REGULAR MEETING - MARCH 11, 1974
MEETING CALLED TO ORDER BY MAYOR F. EUGENE CRAGG AT 7 P.M.
PRESENT: VICE MAYOR ERVIN YATES, COUNCILMEN CLIFFORD HOOSE AND JAMES C. KINARD, AND MAYOR CRAGG.
MINUTES OF THE REGULAR MEETING OF FEBRUARY ll, 1974, MINUTES OF SPECIAL MEETING OF FEBRUARY 20, 1974,
AND MINUTES OF PUBLIC HEARING-SPECIAL MEETING OF MARCH 6, 1974, WERE APPROVED AS READ.
MOTION BY VICE MAYOR YATES AND SECONDED BY COUNCILMAN HOOSE TO PAY FEBRUARY BILLS IN THE AMOUNT OF
$12,224.94. CARRIED.
MRS. MARY RILEY, RESIDENT OF ORANGE HEIGHTS S/D, COMMENTED ON AN ARTICLE SHE HAD READ IN THE LOCAL
NEWSPAPER TO THE EFFECT THAT THE CITY COUNCIL HAD APPROVED THE USE OF THE STREET-RIGHT-OF-KAY IN
ORANGE HEIGHTS AS A SHUFFLEBOARD COURT. MAYOR CRAGG EXPLAINED THIS WAS AN AGENDA ITEM AND WOULD BE
DISCUSSED BY THE COUNCIL LATER IN THE MEETING. IN THE MEANTIME, HE ASSURED MRS. RILEY THAT THE PROJECT
HAD NOT RECEIVED FINAL APPROVAL FROM THE COUNCIL.
MR. TIM KELLY, MANAGER OF EARL'$ HIDEAWAY, REQUESTED PERMISSION TO BULKHEAD AND FILL IN THE RIVERFRONT
PROPERTY FOR CUSTOMER PARKING ON TH~ EAST SiDE OF INDIAN RIVER DRIVE IMMEDIATELY ACROSS THE STREET
FROM EARL'S HIDEAWAY.
MAYOR CRAGG ADVISED MR. KELLY TO SUBMIT A LETTER TO THE CITY REQUESTING ITS PERMISSION TO CONTACT THE
INTERNAL IMPROVEMENT FUND AND THE CORPS OF ENGINEERS FOR THIS PURPOSE.
MOTION BY COUNCILMAN HOOSE, SECONDED BY COUNCILMAN KINARD, THAT UPON RECEIPT OF A LETTER FROM MR. KELLY
REQUESTING PERMISSION TO CONTACT THE INTERNAL IMPROVEMENT FUND AND THE CORPS OF ENGINEERS, THAT THE
COUNCIL GIVE WRITTEN AUTHORIZATION FOR HIM TO DO SO. CARRIED.
VICE MAYOR YATES COMMENTED HE WAS VERY PROUD OF MRS. PHELAN (CITY CLERK) FOR HAVING SOLD THE GARBAGE
TRUCK FOR $500 MORE THAN HE WAS ASKING FOR IT.
THE COMMUNITY BUILDING PROJECT AND REMODELING OF CITY HALL ARE PROGRESSING.
THE PLANNING & ZONING COMMISSION WILL HOLD A MEETING FOLLOWING THE PUBLIC HEARING ON MARCH 21.
A TOTAl... CONSTRUCTIONaIN NEW BUILDINGS AND ADDITIONS HAS BEEN STARTED DURING FEBRUARY, INCLUDING THE
REMODELING OF CITY HALL.
CHIEF CUMMINS REPORTED 118 COMPLAINTS ANSWERED BY THE POLICE DEPARTMENT DURING FEBRUARY, NOT INCLUDING
TRAFFIC STOPS.
MR. CHARLES ZiMmER REPORTED ON THE 911 PROGRAM, OF WHICH HE IS A COMMITTEE MEMBER.
MAYOR CRAGG APPOINTED COUNCILMAN KINARD AND COUNCILMAN HOOSE TO LOOK OVER A PENSION PLAN WHICH HAD
BEEN PRESENTED TO HIM, AND TO REPORT BACK AT A LATER DATE.
COUNCILMAN FLOOD IS ATTENDING A PRELEGISLATIVE MEETING OF THE FLORIDA LEAGUE OF CITIES AT TALLAHASSEE.
HE WILL ALSO SUBSTITUTE AT A MEETING OF THE URBAN ADMINISTRATION COMMITTEE FOR MAYOR CRAGG. MAYOR CRAGG
WAS UNABLE TO ATTEND BECAUSE OF TONIGHT'S COUNCIL ~EETING.
COUNCILMAN HOOSE, CHAIRMAN OF THE CEMETERY COMMITTEE, STATED THAT AFTER SEVERAL MEETINGS, THE
COMMITTEE HAD COMPLETED AN UPDATING OF CEMETERY RULES AND REGULATIONS. THESE ARE A COMBINATION OF THE
RULES NOW IN EFFECT, PLUS ELABORATION OF A FEW NEW FACTORS FOR MORE EFFICIENT OPERATION OF THE CEMETERY.
DISCUSSION FOLLOWED.
MOTION BY COUNCILMAN KINARD, SECONDED BY COUNCILMAN HOOSE, THAT THE NEW RULES AND REGULATIONS OF THE
CEMETERY 8E ACCEPTED AS READ AND ARE EFFECTIVE THIS DATE. CARRIED.
A COPY OF THE RULES AND REGULATIONS WILL BE SENT BY CERTIFIED MAIL TO EACH FUNERAL HOME AND MONUMENT
COMPANY IN THE SURROUNDING AREA.
iN THE ABSENCE OF COUNCILMAN FLOOD, MAYOR CRAGG POSTPONED DISCUSSION OF ELECTRICAL PERMITS FOR ANOTHER
MONTH.
COUNCILMAN KINARD, AS A MEMBER OF THE iNDIAN RIVER ENVIRONMENTAL COMMITTEE, MET WITH THE VERO BEACH
ENVIRONMENTAL COMMITTEE LAST WEEK. THEY PRESENTED THE FOLLOWING REPORT ON SPOIL ISLANDS TO THE PLANNING
COMMISSION WHICH, AFTER SOME DISCUSSION, WAS PASSED. THE PLANNING COMMISSION WILL PRESENT IT TO THE
iNDIAN RIVER COUNTY COMMISSION IN THE NEAR FUTURE. THE REPORT IS BROKEN DOWN INTO THREE CATEGORIES:
RECREATIONAL USE, CONSERVATION USE, AND RESEARCH USE. EACH OF THE ISLANDS HAS BEEN RESEARCHED FROM
THE NORTH COUNTY LINE TO THE SOUTH COUNTY LINE AND THERE IS A MAP WHICH SHO~S WHERE EACH ONE IS LOCATED.
CERTAIN ISLANDS HAVE BEEN DESIGNATED FOR RECREATIONAL USE AND OTHERS FOR CONSERVATION. PELICAN ISLAND
WILL REMAIN A REFUGE AND WILL NOT BE INCLUDED IN THE PLAN. THERE ARE THREE ISLANDS NORTH BETWEEN
SEBASTIAN CITY LIMITS AND THE COUNTY LINE THAT ARE BEING LOOKED AT AS POSSIBLE RECREATIONAL ISLANDS.
SOUTH OF THE CITY IS THE RESEARCH ISLAND. A STATE REPRESENTATIVE iS DUE TO ARRIVE IN VERO ON THE
15TH OF MARCH AND THEY HOPE TO GET HIS APPROVAL OF THE PLAN AT THAT TIME. IF SO, INDIAN RIVER COUNTY
WILL POSSIBLY BE THE FIRST COUNTY TO HAVE SUCH A SYSTEM OF DESIGNATING ISLANDS FOR CERTAIN USAGE. AT

COUNCILMAN KINARD,S REQUEST, THE VERO BEACH ENVIRONMENTAL COMMITTEE DECIDED TO RETAIN MEMORIAL ISLAND
IN VERO BEACH AS A MEMORIAL FOR THE DECEASED VETERANS OF THE COUNTY.
ANOTHER iTEM DISCUSSED AT THIS MEETING WAS THAT PERHAPS THE INDIVIDUAL MUNICIPALITIES MIGHT WANT TO LOOK
INTO THE POSSIBILITY OF FORMING THEIR OWN TREE ORDINANCE FOR SITE PLAN APPROVAL. THE COMMITTEE SUGGESTED
THIS BE BROUGHT TO THE COUNCIL'S ATTENTION FOR CONSIDERATION IN THE NEAR FUTURE AS THE COUNTY FORESTER
IS HAVING DIFFICULTY GETTING HIS TREE ORDINANCE OFF THE GROUND.
IN ViEW OF MR. VOCELLE'S STATEMENT THAT IT WOULD NOT BE LEGALLY PERMISSIBLE FOR THE CITY TO USE A
DEDICATED STREET RIGHT-OF-WAY FOR RECREATIONAL PURPOSES, THE MOTION WAS MADE BY COUNCILMAN HOOSE AND
SECONDED BY COUNCILMAN KINARD THAT THE USE OF THE STREET RIGHT-OF-WAY IN ORANGE HEIGHTS S/D AS A
RECREATIONAL AREA BE DENIED. CARRIED.
VICE MAYOR YATES STRESSED THE NEED FOR RECREATIONAL FACILITIES FOR THE PEOPLE OF SEBASTIAN AS A WHOLE,
AND MAYOR CRAGG ASKED THE RECREATION COMMITTEE TO CHECK AND SEE WHAT CAN BE DONE TOWARD THIS END.
MOTION BY VICE MAYOR YATES, SECONDED BY COUNCILMAN KINARD, THAT THE CITY ATTORNEY DRA~ UP A RESOLUTION TO
GIVE THE VFW RIGHT OF INGRESS-EGRESS OVER THE PRESENT ROAD RIGHT-OF-WAY. CARRIED.
MR. JAMES HOUDENSHILD OF INDIAN RIVER DRIVE dILL BE ADVISED IT IS ILLEGAL TO PARK EARTH MOVING EQUIPMENT,
OR ANY OTHER TYPE COMMERCIAL VEHICLES, ON A PERMANENT BASIS ON A STREET RIGHT-OF-WAY, AND ~ILL BE GIVEN
30 DAYS TO FIND AN APPROPRIATE AREA TO PARK HIS EQUIPMENT.
MOTION BY ViCE MAYOR YATES TO ACCEPT THE PLANNING & ZONING COMMISSION'S RECOMMENDATION TO REZONE ONLY THAT
~ PORTION OF LOT 18, BLOCK 4, SEBASTIAN GROVE ESTATES, THAT LIES 'WITHIN THE CITY LIMITS OF THE CITY OF

IN RESPONSE TO THE BUILDING INSPECTOR'S REQUEST THAT ANY HOUSE OVER 18" ABOVE THE GRADE CROWN OF THE
STREET SHOULD HAVE AT LEAST A 12# PIPE INSTALLED IN THE DRIVEWAY TO PROVIDE DRAINAGE, A MOTION WAS MADE
BY VICE MAYOR YATES, SECONDED BY COUNCILMAN HOOSE, THAT THE CITY ATTORNEY PREPARE AN ORDINANCE TO PROVIDE
SUCH DRAINAGE. CARRIED.
MAYOR CRAGG WiLL DISCUSS WITH BOB JENNINGS THE BUILDING INSPECTOR'S RECOMMENDATION THAT ANY FRAME HOUSE
8UILT IN THE CITY SHOULD NOT HAVE FILL INSIDE THE FOUNDATION IN ORDER TO ALLOW AIR SPACE BETWEEN THE
GROUND AND THE FLOOR.
MR. FLIP LLOYD'S REQUEST TO BE PLACED ON A RETAINER FEE OF $100 A MONTH WILL BE CONSIDERED FURTHER.
MR. TIM KELLY, MANAGER OF EARL'S HIDEAWAY, REQUESTED THE SUPPORT OF THE CITY AND ITS LOCAL MERCHANTS
IN ORGANIZING A TOURNAMENT FOR THE~NIOR GOLFERS ASSOCIATION, PROCEEDS FROM WHICH WILL BE DONATED TO
CHARITY. EARL'S HIDEAWAY WILL SPONSOR THE PROGRAM.
MAYOR CRAGG HAS BEEN ASKED TO ATTEND THE HEARING iN JUDGE SMITH'S CHAMBERS ON THE ANNEXATION SUIT ON
MONDAY, MARCH 18, AT 4 P.M.
