The City Manager gave a brief opening.
The Director of Community Development said this item was "pending" when he came to the City,
stated that he and the Chief of Police have reviewed the current code and were requesting input
fi.om City Council relative to what it perceives as parking problems in the City and what it wants
to see. He reviewed the agenda packet and had previously distributed Chapter 316 Florida
Statutes.
Vice Mayor Taracka asked where public scales are located. The Chief of Police said it is not in
the department's best interest to get into weighing. The City Manager said he could contact the
Department of Agricultural Services to ascertain location or FDOT to spot check weights.
Vice Mayor Taracka asked what vehicles are referred to "which run on a track". The City
Attorney said she believed it meant certain types of amusement rides.
Vice Mayor Taracka asked the The Director of Community Development to define items 1-12 on
circle page 12 of the packet relative to parking recreational vehicles. Mayor Barnes said he
would like to see this limited to no more than two on any size lot. Mr. Paul expressed concern
for limiting it to two. Mayor Cartwright said it is conceivable that people can have more than two
recreational vehicles. The Chief of Police said it would be a code enforcement nightmare to have
to be measuring properties if it is based on square footage. The City Manager said the regulation
should not include any RV parked in an enclosed garage. Mr. Paul suggested setting the limit to
three RV's and questioned whether grandfathering would come into play. The City Attorney said

grandfathering would not apply if the regulations are established for the benefit of the health,
safety and welfare of the public but may if done for arbitrary or aesthetic reasons.
Vice Mayor Taracka asked if there would be a problem leaving in language requiring an RV to
bear only a Florida registration. Mayor Barnes said it should read "bear a valid current
registration". Everyone agreed.
Vice Mayor Taracka read from proposed O-97-YY regarding Section 98-32 and recommended,
"When the parking of a vehicle interferes with the safety of the general inhabitants of the City and
a police officer has determined that the vehicle is so parked, he shall make a reasonable effort to
notify the owner or driver of the vehicle, giving the owner or driver of the vehicle, an opportunity
to remove the vehicle from the parking location. If the owner or driver cannot be located, the
vehicle shall be towed at the owners expense from such location by the police officer and owner
shall be deemed in violation of this section."
Mrs. Cartwright referred to circle page 22 asking what "for more than one hour" means. The
Director of Community Development said this is being added to give people time to move a
recreational vehicle to clean it off, drop off or pick someone up, etc. Mayor Barnes suggested
"for a reasonable time but no more than one hour". Mr. Paul asked if the vehicle is moved and
brought back does another hour begin. The City Manager suggested "for no more than one hour
in a twelve hour period". The Director of Community Development said that preparation of a
motor home may take more than one hour. Mayor Barnes suggested making it two hours if that
is more reasonable, the issue is not allowing people to park for long periods of time in right-of-
way. The City Manager said the way this is written a person could park in the street.
TAPE I - SiDE II (6:48 p.m.)
Vice Mayor Taracka suggested "No vehicle may be parked in any street right-of-way in the City
limits of Sebastian. Any vehicle parked on any street right-of-way in front of any lot which is not
removed within twenty four hours after a notice requiring removal has been posted on the vehicle
by a police officer will be towed at the owners expense" then listing exceptions such as parties,
funerals, contractors working, landscapers, etc. and maintaining a daily log listing these activities.
The Director of Community Development said in situations where people may have guests for a
short period of time that maybe they can work out these situations with Code Enforcement. Mr.
Paul agreed with a system of notification.
Mrs. Cartwright disagreed with listing exceptions because towing is done after notification,
agreed with the language "within a twelve hour period" for RV parking in right-of-way, objected
to limiting the number of recreational vehicles to two or three, suggesting that an individual with
additional lots should be allowed to have more. She asked if Code Enforcement could enforce

Herbert Sturm, 549 Saunders Street, Sebastian, discussed his rights relative to the last meeting
and asked that an investigation be conducted to ascertain the truth of the matter.
Bob Mekosh, 1282 Schumann Drive, Sebastian, said the City's roads are in poor shape and
sinking; and said the Police Department needs four wheel drive vehicles. The City Manager said
there are funds budgeted for Schumann and Barber in the next few years. He said staff and
Council need to review the need for road repairs and/or a paving program.

CITY MANAGER MATTERS
The City Manager gave an update on the proposed franchise ordinance; said when the Public
Works Director is on board he will sit down with him and the Director of Community
Development on the issue of rights~of-way which will affect the telecommunications ordinance;
and said he had met with a group interested in coming into the City with a cable system.

Mr. Paul said he had been advised by other police agencies that two officers should be
trained and recertification be done every 3 years. The City Manager suggested an increase
of $975 for additional training if needed.
The Chief of Police said he could send two officers out of town in staggered times,
however, was not certain he could use drug funds for training the other officer.
The City Manager said he would meet with the Chief on the matter of funding.

The City Attorney read Resolution No. R-97-21 by title.
Mrs. Sullivan asked if items are added to the agenda by majority vote and can be acted
upon how is the public protected. The City Manager said it is a rare occasion when this is
done unless he deems it an emergency. The City Attorney said it could be changed to the
majority of Council members not of the majority present. City Council concurred. She
then asked about the order of business for public hearings and its purpose was explained
to her.
Mrs. Sullivan said for record keeping purposes, the City Clerk should announce that
people should sign up before the sheets are collected. Discussion took place on whether
or not sign-up sheets are needed for agenda items. Mayor Barnes said he would like to
see sheets used for public input on agenda items and then if others want to speak they can
raise their hands. Following further discussion, it was decided to try Public Input on
Agenda Items without sign-up sheets.

The meetings were tentatively scheduled for April 30, July 30, and October 29, 1997.
The meetings were formatted as follows: Five minutes with extension up to ten minutes
with a majority vote of City Council; people's suggestions or problems appropriate to the
City following same rule as Introduction of Business from the Public regarding being
timely within last six months; no personal attacks on staff' or Council; sign-up sheets; no
action by Council; and meetings to be audio taped but not videotaped.
The City Clerk asked the City Attorney if a meeting should have an agenda and the City
Attorney said this is more like a town meeting with a generalized agenda.
The City Manager suggested Council be seated at a table on the floor and City Council
concurred.

Mrs. Sullivan inquired what 20A-11.7, referred to in the ordinance, requires. The
Director of Community Development said the new 20A-11.7 will address the overall
public hearing notice requirements which was recently discussed at a workshop and will
come back for first reading in the near future. He added it may come back amended to
require notice within 300 feet rather than 200.

Mrs. Sullivan suggested appeals be made to City Council rather than Planning and Zoning.
The Director of Community Development said any decisions ofP & Z can be appealed to
City Council. Mrs. Sullivan said too many approvals such as irrigation are left up to the
Director of Community Development. The Director of Community Development said he
would rather utilize the abilities of staff for something like irrigation systems than the
services ora City Engineer. The City Manager said what is being asked is to establish a
line of responsibility and in this circumstance agrees with the Director of Community
Development.
Mayor Barnes inquired whether "confident" should be "competent".

Mayor Barnes asked why more than one site plan extension should be granted. The
Director of Community Development suggested "one extension up to twelve months".
City Council concurred.
Vice Mayor Taracka requested in Section 4 that the applicant "shall" submit a preliminary
site plan sketch. The Director of Community Development suggested that rather than
here that amendment be made under special use provisions.
Mrs. Cartwright asked if the Director of Community Development intends to do a
definition section where his position is defined. He said it was.
Mrs. Sullivan asked why site plans are not extended by City Council. The Director of
Community Development said that was the direction that previous Councils had given and
that with the provision for only one extension the problem will be alleviated.
In response to Mrs. Sullivan, the Director of Community Development said he did not see
the public interest in knowing who a new owner of a property having site plan approval is.

Mrs. Sullivan disagreed with administratively approved site plans for properties with up to
an additional 1000 square feet and said she would like to see the number of times they can
come back limited. Mr. Paul suggested looking at the business community and growth
when considering this. The City Manager cited (2)(b) regarding no intensification of the
property and said this may solve the matter. The City Manager suggested withdrawing
Section 2, approve the rest of the ordinance and bring back section 2 as a separate item.
Mrs. Sullivan suggested that the identity of owners of a project not be deleted from the
site plan application conditions. The Director of Community Development concurred.
The Director of Community Development asked how current site plan extensions should
be treated. The City Attorney suggested withdrawing this ordinance for another first
reading to enable her to review the suggested amendments and their affect on the title.
