(NELSON HYATT) SINCE THERE WAS NO DISCUSSION OR COMMENTS REGARDING THE ABOVE TWO ANNEXATIONS EITHER FROM THE MEMBERS OF THE COUNCIL OR THE PUBLIC, THE PUBLIC HEARINGS WERE CLOSED. MINUTES OF REGULAR COUNCIL MEETING - MARCH 10, 1980 - 7:00 P.M. MEETING WAS OPENED BY MAYOR PAT FLOOD, JR. PRESENT: VICE MAYOR LEWIS GRAY, COUNCILMEN EVERETT T. GASS AND J. RANDY JOACHIM, COUNCILWO~¥AN MC KINLEY, MAYOR PAT FLOOD, JR., AND CITY ATTORNEY DANIEL KILBRIDE, JR. MOTION BY COUNCILMAN JOACHIM, SECONDED BY COUNCILWOMAN MC KINLEY, TO APPROVE THE MINUTES OF REGULAR COUNCIL MEETINGS FEBRUARY llTH AND FEBRUARY 20TH. CARRIED. MOTION BY COUNCILMAN JOACHIM, SECONDED BY COUNCILWOMAN MC KINLEY, TO PAY FEBRUARY BILLS IN THE AMOUNT OF $14,128.90. CARRIED. MR. CECIL FARMER STATED THAT APPRO~EL~.F~kb'A~S~E BOUGHT FROM GRAY REALTY COMPANY THE PROPERTY LOCATED AT THE FOOT OF M~JA~E~T.~E ~EL~S/HE HAS BEEN UNFAIRLY TREATED BY THE CITY AND READ A LETTER DATED APRIZ 10, 1978, SI~NED Bt A~THUR MAYER, THE BUILDING OFFICIAk ~ND MAYOR PAT FLOOD, JR. THE LETTER ST~T~THAT MR. FA~AS BEING DENIED A BUILDING PE~IT ~AUSE THE E~CTRICAL AND PLUMBING WAS N~~O STAN~, mu~ ~T ALSO STATED THAT WHENEVER THE STANDARDS WERE MET, THE NECESSARY PE~ITS WO~E ~UE~ MAYO~OD EXPLAINED THAT SINCE MR. FARMER WAS LEAVING TOWN AT THAT PARTICUL~ TIME, IF HE WAS GRANTED A PERMIT THEN, IT WOULD EXPIRE BEFORE THE WORK COULD BE ~NE AND AN INSPECTION~WI~ THE 90 DAY TIME LIMIT REQUIRED BY ~W, AND IT WOULD BE NECESSARY FOR MR. FARMER ~ ~B~I~ AN~ER PE~IT WHEN HE RETURNED IN THE FALL. MR. MAYER STATED THAT THE PROPERTY IS 30' BY 1~'~ 20~D C-l, BUT IT HAS A RESIDENTIAL HOME ON IT SO IT IS CONSIDERED A NON-CONFO~ITY, WHICH M~NS THA~REPAIRS CAN BE MADE ONLY UP TO 25% OF THE ASSESSED VALUATION. MR. ~YER ADDED THAW FkE P~O~ERTY IS FOR SALE AND MR. FARMER IS ADVERTISING THAT A WELL IS LOCATED THERE WHEN iN TRU~RS~S NOT AND CAN NEVER BE A WELL ON THAT PIECE OF PROPERTY. MR. F~ER HAS BEEN ASKED TO S~A ~D HA~LESS AGREEMENT IN CONNECTION WITH THE WATER THOUGHT MR. FA~AD B~ U. VF~Y 7R~ED.~ ~CE MAYOR GRAF ~0~ THE OPINION THAT THERE HAD WE EXTENDED OUR~ A ~IT~L~ A~ ~D ~RK ~H M~ F~E~~ ~ FLOOD SUGGESTED THAT WE SHOULD DISCUSS THIS MATTER FURTHER AT A WORKSHOP MEETING. VICE MAYOR GRAY ANNOUNCED THAT HE WILL BE PUTTING OUT BIDS FOR A BACKSTOP FOR THE SOFTBALL FIELD. COUNCILMAN GASS STATED THAT THE FLORIDA POWER AND LIGHT COMPANY IS IN THE PROCESS OF RELOCATING 22 STREET LIGHTS AND THEY HAVE AGREED TO RELOCATE THE FIRST 15 FREE OF CHARGE. MAYOR FLOOD COMMENDED COUNCILMAN GASS ON THE GOOD JOB HE HAS DONE IN CONNECTION WITH STREET LIGHTING. COUNCILMAN JOACHIM STATED THAT A MEMORIAL STONE HAS BEEN PLACED IN FRONT OF THE FLAG POLE IN THE CEMETERY WHICH WILL BE DEDICATED TO ALL VETERANS OF THE PAST WARS ON SUNDAY, MAY 25TH. COUNCILMAN JOACHIM ALSO STATED THAT A CONTRACT HAS BEEN LET TO FERTILIZE AND CONTROL THE WEEDS IN THE CEMETERY. COUNCILWOMAN MC KiNLEY STATED THAT THE BROCHURE FOR THE CITY OF SEBASTIAN IS STILL 'BEING WORKED ON. THE BUILDING OFFICIAL REPORTED 21 SINGLE FAMILY HOMES WERE CONSTRUCTED IN FEBRUARY FOR A TOTAL VALUE OF $712,210. TOTAL CONSTRUCTION FOR THE MONTH WAS $744,801. PERMIT FEES WERE $4,086.45. TOTAL CONSTRUCTION TO DATE AMOUNTS TO $4,028,033., AND TOTAL PERMIT FEES $22,470.52. CHIEF CUMMINS REPORTED THAT THE POLICE DEPARTMENT HANDLED 339 COMPLAINTS DURING THE MONTH OF FEB- RUARY, NOT INCLUDING TRAFFIC STOPS. LETTER WAS READ FROM JOE SUIT, MAYOR OF'FELLSMERE, INVITING THE MAYOR AND COUNCIL MEMBERS TO THE FELLSMERE BIRTHDAY CELEBRATION ON APRIL 12TH. THE CITY CLERK READ THE NOTICE OF PUBLIC HEARING REGARDING THE ANNEXATION OF A. A. BERRY SUBDIVISION AS IT APPEARED IN THE VERO BEACH PRESS JOURNAL ON FEBRUARY 15, 22, 29, AND MARCH 7TH. LETTER WAS READ FROM WAYNE ALLEN, GENERAL DEVELOPMENT CORPORATION, ADVISING THAT THEY ARE WILLING TO ENTER INTO DISCUSSION LEADING TO THE EVENTUAL ESTABLISHMENT OF A CITY UTILITY SYSTEM AND TO CONSIDER DONATION OF THEIR EXISTING UTILITY SYSTEM TO THE CITY. COUNCILMAN JOACHIM INFORMED HIM THAT GENERAL DEVELOPMENT CORPORATION WILL TAKE CARE OF THIS. MR.
