Those present were Mayor Rohme, Councilman Sembler, Councilman Baxter, Councilman Nash and Councilman DeCristofaro. Councilman Ptnnegan absent. Gallager also present. Mike This meeting was called due to the adjournment of the regular meeting of March 13, 1961. Minutes of Regular meeting on Pebruary 13, 1961, Special meeting on February 17, 1961, Regular meeting of Pebruary 27, 1961 and Special meeting of March l, 1961 were approved as read. Bills for month of February were approved by Finance Committee and authorized to be paid on motion by Councilman Nash, seconded by Councilman Baxter. Carried. Acting City Clerk read correspondence from Eugene Lyon, City Manager, of Vero Beach in reference to our Police Department's two-way radio. Also a letter from Rex Halley concerning Schumann Drive and Barber Street which have been mixed with soil cement. Also in future plating, these Streets laying within the City limits the inspection fee is to be paid by General ~evelopment Corporation. A letter of thanks from R. A. Whitehead, Traveling Sales Representative from Southeastern Greyhound Lines was also read. A letter from Warren T. Zeuch Insurance Agency was read in regards to the Airport Liability Insurance. The letter stated that the Airport is covered even though there is no endorsement on the policy. A letter from Robert Duerden was read stating he had no objections to a variance or zoning to permit a one thousand gallon tank on the property to the East, South, and West of the 100' X 100' lot'leased to the Natural Gas Company. Counclmman Baxter made a motion for a hearing for the purpose of rezoning the following described land from C2 to industrial, seconded by Councilman Nash. Carried. Beginning at the Southwest corner of 9th Street and U. S. #1 Highway, in the City of Sebastian, and run Southerly along the West side of U. S. #1 PPlghway right-cf-way for line parallel to 9th Street a distance of 100 feet for a point of beginning; thence continue on the same course a distance of 293.38 feet to the East right-of-way of the P. E. C. Railroad; thence Northwesterly along said right-of-way of F. E. C. Railroad a distance of 106.36 feet; thence Easterly on a course parallel with 9th Street to a point 100 feet Westerly of the right-of-way of U. S.-~]~,:~~.~ence~Southerly 100 feet to point of beginning. ~he above description being intended to cover a lot 100 feet wide and running ~f~om U. S. #1 Highway Westerly to the F. E. C. Railroad right-of-way except t~e front lO0 feet of depth from U. S. #1 Highway. Councilman Baxter made a mo#ion to read an ordinance entitled "AN ORDINANCE AMENDING CHAPTER NO. 184 OF THE ORDINANCES OF THE CITY OF SEBASTIAN, BY ALLOWING THE BUILDING OFFiCiAL TO ISSUE BUILDING PERMITS FOR THE CONSTRUCTION OPERATION OR REPAIR 09 SINGLE FAMILY DWELLINGS~"first time in full, seconded by Councilman Nash. Roll was called and voting was as follows: Ayes: Councilman Sembler Councilman Baxter Councilman Nash Councilman DeCristofaro Councilman ~innegan, absent Nayes:-None Councilman Baxter made a motion to read said Ordinance second time by Title only, seconded by Councilman Nash, Carried. Voting was as follows: Ayes: Councilman Sembler Councilman Baxter Councilman Nash Councilman DeCristofaro Councilman Pinnegan, Absent Nayea: None Councilman Baxter made a motion to read said Ordinance third time by Title only and p~aced upon its final passage, seconded by Councilman Nash. Carried. Voting was as follows: - Ayes: Councilman Semb~e~ Councilman Nash $ouncilman Baxter Councilman DeCristofaro Councilman Finnegan, Absent Nayes: None This Ordinance was numbered Chapter No. 188 of the City of Sebastian, Florida. Councilman Baxter made a motion to accept a Resolution entitled "RESOLUTION REQUESTING THE RELEASE BY THE UNITED STATES OF AMERICA ~ROM THE LIMITATIONS UPON SALE CLAUSE RESERVED BY THE UNITED STATES GOVERNMENT OF THE MUNICIPAL AIRPORT'OF THE CITY OF SEBASTIAN, FLORIDA." This motion was seconded by Councilman Nash. Carried. Councilman Baxter made a motion to accept a Resolution entitled "RESOLUTION OBLIGATING THE CITY OF SEBASTIAN TO DEVOTE THE PROCEEDS FROM THE SALE OF PROPERTY ACQUIRED FROM THE UNITED STATES OF AMERICA EXCLUSIVELY TO THE~EVELOPMENT, IMPROVEMENT, OPERATION OR MAINTENANCE OF THE PUBLIC AIRPORT." This motion was seconded by Councilman Nash. Carried. Councilman Baxter made a motion to accept a Resolution entitled "RESOLUTION STATING THE FACTS AND CIRCUMSTANCES JUSTIFYING THE RELEASE OF THE CONDITIONS, RESTRICTIONS AND RESERVATIONS CONTAINED IN A QUITCLAIM DEED DATED JANUARY 29, 1~59, FROM THE UNITED STATES OF AMERICA TO THE CITY OF SEBASTIAN, I~LORIDA." This motion was seconded by Councilman Nash. Carried. Councilman Baxter made a motion to accept the Deed of Release concerning the Airport Recapture Clause as presented by City Attorney Vocelle, seconded by Councilman Nash. 'Carried. A motion was made by Councilman Nash to grant the request of the Chairman of the StreSt Department to close the City dum~ to anything but City garbage trucks, seconded by Councilman DeCristofaro. Carried. A motion w$,s made by Councilman Baxter to make Dorothy Judah Acting City Cl~r~ in the absence Of City Clerk Joe E. Warren, seconded by Councilman Nash. Carried. Oouncilman Baxter made a motion that all employees of the City be hired on ~ Six month probation period, seconded by Councilman DeCristofaro. Carried. t Councilman Baxter made a motion to accept William T. Smith's resignation from the Police i~partment, seconded by Councilman DeOristofaro. Carried. On recommendation of Mayor Rohme,Councilman DeCristofaro, made a motion to pay William T. Smith one weeks vacation pay, seconded by Councilman Baxter. Carried. Councilman Nash made a motion to adjourn, seconded by Councilman ~eCristofaro. Carried. President of the Council
