFLECT THE FLOOD
HAZARD AREA. BASED ON NEWLY ACQUIRED FLOOD INFORMATION, HUD HAS REVISED THE FLOOD
HAZARD BOUNDARY MAP FOR THE CITY OF SEBASTIAN AND A NEW MAP WILL BE PUBLISHED SHORTLY.
MAYOR CRAGG ASKED THAT THE MATTER BE TABLED UNTIL RECEIPT OF THE NEW MAP.
A LETTER FROM INDIAN RIVER CABLEVISION, FEBRUARY 24, 1975, CONCERNS A MINOR FOOTAGE
ERROR OCCURRED IN THE DEVELOPMENT OF CABLEVISION SYSTEM IN LOTS 15 & 16 OF BLOCK 116,
SEBASTIAN HIGHLANDS, RESULTING IN THE BURIED CABLE BEING PLACED 5' OUTSIDE THE
DEDICATED EASEMENT. INDIAN RIVER CABLEVISION WILL ABANDON THIS CABLE AND RE-INSTALL
A CORRECT CABLE RUN WHEN REQUIRED BY PROPERTY OWNER FOR DEVELOPMENT OF HIS PROPERTY.
INDIAN RIVER CABLEVISION IS PRESENTLY REQUESTING CORRECTED COPIES O? FILED PLAT PLANS
FROM MR. KEN MILLER, REGIONAL EAST COAST ENGINEER, TO PREVENT FUTURE ENGINEERING ERRORS.
REQUEST FOR CITY APPROVAL FOR SALE OF BEER AND WINE FOR CONSUMPTION OFF PREMISES HAS
BEEN RECEIVED FROM MR. EDWARDS GROCERY STORE LOCATED ON THE CORNER OF U S 1 AND
WASHINGTON STREET. ALSO, A REQUEST FROM PATRIC'S PIZZA TO SELL BEER TO BE CONSUMED ON
THE PREMISES.
MR. VOCELLE, CITY ATTORNEY, WILL DRAW UP AN AMENDMENT TO THE PRESENT CITY ORDINANCE
WHICH STATES THAT "IT SHALL BE UNLAWFUL FOR ANY PERSON TO SELL EITHER WHOLESALE OR
RETAIL, ALCOHOLIC BEVERAGES CONTAINING MORE THAN 1% OF ALCOHOL BY WEIGHT IN ANY
BUILDING OR ESTABLISHMENT WITHIN THE CORPORATE LIMITS OF THE CITY OF SEBASTIAN WHICH
IS LOCATED WITHIN A DISTANCE OF 450' OF ANY SCHOOL OR C ~RCH." NEITHER OF THE ABOVE
REQUESTS COMPLY WITH THE CITED ORDINANCE.
THE FIRST READING OF THE PROPOSED AMENDMENT TO THE ORDINANCE ON THE SALE OF ALCOHOLIC
BEVERAGES WILL BE PRESENTED AT A PUBLIC HEARING ON APRIL 9, 1975 PRIOR TO THE REGULAR
WORKSHOP MEETING OF APRIL 9.
MOTION BY COUNCILMAN KINARD, SECONDED BY COUNCILMAN FLOOD, THAT THE PROPOSED ORDINANCE
READ AT THE PUBLIC HEARING THIS DATE ADOPTING THE RULE OF THE DIVISION OF MOTOR VEHICLES
CHAPTER 15C-1.10 AS AMENDED AUGUST 6, 1974, ESTABLISHING THE INSPECTION FEE AND AN
EFFECTIVE DATE, BE APPROVED WITH THE RECOMMENDATION THAT THE WORD "INSPECTION" BE ADDED
AT THE END OF CHAPTER 4 TO READ, "A MINIMUM INSPECTION FEE OF $2.00 IS HEREBY ASSESSED
FOR ALL TIE-DOWN INSPECTIONS..."
ROLL CALL - AYES - VICE MAYOR HOOSE, COUNCILMEN GRAY, KINARD, FLOOD AND MAYOR CRAGG.

THE CITY CLERK READ THE PROPOSED RESOLUTION WHICH WOULD AFFORD THE CITY COUNCIL THE
OPPORTUNITY TO FAMILIARIZE THEMSELVES WITH ITEMS APPEARING ON THE AGENDA FOR COUNCIL
MEETINGS SUFFICIENTLY IN ADVANCE TO BE KNOWLEDGEABLE ON SUCH ITEMS; AND THAT THE DEADLINE
FOR PLACING ANY ITEM ON THE AGENDA FOR THE REGULAR COUNCIL MEETING IS AT THE END OF THE
WORKSHOP MEETING PRECEDING SUCH REGULAR MEETING.
MOTION BY COUNCILMAN KINARD AND SECONDED BY COUNCILMAN FLOOD THAT THE ABOVE RESOLUTION BE
ADOPTED. CARRIED,
A MEETING WILL BE HELD AT CITY HALL ON WEDNESDAY, MARCH 26, AT 7:30 P.M. TO DISCUSS THE
PROPOSED TREE ORDINANCE.
A PROCLAMATION IN CONNECTION WITH THE CENTENNIAL + l0 CELEBRATION WAS READ BY THE MAYOR,
SUBJECT: "FACIAL GROWTH." THE PROCLAMATION IS INTENDED AND PASSED SOLELY IN THE SPIRIT
OF A FUN ATTITUDE AND IS IN WO WAY MEANT TO DISCREDIT ANYONE. IT WAS SIGNED BY THE MAYOR.
THE BUILDING OFFICIAL DISCUSSED THE NEED FOR TIGHTER CONTROLS ON BUILDING OF ALL SWIMMI?NG
POOLS WITHIN THE CITY. AFTER A LENGTHY DISCUSSION BY THE COUNCIL ON THE PROS AND CONS OF
CERTAIN RECOMMENDATIONS BY MR. MUMM, THE COUNCIL REQUESTED THE PROPOSED ORDINANCE BE
FORWARDED TO THE ZONING & PLANNING COMMISSION FOR FURTHER REVIEW, STUDY AND COMMENT.
COUNCILMAN KINARD REQUESTED SOME SPECIFIC CHANGES IN THE PROPOSED RECOMMENDATIONS, AND THE
CITY ATTORNEY AGREED WITH VICE MAYOR HOOSE'S SUGGESTION THAT ALL SWIMMING POOLS BE DRAINED
WHEN THE OWNERS WILL BE AWAY FROM THE PREMISES FOR A PERIOD OF THREE MONTHS OR MORE.
MAYOR CRAGG ASKED THAT ALL RECOMMENDATIONS TO BE ADDED TO THOSE OF MR. MUMM'S BE
SUBMITTED TO MR. MUMM BEFORE THE LIST IS TURNED OVER TO THE ZONING & PLANNING COMMISSION.
MAYOR CRAGG AGAIN STRESSED THE IMPORTANCE OF REFERRING ALL MATTERS TO THE CITY COUNCIL
BEFORE SENDING THEM TO THE ZONING & PLANNING COMMISSION OR OTHER BOARDS FOR ACTION.
MR. ZIMMER, FORMER MAYOR OF SEBASTIAN AND NOW THE DEPUTY DIRECTOR OF CIVIL DEFENSE,
SUBMITTED A FORM TO MAYOR CRAGG IN REGARD TO THE USE OF THE COMMUNITY CENTER AS A FALL-OUT
SHELTER IN EVENT OF NUCLEAR WARFARE. THE BUILDING WOULD BE USED FOR THIS PURPOSE ONLY AND
NOT FOR OTHER DISASTERS SUCH AS HURRICANES, ETC. AFTER COMPLETION OF THE FORM SUBMITTED,
CIVIL DEFENSE WILL THEN INSPECT THE BUILDING TO ASCERTAIN IT MEETS CERTAIN STANDARDS. AFTER
WHICH ANOTHER FORM WILL BE SENT TO THE CITY FOR COMPLETION.
MOTION BY COUNCILMAN KINARD, SECONDED BY COUNCILMAN GRAY, THAT THE MAYOR BE COMMISSIONED TO
COMPLETE THE ABOVE FORM AGREEING TO THE USE OF THE COMMUNITY CENTER AS A FALL-OUT SHELTER
AND RETURN IT TO MR. ZIMMER. CARRIED.

THE COUNCIL DISCUSSED AT LENGTH MR. MUMM'S TITLE, WHETHER IT BE "BUILDING INSPECTOR"
OR "BUILDING OFFICIAL." WHILE MR. MUMM HAS STATED HE HAS BEEN WORKING IN THE CAPACITY
OF A BUILDING OFFICIAL, SOME MEMBERS OF THE COUNCIL DISAGREED THAT HE BE GIVEN THIS
TITLE FOR VARIOUS REASONS.COUNCILMAN FLOOD SUGGESTED IF MR. MUMM IS TO BE DESIGNATED
"BUILDING OFFICIAL" THAT AN AMENDMENT BE MADE TO THE PRESENT CITY ORDINANCE TO THE EFFECT
THAT HE COME UNDER THE DIRECT SUPERIVISION OF THE CITY COUNCIL AND NOT BE AUTHORIZED TO
CONDEMN ANY BUILDING WITHOUT PRIOR APPROVAL OF THE COUNCIL.
MOTION BY COUNCILMAN HOOSE THAT UNDER THE ABOVE CONDITIONS, THAT MR. MUMM BE DESIGNATED AS
"BUILDING OFFICIAL."
THE CITY ATTORNEY EXPLAINED THAT WHILE THE CITY ORDINANCE CALLS FOR A BUILDING INSPECTOR,
THE ZONING & PLANNING COMMISSION REFERS TO THE BUILDING OFFICIAL IN ITS ORDINANCE AND THE
SOUTH FLORIDA BUILDING CODE, UNDER WHICH WE OPERATE, ALSO CALLS FOR A BUILDING OFFICIAL.
IN VIEW OF THE ABOVE, HE FEELS IT OBVIOUS THE CITY SHOULD HAVE A BUILDING OFFICIAL.
THE CITY COUNCIL CAN HAVE CONTROL OVER THE BUILDING OFFICIAL BY SPECIFICALLY SPECIFYING
THOSE ITEMS WHICH THE COUNCIL WOULD WANT TO CONTROL.
COUNCILMAN KINARD SUGGESTED THIS MATTER BE POSTPONED UNTIL THE NEXT WORKSHOP MEETING TO
GIVE THE COUNCIL MEMBERS MORE TIME FOR THOUGHT- SO A JOB DESCRIPTION CAN BE WRITTEN FOR
THE POSITION.
VICE MAYOR HOOSE WITHDREW HIS MOTION TO DESIGNATE MR. MUMM AS BUILDING OFFICIAL.
MOTION BY COUNCILMAN GRAY, SECONDED BY COUNCILMAN KINARD, TO APPROVE REQUEST BY EARMAN OIL CO
TO INSTALL A SELF-SERVICE GAS STATION AND COMMERCIAL STORE AT THE FORMER LOCATION OF THE
UNION 76 STATION ON US HWY 1.
MR. CARL SMITH, SEBASTIAN HIGHLANDS, RECOMMENDED THE CITY NOT PUT A TENNIS COURT AT
SCHUMANN DRIVE AND ENGLAR STREET AS IT WOULD BE DEMOLISHED BY VANDALISM WITHIN SIX MONTHS.
AT THE CONCLUSION OF THE MEETING, MR. MUMM INDICATED HE PREFERRED TO REMAIN AS
BUILDING INSPECTOR RATHER THAN BUILDING OFFICIAL AS HE WOULD NOT HAVE TO PUT IN AS MUCH TIME
PER DAY. HE INDICATED HE HAS BEEN WORKING SIX OR SEVEN HOURS A DAY BUT HAS ACCOMPLISHED
MANY THINGS FOR THE CITY SUCH AS: (1) PUTTING IN A NEW WATER SYSTEM FOR CITY HALL, (2)
PUTTING IN A NEW ELECTRICAL SERVICE IN CITY HALL, AND (3) HAVING STREET DRAINAGE PUT IN BY
THE CONTRACTOR AT THE NEW SHOPPING PLAZA.
MOTION WAS MADE TO ADJOURN THE MEETING.

FACIAL GROWTH
W H E R E A S, all good citizens of Sebastian and Sebastian area
residents are interested in doiug their utmost to make our Centennial ~-~.1_0
Celebration the greatest event of its type to be held in this part of Florida~ A N D
W H E R E A S~ all of us are anxious to have the city look as it did
IlO years ago with regard to beards and moustaches;
N 0 W T HE R E F 0 R E~ I~ F. Eugene Cragg, Mayorf do hereby
proclaim that all males from the age of 18 and over, refrainfrom shaving
from now until the end of our celebration, March 23f 1975. These males
shall include all males who find themselves within the prescribed boundaries
of our fair city~ They may wear a full beard, mutton chops, van dykes~ goatees~
moustaches or any similar facial foliage they so desire. This hairy growth
shall be of such length and luxuriance that it can be readily seen and
recognized at eight ~8) paces.
BE I T K N OW N~ T H A T~ in lieu of the above, such eligible
males not wishing to join in the fun as prescribed above may abstain by
purchasing and carrying upon his person at all times during the celebration
a special license for the paltry sum of $1.00.
B E I T K N O W N, A L S O, T H A T, those males who refuse
to join in the fun by failing to sport such hirsute appendages as herein
prescribed and ordered, or~ by not obtaining a license will be dealt with as
in the days of our forefathers by a specially constituted police force, to be
known as "YE KEYSTONE KOPS." YE KEYSTC~E KOPS shall cause all violators of
this proclamation to be dealt with in a most dastardly way. Such violators
shall be confined in a special jail erected for such violators for a period
of not less than five (5) minutes mor more than fifteen (15) minutes. To
obtain release from such jail~ violators will have to donate the paltry sum
of fifty cents (50~) and obtain a license as described above for the stated
price.
