CITY COUNCIL CHAMBERS 1225 MAIN STREET, SEBASTIAN, FLORIDA ALL PROPOSED ORDINANCES AND INFORMATION ON ITEMS BELOW MAY BE INSPECTED IN THE OFFICE OF THE CITY CLERK, CITY HALL, 1225 MAIN STREET, SEBASTIAN, FLORIDA. PURPOSE: TO REVIEW THE CITY'S POSITION ON THE WATER AND SEWER FRANCHISE Mayor Conyers called the Special Meeting to order at 6:30 p.m. and stated its purpose. 2. The Pledge of Allegiance was recited. 3. ROLL CALL Present: Mayor W.E. Cloud, Esquire Gerald C. Hartman Hal Schmidt 4. PUBLIC INPUT ON AGENDA ITEMS None. 5. REVIEW CITY'S POSITION ON WATER AND SEWER FRANCHISE The City Manager gave a brief history on the indian River County water and sewer franchise. Tom Cloud, Special Legal Counsel, recommended, as a result of a review of city documents representing agreements between the City of Sebastian and Indian River County regarding the water and sewer franchise and the County's offer to "unbuckle" the franchise, that the City Council accept the County's offer subject to authorization for its staff to meet with County representatives to develop the necessary terms and conditions in order to unbuckle the franchise in a manner which causes no harm to innocent third parties. Gerry Hartman, Hartman & Associates, Inc., gave a preliminary report from an engineering standpoint, particularly regarding the use of the current GDU facility which, he said, was expandable and he concurred with Attorney Cloud's recommendation to accept the offer conditioned on appropriate terms and conditions. Attorney Cloud restated his recommendation, at the request of Mayor Conyers, as follows: "that you authorize either your City Manager or me to respond back to the County's offer in writing, accepting that offer sub3ect to meeting and negotiating, completing terms and conditions acceptable to the City and the County, in such a manner as to protect innocent third parties" MOTION by Conyers/Oberbeck I'll make that motion. AGENDA MODIFICATIONS (ADDITIONS AND/OR DELETIONS) The City Manager requested the withdrawal of item 91.106 Discuss Sebastian Handicapped Evaluation Committee at the request of the Committee chairman to allow the committee time to review. Council concurred. Vice Mayor Oberbeck requested that the City Manager copy a March 1991 Quality Cities' magazine article regarding handicapped matters to the committee. 5. ANNOUNCEMENTS None. 6. PRESENTATIONS Presentation of Plaques to Former Council Members Robert McCollum and Lloyd Rondeau Mayor Conyers presented a plaque to former Councilman McCollum. 7. PUBLIC INPUT B. Agenda Items Steven Lulich, 932 Riviera Avenue, Sebastian, urged Council to listen to citizens and reconsider the twin pairs concept. Peter Jones, 925 Indian River Drive, Sebastian, Riverfront Committee Chairman, discussed aspects of the proposed design competition for the Riverfront, stated that the Riverfront Committee had zeroed in on public consensus and advised that a project as vast as the Riverfront will take much more time than is available from now to July fourth. A. Non-Agenda Items Clay Price & Roger Moore - Request Permission to Conduct Skydiving Operations at Sebastian Municipal Airport (Moore Letters dated 2/27/91, Operational Plan for Standards of Operation and Safety) -- Roger Moore, 657 Oleander, Sebastian and Clay Price, requested permission to use the Sebastian Municipal 2 City Council Workshop Meeting April 3, 1991 Page Three 91.045 Airport for skydiving. Subsequent to input from the City Manager, Airport Manager, John Van Antwerp, City Attorney and City Council it was the consensus of Council to contact FAA Legal Counsel, Robert Eisengrein to inquire if this use violates the standstill agreement between the FAA and the City of Sebastian and bring this back to Council at a later date. Mayor Conyers called recess at 8:02 p.m. and reconvened the meeting at 8:10 p.m. Ail members were present. 8. WORKSHOP ITEMS Planning & Zoning Commission Request Council Support o~ Indian River County TranspOrtation Planning Committee Recommendation Re: CR 512 - Compatibility of Twin Pairs with Railroad Bridge Concept (P & z Recommendation dated 3/23/91) Following a brief discussion and input from each member of Council regarding his position on Planning and Zoning's recommendation to write a letter to the County Commission in support of the Transportation Planning Committee's recommendation to conduct a study to see if the twin pairs is compatible with the railroad bridge concept, motion was made. MOTION by Oberbeck/Holyk I move we approve Planning and Zoning's request. ROLL CALL: Mayor Conyers Councilman Holyk Vice Mayor Oberbeck Councilman Reid aye aye aye aye MOTION CARRIED 5-0. The City Manager noted that the recommendation stated that City Council should write the letter, and Council concurred that the letter should be over the Mayor's signature. 3 City Council Workshop Meeting April 3, 1991 Page Four 91.102 B. 91.015 91.103 Proposed Mutual Aid Agreement with Vero Beach Police Department (Staff Recommendation dated 3/26/91, Proposed Agreement) It was the consensus of Council that the City Attorney draft the resolution to approve the mutual aid agreement. Collier Place PUD Time Extension - Direct ~ Attorney to Draft Ordinance to Terminate the Conceptual Development Plan (6-89-08) (Staff Recommendation dated 3/28/91, Nash Letter dated 3/13/91, Certificate of Sale) The City Attorney stated that, in accordance with Section 20A-4.9 of the Land Development Code, an ordinance was not needed to terminate the conceptual plan, however an advertised public hearing should be held. The scheduling of the public hearing for April 24, 1991 was placed on the April 10, 1991 consent agenda. Request of Coast Guard Auxiliary - Use of Yacht Club for-Vessel Examination (City Manager Memo date~ 3/28/91j Memo from U.S. Coast Guard Auxiliar~ dated 3/25/91) It was the consensus of Council to place this request on the April 10, 1991 consent agenda for approval. Staff was advised to meet with the Coast Guard auxiliary regarding their request for signs. 9. MAYOR'S MATTERS Mayor Conyers said he had sent a letter and copy of Resolution No. R-90-22 to Senator Edward Markey regarding Falcon Cable. 4 City Council Workshop Meeting April 3, 1991 Page Five 10. COUNCIL MATTERS A. Vice Mayor Oberbeck 91.045 1. 91.104 Support Indian River County Transportation Committee Recommendation Re: Compatibility of Future Traffic Control and Twin Pairs (no backup) Vice Mayor Oberbeck noted that this item had been previously approved. 2. Other Matters Vice Mayor Oberbeck commended the City Manager on his choice for City Engineer/Director of Public Works and listed grants available for municipal projects as printed in the March 1991 Quality Cities magazine. B. Councilman Holyk Discuss Design Competition for Ail interested Architects Re: Riverfront and Surrounding Areas (Councilman Holyk Memo dated 3/28/91) Councilman Holyk said he felt the proposed Design Competition merited discussion, said the Dublic should not be ignored and concurred that time was a concern. The City Attorney said any competition done by ballot would have to be a referendum in accordance with Florida law. Robert Brodie addressed Council on the matter and was advised that he should take his idea to the Riverfront Committee since the committee was delegated the authority to do the feasibility study. Steven Lulich, member of the Riverfront Committee said the committee's report should be finalized by the end of the month. Discuss Appointment to Indian River County Land Acquisition Committee (City Manager Recommendation dated 3/28/91) Mayor Conyers suggested that since Councilman Holyk's schedule does not allow his membership on this committee, the City Manager inquire whether Councilman Powell can take this committee, and if so, Councilman Holyk be appointed alternate to the Indian River County Transportation Planning Committee. Discussion Road Plan for Sebastian (Councilman Holyk Memo dated 3/28/91) A brief discussion took place on a letter from the Roseland Property Owners Association objecting to the proposed connection of Gibson Street. The Director of Community Development noted that this connection is in the Indian River County twenty year street plan. C. Councilman Powell Absent. D. Councilman Reid Councilman Reid recommended that signs be placed on CR 512 advising use of CR 510 and CR 505 to bypass Sebastian. CITY ATTORNEY MATTERS Discussion - Government-In-The-Sunshine Law (No Backup) The City Attorney advised City Council members in regard to the Sunshine Law. 12.
