HomeMy WebLinkAbout03251981MINUTES OF SPECIAL MEETING - COMPREHENSIVE LAND USE PLAN - MARCH 25, 1981 MEETING WAS CALLED TO ORDER BY ViCE MAYOR GASS AT 7:00 P.M. PRESENT: COUNCILMAN FRANK OBERBECK, COUNCILMAN RICHARD VOTAPKA, COUNCILWOMAN FLORENCE PHELAN, VICE MAYOR EVERETT GASS, CITY ATTORNEY DANIEL KILBRIDE. VICE MAYOR GASS iNTRODUCED MR. LES SOLIN, WHOM THE COUNCIL WAS CONSIDERING APPOINTING AS A PLANNER TO WORK ON THE COMPLETION OF THE COMPREHENSIVE PLAN. MR. SOLIN OUTLINED WHAT HAD YET TO BE DONE AND WHAT HE PROPOSED TO DO AT AN INITIAL BASE FEE OF $450.00 FOR 10 HOURS AS A RETAINER, $40.00 PER HOUR FOR ANY ADDITIONAL TIME, PLUS DIRECT REIMBURSEMENT FOR PHONE CALLS, POSTAGE AND ANY SECRETARIAL SERVICES HE MIGHT NEED. IF ADDITIONAL GRAPHS WERE NEEDED, THEY WOULD HAVE TO BE PAID BY THE CITY UPON APPROVAL. MR. SOLIN STATED THAT THE PLAN WILL BE FINISHED BY JULY 1, AS IT HAS ALREADY BEEN SUBMITTED TO THE STATE WHICH ACTIVATES THE 60-DAYS REVIEW PERIOD. MR. SOLIN AGREES WITH THE POLICIES OF THE PLAN AND FEELS MOST OF THEM ARE GOOD WITH THE EXCEPTION OF THE PLANNED UNIT DEVELOPMENT WHICH HE FEELS IS A ZONING CONCEPT. THE DENSITY ASPECT OF A P.U.D. WAS DISCUSSED, AND ~LSO THE ADOPTION OF A P.U.D. ORDINANCE, WHICH WILL TAKE A FEW WEEKS TO FINALIZE PENDING THE ANNEXATION OF SPECIFIC PROPERTY. MR. SOLIN STATED THAT THE LAND USE PLAN CAN BE AMENDED AT ANY TIME; HOWEVER, THE PROCEDURE TO AMEND IT SHOULD BE INCLUDED IN THE PLAN AT THE TIME IT IS SUBMITTED. IF THE STATE.'~HAS ANY OBJECTfON TO THE PLAN, THE COUNCIL SHOULD SERIOUSLY CONSIDER THE OBJECTIONS BEFORE RESPONDING WITHIN THE REQUIRED 30 DAYS. THE COUNCIL CAN THEN ADOPT THE PLAN WITHOUT FURTHER INTERFERENCE FROM THE STATE, WITH THE EXCEPTION OF A LEGAL BATTLE WITH A CITIZEN CONCERNING A DEVELOPMENT ISSUE. MOTION WAS MADE BY COUNCILWOMAN PHELAN AND SECONDED BY COUNCILMAN VOTAPKA TO HIRE MR. SOLIN ON THE BASIS HE HAS INDICATED TO THE COUNCIL THROUGHOUT THE COMPLETION AND ADOPTION OF THE COMPREHENSIVE LAND USE PLAN. ROLL CALL VOTE: AYES: COUNCILMAN OBERBECK VICE MAYOR GASS AND MR. SOLIN AGREED. MR. GREGORY GOLIEN, CHAIRMAN OF THE~N'"%I)~G A~PLANNING COMMISSION, ASKED WHAT PROCEDURE MR. SOLIN WILL FOLLOW AND HE EXPLAINED THAT HE WfLL GA~ER THE FEEDBACK FROM THE STATE, COUNTY, AND REGION, PUT IT INTO A BETTER FORMAT AND THSN PRESEUTw_~T TO THE COUNCIL. THE PLAN IS TO BE ON THE REGIONAL COUNCIL AGENDA IN APRIL. ~ ~ MOTION WAS MADE BY COUNCILMAN OBERBECR~AND SECONDED BY COUNCILWOMAN PHELAN TO BRING A SUBJECT TO THE FLOOR. CARRIED. MOTION WAS ~ BF C©VN~OB~RBEC~< ~W41--SECOND~D Bic-~O~I~M~LAN TO DISCUSS THE FRANCHISE ORDINANCE FOR WATER AND SEWER CONCERNING GENERAL DEVELOPMENT UTILITIES, AS REQUESTED BY ATTORNEY KILBRIDE. CARRIED. A MEETING HAS BEEN SET FOR APRIL 1, 1981, TO HAVE GENERAL DEVELOPMENT CORPORATION PRESENT THEIR CORRESPONDENCE FROM THE DEPARTMENT OF ENVIRONMENTAL REGULATIONS REGARDING THE WATER AND SEWER FRANCHISES TO SERVE UNITS 16 AND 17. THE SPECIAL MEETING WAS ADJOURNED AT 8:05 P.M. CITY CLERK MAYOR
