ICE has drafted a sketch with two benchmarks and a legal description of the utility easement which will be referred to
as Exhibit "A". ICE will be coordinating with the city and IRC for issuing an easement for the mentioned Fireline. LIT is
requested to provide pricing from his surveyor BETSY LINDSAY, Inc. to review, sign and seal Exhibit "A" provided by
ICE. Any possible comments on exhibit "A" from Surveyor will be addressed by ICE based on direction from BETSY
LINDSAY, Inc.

Specification Section 01720, 3.2.D & 3.2.E.3 clearly state the record's requirement to meet the IRC standards and
permit stipulation. ICE is neither claiming that a new property boundary survey is required nor locating and surveying
the entire airport property to generate an easement. Maybe this was misunderstood by UT. As for expediting and
clarification, ICE has provided an exhibit (refer to attached CCD 002 page 2 of the pdf) to meet the IRC requirements
for issuing an easement for Fireline. ICE has generated a Work Change Directive ( 002) with all requirements clarified
in instruction section.
We can also discuss this at on weekly progress meeting next Monday 22"".

Harried,
LJT is aware of your reference. If you recall, this was brought to your attention by UT in the beginning of the
project when we were trying to secure the project permits that this note existed. It was discussed and
understood that UT would inform the field inspector when the waterline was ready for inspection and testing
and ISS would coordinate with Indian River County. The requirement to generate an asbuilt was discussed
in the field and understood with the exception of the statement to locate the waterline in accordance with the
property boundary.
UT is not disputing that asbuilts are required, but did ask for clarification of the need for a property
boundary, versus the project boundary for asbuilts as those are two very different things. During our
progress meeting, nobody was able to provide this clarification as that knowledge could not be
clearly ascertained within the contract documents. It should also be understood that, UT previously asked for
you to provide the existing property boundary asbuilts in CAD since the only records we were provided for
the project is the project boundaries so we could determine if they could be utilized for the project
asbuilts. To date, UT has not been provided this information so it is assumed it does not exist.
Further, if you are claiming that it was understood by the FOR and the City at bid time that a new property boundary
survey would be required to be performed under this contract, that information should have been clearly identified to
the bidders.
Please understand, UT has already stated an asbuilt with the information on the location of the waterline will be
produced, based on the project boundaries and the costs for those can be absorbed. What is being disputed is having
our surveyor locate and survey the entire airport property in order to generate an asbuilt for the waterline and then
prepare an easement acquisition/recording. Nothing in the contract documents clearly identifies this magnitude of
effort should have been expected. The fact that it took further communications between the City and County to
generate some sort of understanding is further evidence that there was no reasonable way for UT to have accounted
for this effort in the project bid.
Please generate a Work Change Directive with all requirements clarified and UT will submit to you the cost and time
impacts accordingly.

Hamed,
To further address your email, please identify where in the bid documents all bidders were made aware
additional surveys, easements and asbuilts would be needed and under what line items are they paid
from. A requirement to coordinate with utilities and other municipalities does not constitute a requirement to
include costs for efforts entirely unknown during the bid phase. If the City and the Engineer of Record were
aware of these requirements, they had a responsibility to make this known to all bidders.
Generating an asbuilt drawing specifically for the waterline installation is an element of cost for UT's surveyor but is a
function that can be mitigated. Directing an easement recording to be generated, which includes property corners
that have not been provided will require much more effort and is an increased scope.
Please process a Work Change Directive with all additional scope elements clearly identified and UT will provide all
cost and time impacts for authorization to proceed.

waterline permit, you need to get your surveyor to draft a sketch with two property corners and a legal description
of the easement which will be referred to as Exhibit "A". John mentioned they want a 15-foot-wide easement
(Need to be confirmed) Once done we can help you send and coordinate with the county. The county will
eventually have a standard language for the easements which will state it's a utility easement as described in
Exhibit A, which will be the sketch and legal description that your surveyor did, and at the end, UT can pay for the
recording fee.
Ps: 1 think you are aware that your survey as -built information was collected on the fire hydrant line by your
surveyor and that should expedite the process.
