Mayor Conyers called the meeting to order at 7:00 p.m. 2. The Pledge of Allegiance was recited. 3. ROLL CALL Present: Mayor W.E. AGENDA MODIFICATIONS (ADDITIONS AND/OR DELETIONS) Mayor Conyers said the 4th of July Committee had requested use of the Community Center on May 2, 1991 with a fee waiver and closure of the Yacht Club and parking lot on July 4, 1991. MOTION by Oberbeck/Holyk I move we make that item H under workshop items. VOICE VOTE on the motion carried 4-0. The Director of Community Development requested that representatives of Empire Environmental and Empire Engineering and Testing be allowed to report on the recently discovered diesel fuel tank leak at the city garage. MOTION by Oberbeck/Holyk I move that we allow our engineering firm representing us on the fuel tank problems to address Council. VOICE VOTE on the motion carried 4-0. 5. ANNOUNCEMENTS None. 6. PUBLIC INPUT Andy Feinstein, Empire Environmental and Bob Walker, Empire Engineering and Testing reported that approximately 700 cubic yards of soil had been excavated, that the water contamination test results would be received in approximately ten to fourteen days and that the Contamination Assessment Report proposal would be submitted soon. The Director of Community Development said staff will come back to Council with a proposal for land farming contaminated soil. 2 City Council Workshop Meeting May 1, 1991 Page Three A. Non-Agenda Items 91.121 2. Henry L. Brandenburg - Request to Transform Residence at 1302 Indian River Drive Into Restaurant - Change Reverter Clause to Accommodate Parking (Letter dated 4/24/91, City Manager Memo dated 4/25/91) Following a discussion of the request for removal of a reverter clause for an adjacent property to allow Mr. Brandenburg to convert the property at 1302 indian River Drive into a French style restaurant, Mr. Brandenburg concurred with a request that he pay for a city initiated survey of the subject property to determine its value for compensation to the city in the event the city agrees to release the reverter clause. B. Agenda Items S.F. Morris, 522 Cross Creek Circle; A1Vilardi, 445 Georgia Boulevard; C.N. Kirrie, 12855 79th Avenue, Roseland; Steven Lulich; Cora Sadler, Sebastian Historical Society; Jim Wadsworth, 317 Breakwater Terrace; Robert Fullerton, 330 King; Duke Copp, 155 CR 512; Ed Busch, 8285 Manatee St, Roseland; and Fred Mensing, 7580 129th Street, Roseland all spoke in opposition to the "twin pairs" concept for CR 512. Mr. Vilardi also addressed Indian River Drive jurisdiction. Roger Moore, 657 Oleander St, requested that any action on item 91.101 be postponed until he can address the FAA letter. Peter Jones, Riverfront Committee Chairman, read a letter for the record regarding recommendation for property acquisition for a linear park system. (see attached) Jim Davis, Indian River County Public Works Director addressed citizens concerns regarding the twin pairs for CR 512, gave a history of its implementation, and invited a member of Council to meet with county staff when it meets with FEC staff. 3 City Council Workshop Meeting May 1, 1991 Page Four 91.120 Mayor Conyers called recess at 8:28 p.m. and reconvened the meeting at 8:42 p.m. Ail members were present. Former Mayor, L. Gene Harris spoke in opposition to the twin pairs and said a promised study of an alternate access to U.S. 1 through Chesser Gap was never done by the county. Steven Lulich - "No" to the Twin Pairs (No Backup ) Steven Lulich, 932 Riviera Avenue stated that citizens have been against the twin pairs since its inception and urged Council to take action to tell the county to stop its engineers on the project. 91.101 91.122 Jim Davis stated that the study done by Keith and Schnars included the alternative route through Chesser Gap and said it was available for review. 7. WORKSHOP ITEMS Review FAA Letter Re: Sport Parachuting (FAA Letter dated 4/18/91) Following a brief discussion and input from Roger Moore and Clay Price, City Council concurred that this item needs more information and instructed them to contact staff. The City Attorney advised staff to obtain PART 105 FAA regulations. Review Jurisdictional Transfer of Indian River Drive w/in City Limits from Indian River County to City of Sebastian (City Manager Recommendation dated 4/23/91, Davis Letter dated 4/18/91) It was the consensus of Council to place staff's recommendation on the May 8, 1991 consent agenda for approval. 4 City Council Workshop Meeting May 1, 1991 Page Five 91.065 C. 91.123 91.124 91.125 Review Proposed Cemetery Rates (Staff Recommendation dated 4/25/91, Cemetery Rate Resolution, Rate Comparison Schedule, Rate Pro3ections) It was the consensus of Council to direct the City Attorney to draft the resolution in accordance with staff recommendation. Review Proposed Security Alarm Ordinance (Petty Memo dated 4/18/91, Proposed Ordinance) Ron Harsh, 931 Barber Street recommended improvements to the proposed ordinance and requested an opportunity to meet with Chief Petty. The City Attorney requested direction in determining who would sit as the appeal board as addressed in the draft ordinances. He said he would contact Florida League of Cities and was instructed to obtain other municipalities' ordinances. This item was sent back to staff for further review. Review Proposed Requirement for Bid, Payment and Performance Bond for Bids Over $100,000 (Staff Recommendation dated 4/24/91) It was the consensus of Council to direct the City Attorney to draft an ordinance. Discuss City Board Terms (Staff Recommendation dated 4/25/91, R-90-17) It was the consensus of Council to direct staff to draft the resolution. 91.126 G. Review Proposed Nuisance Ordinance Amendments (Staff Recommendation dated 4/25/91, P & Z Memo dated 4/25/91, Proposed Amendments to Chapters 12 and 16) It was the consensus of Council to direct the City Attorney to draft the ordinance. Vice Mayor Oberbeck was excused from 9:38 p.m. to 9:40 p.m. City Council Workshop Meeting 5 City Council Workshop Meeting May 1, 1991 Page Six H. 4th of July Committee It was the consensus of Council to approve the request for the closing of the Yacht Club and parking lot on July 4, 1991 and approve a blanket fee waiver for use of city facilities for 4th of July meetings and/or events. 8. MAYOR'S MATTERS Mayor Conyers announced the passing of former Councilman Lloyd Rondeau. Discussion took place on proposal for nine additional holes at Golf Course. 9. COUNCIL MATTERS A. Vice Mayor Oberbeck None. B. Councilman Holyk Councilman Holyk requested an excused absence from the May 8, 1991 Regular Meeting and said Council had not heard the last of the proposed purchase of the CAVCORP property. C. Councilman Powell Absent. D. Councilman Reid Councilman Reid said he had received threatening phone calls regarding proposed yard sale regulation. Jones ARCHITECT 1627 U.S. Highway 1 Sebastian, Florida 32958 407/388-1983 May I , 1991 Mr. Will Conyers, Mayor Members Sebastian City Council City Hall 1225 Main Street Sebastian, Florida 32958 Re: Main Street and Indian River Drive Riverfront Study DEAR SIRS: As you may be aware, the Riverfront Study Committee is in the final process of completing its report, to be presented later this month. Many issues have been deliberated, public input noted and recommendations set. One aspect of the Committee's focus has been on the concept of a linear park system running north and south, with its 'center' at Main Street and Indian River Drive. Main Street to City Hall and the riverfront is referenced in the City's comprehensive plan, along with U.S. 1 and Indian River Drive, as part of the City's 'Central Commercial Core Area'. Main Street, U.S. 1, Indian River Drive and the Indian River itself, at that point, presents a unique opportunity to enhance this 'center' of the riverfront, while improving the image and function of the Central Commercial Core Area. The Riverfront Study report refers to the opportunity to create a 'cultural center' within this center area. A 'public place' that might contain a band shell, tourist information center, connection to the linear park system, related public facilities and parking. The visibility of this area from U.S. 1, even now, can be readily seen. As you consider action on properties within this important part of the riverfront, please note that the acquisition of those properties by the City, itself, for a greater, longer term, public good, is worthy of consideration. Funding mechanisms for such acquisitions are discussed in the Committee's report. The City has had opportunities in the past to acquire such vital properties as an investment towards the development public spaces. The riverfront is every bit valuable as a public space, May 1, 1991 Mr. Will Conyers, Mayor Members Sebastian City Council Page Two as it is a place for private sector development. Concurrent with following the Riverfront Study Committee's recommendations,the City should begin a land banking program within the riverfront district, now, to ensure its cultural vitality and to maintain the proper balance between public space and private development.
