In accordance with the action taken by the City at its
meeting on July 25th, I have drafted and enclose an original and
one copy of a proposed form of Ordinance which indicates the
intention of the City to annex the lands of General Development
Corp. in accordance with the petition filed with the City. I under-
stand that this ordinance will be adopted by the City at its meeting
on July 29th.
We will have the ordinance published in the issues of
the Press Journal of August 1, 8, 15 and 22, so that the City will
be in a position to take final action at its first meeting after
September 1st. Will you let me know what day this meeting will
be held and I will send to you the final ordinance in time for
adoption.
General Development Corp. has now purchased and
received a deed from Paul R. Stevenson and wife on the following
described property, situated in the City of Sebastian, Indian River
County, Florida, to -wit:
All that part of Government Lots 6 and 7, Section
6, Township 31 South, Range 39 East, lying East
of State Road 5 as it exists on this 25th day of July,
1957, and South of the North line of Lot 10, Block
2, Edgewater Park if said line were extended
Easterly to the Indian River and North of the South
line of Lot 12, Block 2, Edgewater Park if said line
were extended Easterly to the Indian River. Said
land being also described as that part of Government

Lots 6 and 7, Section 6, Township 31 South, Range
39 East, lying opposite Lots 10, 11 and 12, Block
2, Edgewater Park, a subdivision in the City of
Sebastian, Florida, together with full riparian
rights thereunto appertaining.
You will recall that in the petition for annexation, this
corporation suggested that it would convey the above described parcel
to the City with a lease back and that the City would then acquire the
submerged lands to the bulkhead line to be established at your meeting
on the 29th. Mr. Mackle has since discussed this matter with his
brothers, who are associated with him, and they feel that since they
are advertising this Yacht basin site as available to owners of prop-
erty in Highland Subdivision, that reconsideration should be given to
the question of deeding to the City, since someone might construe
this as not acting in good faith insofar as the property owners in the
subdivision are concerned; therefore, we request that you fix your
bulkhead line as soon as possible. Then whan your bulkhead line is
established, the corporation will make application to the State for
purchase of the submerged lands out to the bulkhead line and it will
fill and develop this area, keeping title in its own name but agreeing
that the property will be used exactly as was originally contemplated.
They are going to be pushed for time, so we trust that you will
promptly fix the bulkhead line. This means that this parcel will be
handled exactly as originally discussed except there will be no deed
to the City and no lease back from the City.
