1. Mayor Harris called the meeting to order at 7:00 P.M.
2. Councilman Metcalf led the Pledge of Allegiance.

Vice Mayor Roth requested that the election of the Vice
Mayor be placed on this agenda since Section 2.06 of the
City Charter states that the Vice Mayor is chosen at the
next meeting following a general election.
Attorney Palmer said that there was no provision in the
Charter for run-off elections. He said it was proper to
wait until the new Mayor sits on Council to elect the
Vice Mayor.
Vice Mayor Roth disagreed with the City Attorney's
opinion. Attorney Palmer said his opinion was not
binding on Council.

I move we add the election of the Vice Mayor to this
agenda.

City Manager requested that the election of the Vice

Attorney Palmer said it was proper to elect the Vice
Mayor at that time, since there was nothing in the
Charter regarding run-offs.

Attorney Palmer opened and read the one bid as follows:

I move we refer the one bid from Atlantic Irrigation,
Inc. in the amount of $4080.35 for irrigation in unit
four of the Sebastian Cemetery to staff for their review
and recommendation to Council.

A RESOLUTION OF THE CITY OF SEBASTIAN, FLORIDA,

SOCIETY, INC., A SPECIAL USE PERMIT PURSUANT TO
SECTION 20A-2.6, LAND DEVELOPMENT CODE; PROVIDING

Attorney Palmer read Resolution No. R-88-18 by title
only.
Mayor Harris opened the public hearing at 7:17 P.M. and
called for public input. There being none, he closed the
public hearing at 7:18 P.M.
Attorney Palmer said the burden of proof for approval is
on the applicant.
The Building Official said there were concerns regarding
traffic flow and location, but that this will still go to
Planning and Zoning for site plan review and these
matters can be addressed at this time. He said
requirements have been met for a conceptual plan
approval.

title, and include the Building Official's comments as
part of the record.

8. ~QMMITTEE REPORTS
Councilman Metcalf said that the Vicker Sandmine request
presented to Planning and Zoning was not the same request
that was presented to Council. The Building Official
said there was no site plan change.
9. PUBLIC INPUT QN AGENDA ITEMS
J.W. Thompson recommended that Council deny item 88.055,
Skillman request for rezoning and land use change until
Council is made aware of what commercial use is being
contemplated for that area since CG has many more
conditional uses than CL.
Fred Mensing recommended that Council approve item 88.035
Resolution No. R-88-19, Vicker Sandmine Special Use
Permit, stating that the economic impact is desirable for
Sebastian.
Jim Donahue requested information on item 88.071
Sand Lake Park Conceptual Plan, regarding the use of Park
Place facilities.
Jim Gallagher recommended that Council approve item
88.055, Skillman request for rezoning and land use
change, stating that during finalization of the Land
Development Code when mass rezoning took place the
Skillman property was overlooked.
Steve Paic stated the following regarding item 88.071
Sand Lake Park Conceptual Plan: 1) Park Place facilities
would not be adequate for another development; 2) the
Park Place Clubhouse would not be adequate for use by
more families; and 3) costs would be passed to present
homeowners in Park Place if additional repairs to
facilities are ever needed.
Richard Votapka recommended that Council amend the
request for item 88.035, Vicker Sandmine, to 1) elevation
25 until such time as St. John's Water Management
District studies are completed; 2) prohibit dewatering;
and 3) that the City and County cooperate in their
sandmining ordinances. He asked that Sebastian General
Partnership comply with the County ordinance or the city
by its approval of the request may permit long term damage.
Arthur Lemire recommended tabling items with a long term
impact on the city until Richard Votapka is installed as
Mayor as follows: 1) item 88.035, Vicker Sandmine; 2)
87.146 Ordinance No. 0-88-13 Special Assessment; 3)
88.064 Marker 68 Riparian Rights; 4) 88.055 Skillman
Request.
Mr. Dolan recommended that any matter of substance be
tabled until Richard Votapka is installed as Mayor. He
also requested that item 88.047, Ordinance No. 0-88-15 be
amended to include all single family units in PUDs.
Mayor Harris closed the public input on agenda items at
8:09 P.M.

Councilman Vallone questioned whether parliamentary
procedure was followed by this item being automatically
carried over to this meeting after a motion to approve
died for lack of a second at the March 9, 1988, meeting.
Attorney Palmer said the item was back on the agenda
because the City Clerk was instructed to do so by the
Mayor and no one overruled his request.
Randy Mosby, Mosby & Associates, recommended approval for
the request.

Councilman Metcalf said he agreed with Mr. Dolan that PUDs
need to be included in this ordinance.
Attorney Palmer said PUD applications that go before
Planning and Zoning can impose more restrictive
restrictions than this ordinance.
The Building Official said the PUD ordinance says you must
comply with landscape ordinances so this would apply to
PUDs.

of Barber
Jerry Thomas said one bid had been received and another
company had not yet completed their findings.
Vice Mayor Roth said the city should go to bid and follow
proper procedures.
Attorney Palmer said the city must satisfy that the Indian
River County contract price is lower than any bids would
be taking commercial reasonableness into consideration.
Mayor Harris stated that more study was required for this
item.
13. MAYOR ~ATTERS
Mayor Harris thanked the citizens of Sebastian for their
support and congratulated Mayor elect Richard Votapka.
Mayor Harris called recess at 9:10 P.M. and recalled the
meeting at 9:15 P.M. All members present at recess were
present at recall.
12. C~TY MANAGER MATTERS
City Manager, Robert McClary stated the following items
would be brought to Council for their consideration in the
near future:
1) Procedures for bid openings,
2) Council agendas; sign up sheets, format,
3) ICMA retirement plan, and
4) appointment of a City Attorney (this item was
scheduled for the April 6, 1988 workshop).
Mr. McClary requested communications between Department
Heads and Council be through the City Manager's office.
Mr. McClary requested guidance from Council in obtaining a
city vehicle.
14. CITY CQUNCIL MATTERS
Vice Mayor Roth thanked the citizens of Sebastian for
their thoughtfulness in the passing of his wife Carmen.
Councilman Metcalf requested that his proposed resolution
regarding capital improvement program be a 4/6/88 workshop
agenda item. Mr. McClary said he had no problem with Mr.
Metcalf's proposal being brought to Council.

Attorney Palmer said he wished the public had a better
idea of the blood, sweat and tears that were put into
Mayor Harris' efforts.

I move we grant the request of Skillman for appeal to
Planning and Zoning Commission decision on request for
rezoning and comprehensive land use plan amendment from CL to
CG for a 3.65 parcel on Main Street and instruct the City
Attorney to draft two ordinances for first reading on
April 6, 1988, to be set for public hearing.
Attorney Palmer advised that the comprehensive land use
plan amendment would have to go to the Department of Community
Affairs for review.

Volunteer Fire Department for transfer of reverter clause
from Station I to New Station contingent upon City
Attorney and City Manager review and the draft of the
necessary documents.

of a state bid, Lieutenant Ted Zeuch said VIP Printing
does the forms for Indian River County Sheriffs
Department, Vero Beach and Indian River Shores and that
the company supplies the basic paper used for these forms.
This item was referred to the City Manager and scheduled
for the April 6, 1988 workshop.

Henry Fischer said there was no intended agreement to use
Park Place facilities with the exception of hurricane
shelters and that the utility provision was a contingency.

I move we approve the conceptual development plan for
Sand Lake Park based on three contingencies as stated in
the memo from the Planning and Zoning Commission dated
March 9, 1988.

Reverend Redden asked that the actions of two men arrested
recently at a dance at the Community Center should not
reflect on the hundreds of people who will benefit.
Lieutenant Ted Zeuch recommended that Council deny the
request based on previous incidents and reports of future
retaliations.

I move we deny the request of Reverend Don Redden for
use of public hall in Sebastian for fund raiser dances
based upon report from the Sebastian Police Department.

Attorney Palmer advised Mr. Oberbeck that if he could
certify to the City Manager that his service is being
overseen as to vehicle inspection, rules and rates by
