CITY COUNCIL CHAMBERS 1225 MAIN STREET, SEBASTIAN, FLORIDA Mayor Barnes called the Workshop to order at 7:00 p.m. The Pledge of Allegiance was recited. Or~linance No. 0-97-20 - LDC & Board of A~ustment Procedures - Title Changes Mrs. Sullivan said original minutes should be filed in the City Clerks office. The Director of Community Development concurred. Mayor Barnes inquired why the City Clerk would not select the board secretary. The Director of Community Development said there is a new position in the Community Development Department which organizationally covers all board minutes. iv. Or~ir~ance No. 0-97-25 - Public Hearing Procedures The Director of Community Development said he had combined public hearing procedures of different types into one section. Mrs. Sullivan asked the definition of"directory" in regard to mailing. The Director of Community Development said the requirement is stated as "directory and not mandatory" and that the names of property owners are obtained from the applicant from the Indian River County property appraiser records. Mayor Barnes asked about the posting of properties. The Director of Community Development said posting would be done in addition to other required notices. Mayor Barnes said he would like to see noticing done for all properties adjacent to all subject property rather than for each individual phase of a project. The City Manager suggested he meet with the Director of Community Development on this matter before the ordinance comes back. City Council concurred. City Council concurred that the language be changed to reflect that a sign on the property "shall" be posted. The City Clerk recommended that "However, nothing contained herein shall be inconsistent with Florida Statutes" be lef~ in the language. The Director of Community Development concurred. Ordinance No, 0-97-31 - Subdivision Improvement/Design Standards - Title Changes - Muck or CI~ Fill P~rrait Mayor Barnes inquired about the need for the City staff involvement with Indian River County water approval. The Director of Community Development recommended changing the language to "approval by Indian River County Utilities". City Council concurred. Mrs. Cartwright said bulkheads, docks and piers should be approved by the Director of Community Development "under consultation with the City Engineer" and after approval of the governing agency. The Director of Community Development he agreed except that the state agencies require local permits first, but the permit can be conditional upon receipt of state permits. There were no objections. Mrs. Cartwright reiterated approval in consultation with the City Engineer for waivers. The Director of Community Development agreed. Mrs. Cartwright suggested City Council should waive underground utility requirements. The City Manager recommended that waivers be approved by City Council rather than staff City Council concurred. 97. O41 vi. Ordinance NOLO-97-32 - Subdivision Improvement/Design Standards - IRC Review and Approval of Ce[ltl'al Wa~tewater Systems The City Manager noted the incorrect reference to central "water" system in the body of the ordinance rather than "wastewater". 97.048 vii. Ordinance No. O-97-39 - Majo_r.~ul~tivision Procedures Mrs. Cartwright said there were many typos in this ordinance. She then went on to recommend that the both references to the 18 month time requirement be reduced to 12 months. The City Manager recommended the word "construct" be changed to "completed". TAPE I - SIDE II (7:45 p.m.) City Council Workshop April 2, 1997 Page Four Mrs. Cartwright questioned to what "a specified amount of time" referred relative to the timing of plat submission. The Director of Community Development suggested 90 days. City Council concurred. Mrs. Sullivan inquired about the general statement requirement for preliminary plats. The Director of Community Development said the general statement is made at the time of pre-application conference and then the specific details come later. The City Manager agreed that requiring a developer to submit a final design prior to a pre- application conference with no guarantee of approval is not a fair way of dealing with developers. The Director of Community Development suggested addition of language in that section that "Council will approve, approve with conditions, or disapprove". There were no objections. Mayor Barnes asked if there was any penalty for partial construction which is then abandoned. The City Manager said there is no assurance if a developer has not filed a plat and surety bond. The City Manager recommended against the applicant recording a final plat with the Clerk of the Circuit Court. The Director of Community Development suggested the cost of recording be borne by the applicant. City Council concurred with both suggestions. 97.049 viii. Ordinance No~ 0-97-40 - Procedures Re: Construction of Required Improvements Mrs. Cartwright recommended taking out "preliminary plat" for "required improvements". The Director of Community Development concurred and said this reference to 18 months should be reduced to 12 months as before. There were no objections. 97.096 Review LDC 5~l:i(~r~ 20A-4.8 Re: PUD(MH) Mobile Home Plar~rl~J UllJt Development (Col!lrnunity Development Transmittal 3Jl7/97,_5~, 20A-4.8.A. and B.) The Director of Community Development said this section needs to be amended to include residential manufactured home as a permitted in the PUD(MH) Mobile Home Planned Unit Development zoning district. City Council concurred. City Council Workshop April 2, 1997 Page Five 97.097 C. Review When COR (Commercial Office Residential) Zoning District isto be C9.nsid~r~cl Residential Use (CoramuniLv Development Transmittal 3/17/97, Conditional Use Criteria, Map Showing COR Zoning) The Director of Community Development sought guidance as to when COR should be considered residential and commercial when conditional uses are being considered. He said staffhas identified certain conditional uses which should not be considered compatible uses when considering COR as residential. Mrs. Sullivan expressed concern that bars and lounges are allowed as conditional uses within 100 feet of schools, places of worship or residential. The Director of Community Development agreed that other areas relative to conditional uses need to be addressed. City Council concurred on the four areas identified by staff whereby COR should be considered residential. 97.002 D. Review City Council Meeting Procedures Resolution No. R-97-02 (R.-97-0.?.,) Mayor Barnes suggested regular meetings which are held on the second and fourth Wednesdays always begin at 7:00 p.m. Mayor Barnes suggested that "Introduction of New Business" be moved forward on the agenda. The City Clerk said the City Manager sets the agenda. The City Manager suggested that public comment be moved forward to just after Public Hearing. Mr. Taracka asked why 10 copies of written backup must be provided. The City Clerk explained that when an individual requests an item he/she would provide sufficient backup for all parties who receive packets. Mayor Cartwright suggested that sign-up sheets for public input on agenda items be done away with. The City Clerk said people should be required to state and spell their name. Mr. Paul suggested workshops be held on the first or third Wednesday when a quasi- judicial hearing is not being held. TAPE II - SIDE I (8:34 p.m.) City Council Workshop April 2, 1997 Page Six Following further discussion, it was decided to amend the resolution to reflect that all meetings will begin at 7 pm; Regular Meetings are to be held on the 2nd and 4th Wednesdays; Quasi-judicial hearings will still be held on the 1 st and 3rd Wednesdays when needed; Workshops will be held on the 1st or 3rd Wednesdays if no quasi hearings or after hearings when held; there will be no sign-ups for input on agenda items; Introduction of New Business will be moved to following Public Hearings; and all meetings will go to 10:30 pm with one extension to 11 pm. 97.098 E. Corll3ider Quarterly Open Public Meetings Mayor Barnes suggested quarterly open meetings to allow the public to bring matters to City Council with input often minutes and no sign-up sheets and no need for department heads to attend. The City Manager suggested seating at a table on the floor. Mrs. Cartwright suggested Commissioner Adams be invited to attend. The City Manager said he would bring a schedule back to the next agenda. Mayor Barnes commended all emergency services personnel for their involvement in putting out today's fire. Mrs. Sullivan said she would like to see a couple of resolutions amended. She was advised to have them placed on an agenda for review by Council for further action. 5.
