SPECIAL COUNCIL MEETING CALLED TO ORDER BY MAYOR PAT FLOOD, JR., AT 7:05 P.M.
PRESENT: VICE MAYOR GASS, COUNCILMAN FRANK OBERBECK, COUNCILMAN RICHARD VOTAPKA, CIT~
ATTORNEY DANIEL KILBRIDE AND MAYOR PAT FLOOD, JR.
ABSENT: COUNCILMAN GEORGE SCHUM (ILLNESS IN FAMILY)
MAYOR FLOOD STATED THAT THIS SPECIAL COUNCIL MEETING HAD BEEN CALLED TO DISCUSS AND REVIEW
THE FINAL ADJUSTMENTS ON THE FINAL PLAT APPROVAL OF ROSELAND ACRES SUBDIVISION.
AFTER REVIEWING THE FINAL PLAT, ATTORNEY KiLBRIDE STATED THAT ALL OF THE TECHNICAL CORRECT-
IONS HAD BEEN SATISFIED. HE ALSO EXPLAINED THAT IF THE COUNCIL ACCEPTED THE PLAT AS
PRESENTED, THE DEVELOPER AND THE PROPERTY OWNERS WOULD BE RESPONSIBLE FOR THE MAINTENANCE
OF A 40' DRAINAGE EASEMENT.
SINCE DOCUMENTS HAD NOT BEEN EXECUTED REGARDING THE AUREEMENT MADE WITH GENERAL DEVELOPMENT
CORPORATION AND HENRY FISHER, DEVELOPER, ROSELAND ACRES, TO MAINTAIN THE 40 FOOT EASEMENT
AS PLATTED, THE COUNCIL FELT THE EASEMENT NEEDED TO BE CLEANED OUT AND A DETERMINATION NEEDED
TO BE MADE AS TO WHO WILL BE RESPONSIBLE FOR THE MAINTENANCE.
AFTER A BRIEF DISCUSS$ON, MR. FISHER AGREED TO PUT $1,000.00 INTO A SEPARATE ACCOUNT FOR THE
ROSELAND ACRES PROPERTY OWNERS ASSOCIATION, AS PROOF, THAT IF GENERAL DEVELOPMENT CORPORATION
MOTION BY COUNCILMAN OBERBECK, SECONDF29u~F COUNCILMAN V~T~KA, TO ACCEPT THE ROSELAND ACRES
PLAT SUBJECT TO THE DEVELOPER DEPOSITING $1,000.09 IN A~E~CROW ACCOUNT FOR THE BENEFIT OF THE
THE NORTH 40 FOOT DRAINAGE EASEMENT ~ SUBDIVTSION O~UBJECT~ TO THE DEVELOPER OR GENERAL
DEVELOPMENT CORPORATION AGREEING TO A ~RMA~'~NT E~EMENT AND MAINTENANCE AGREEMENT OF THE 40
FOOT OF THE SUBDIVISION AND CLEARING AND GRADING OF SAME, PROOF OF COMPLIANCE TO THE CITY NO LATER
THAN 60 DAYS FROM TODAY.

THE DEPUTY CITY CLERK READ A RESOLUTION VACATING, ABOLISHING, ABANDONING AND DISCONTINUING·
EASEMENT OF THE SOUTHWEST SIDE OF LOT 8 AND THE NORTHEAST SIDE OF LOT 9, BLOCK 189, UNIT 6,
SEBASTIAN HIGHLANDS, (ESTES)
THE DEPUTY CITY CLERK EXPLAINED THAT AN ABANDONMENT OF EASEMENT WAS GRANTED FOR THE MIDDLE LOTS
LAST YEAR AND SINCE THE LETTER OF REQUEST WAS NOT CLEAR AT THAT TIME, THE SIDE EASEMENTS NEEDED
TO BE ABANDONED ALSO AND THIS IS THE PURPOSE OF THIS RESOLUTION.
MOTION BY VICE MAYOR GASS, SECONDED BY COUNCILMAN OBERBECK, TO ACCEPT THE RESOLUTION VACATING,
ABOLISHING, ABANDONING AND DISCONTINUING EASEMENT OF THE SOUTHWEST SIDE OF LOT 8 AND THE
NORTHEAST SIDE OF LOT 9, BLOCK 189, UNIT 6, SEBASTIAN HIGHLANDS. (ESTES)

MOTION BY VICE MAYOR GASS, SECONDED BY COUNCILMAN OBERBECK, TO BRING TO THE FLOOR A DISCUSSION
REGARDING THE SENATE MEETING CONCERNING THE ADDITIONAL 1¢ SALES. TAX. CARRIED.
MAYOR FLOOD EXPLAINED THAT THE STATE SENATE WOULD BE MEETING REGARDING THE DISBURSMENT OF THE
ADDITIONAL 1¢ SALES TAX. HE FELT IF THIS BILL PASSES IT WILL FREEZE BUDGETS AT 1981 LEVELS. HE
ASKED THE COUNCIL TO PERMIT HIM TO ATTEND TO SHOW THAT THE CITY CARED AND WAS NOT IN FAVOR OF THE
PASSAGE.
MOTION BY VICE MAYOR GASS, SECONDED BY COUNCILMAN OBERBECK, THAT MAYOR FLOOD REPRESENT THE CITY AT
THE MEETING AND DO WHATEVER HE CAN TO SEE THAT WE GET A BETTER CUT OR A BETTER PORTION OF THE PROCESS
OF THE 1¢ SALES TAX. CARRIED.
