Mayor Votapka called the meeting to order at 7:00 P.M. RQLL CALL Present: Councilman George Metcalf Councilman Robert McCarthy Councilman Kenneth Roth Vice Mayor Peter Vallone Mayor Richard Votapka Also Present: City Manager, Robert McClary City Attorney, Thomas Palmer 3. AGENDA MODIFICATIONS (ADDITIONS AND/O~ ~IONS) The Mayor added "Proclamations/Announcements" to the agenda preceding item 4. Following item 4, the Mayor added "Public Input, Mayor's Matters, and Council Matters" to the agenda. PROCLAMATIONS/ANNOUNCEMeNTS Mayor Votapka announced a Bikeathon to benefit St. Jude's Hospital on May 7, 1988 at the Sebastian Swim Lake. 1 88.102 88.098 Mayor Votapka read a proclamation for Lamaze Prepared Parent week. 4. ITEMS REFERRED FROM 4/27/88 RE~AR ~IEETING: N~W Harvest Coffee ~us~ ~ ~quest for Riverview Park ~ 5/28/88 John Zasadzinski was present to request use of Riverview Park for a concert on May 28, 1988. Mayor Votapka recommended that the group be limited to 125 to 150 people, that they contract with private waste cleanup, rent hand washing units, that there be no overnight use, and they pay a $200 refundable maintenance deposit. Councilman Metcalf said he was strongly opposed to the use. It was decided that the group would maintain the park and utilize the City's hand washing units with a $200 refundable deposit. MOTION by Roth/McCarthy I move we approve the request of the New Harvest Coffee House for use of the Riverview Park on May 28, 1988, from 11:00 A.M. to 7:00 P.M. on the condition they provide two portalets and $200 refundable maintenance deposit. Mayor Votapka instructed Mr. Zasadzinski to fill out a rental form in the City Clerk's office so the city has adequate contact information. ORDINANCE NO. 0-88-02 (Solicitation) AN ORDINANCE OF THE CITY OF SEBASTIAN, FLORIDA, ENACTING A NEW ARTICLE III TO CHAPTER III OF THE CODE OF ORDINANCES OF THE CITY OF SEBASTIAN, AND THEREBY PLACING RESTRICTIONS ON DOOR- TO-DOOR SOLICITATIONS; PROVIDING AN EFFECTIVE DATE. (lst Agenda 2/10/88, 2nd Agenda, 1st Reading 3/23/88, Advertised 4/13/88, Public Hearing 4/27/88, tabled to 5/4/88) The City Manager recommended that Council not establish a cumbersome administrative procedure on solicitation and merely require all solicitors to register. MOTION by Vallone/Metcalf I move we deny Ordinance No. 0-88-07. Attorney Palmer said simple registration may have constitutional ramifications. ROLL CALL: Councilman Roth - Aye Vice Mayor Vallone - Aye Mayor Votapka - Aye Councilman McCarthy - Aye Councilman Metcalf - Aye MOTION CARRIED Attorney Palmer was instructed by Mayor Votapka to rewrite the ordinance. ~ Clerk ~ Reque~ for Budget Appropriation ~ $2000 Occupational License ~rQ~m ~ NCR MOTION by Vallone/Metcalf I move we grant the request of the City Clerk for a line item transfer of $2000 for an NCR occupational license program. ROLL CALL: Vice Mayor Vallone - Aye Mayor Votapka - Aye Councilman McCarthy - Aye Councilman Metcalf - Aye Councilman Roth - Aye MOTION CARRIED PUBLIC INPUT E1Oise Holmes complained to Council about the deteri- oration of her property caused by a ditch. 87.146 The City Manager advised Mrs. Holmes to call Jerry Thomas, Public Works Director, the following day. MAYOR'S MATTERS Mayor Votapka said the Ambulance Squad has dissolved and the Fellsmere Squad is now handling the Sebastian Unit until such time that North County Volunteer Ambulance Squad is established. The City Manager said the city as recipient of all assets of the Ambulance Squad has made those assets available to the Fellsmere Squad. He said he has assigned Larry Napier as staff contact to the squad. Duncan Chalmers, Chief of Fellsmere Ambulance Squad, said the group has made progress in the two days since they took over. He requested a letter from the city to the city's insurance company acknowledging Fellsmere's liability. He said the Fellsmere squad has donated $5000 to the Sebastian squad. He requested that any questions be directed to him. Mayor Votapka said the Bikepath Committee had asked that Sebastian provide them with a map showing the areas they wished to have bikepaths before their May 24, 1988 meeting. The Building Official said he would take this to Planning and Zoning. CITY ~ANAG~ MA~TK~ The City Manager said he had met with Jim Davis on the paving of Barber Street. He said the repair can be made with money in the city's budget. Mayor Votapka called recess at 8:35 P.M. and recalled the meeting at 8:45 P.M. Ail members present at recess were present at recall. 5. WORKSHOP ITEMS A. Side ~itches The City Manager said the Construction Board has recommended that Council provide a mechanism to allow a case by case permitting system at owner's expense for side culvert pipes. After further discussion, the proposed resolution was scheduled for the May 11, 1988 meeting. 4 88.10'~ 88.072 88.103 88.104 88.105 B. Public Service Zoning The Building Official recommended that permitted and conditional uses in PS zoning be reviewed and possibly amended and that the posting of properties being considered under conditional use be established. Sue Silva presented materials to the City Clerk for a May 11, 1988 related agenda item. Edra Young said she had original maps from GDC for park tracts. She was advised to meet with the Building Official. C. City Attorney The City Manager told Council that three applicants for City Attorney had been interviewed and he would come back to Council with a recommendation on May 11, 1988. D. Bu~ ~rQcesa Calendar The City Manager presented the budget calendar to Council. The City Manager requested a Special Meeting on the Airport Master Plan for Wednesday, May 18, 1988. Council concurred. E. Proposed Wrecker RotatiQn Resolution Lieutenant Puscher said the purpose of his request was a more efficient enforcement of the wrecker rotation policy and to ensure professional operation and control. After some discussion, the resolution was placed on the May 11, 1988 agenda. F. Aquatic Control The Public Works Director said the contract with Ameraquatic expires on May 31, 1988 and recommended that the City Manager look into a contract with extended services. The City Manager said he would go to bid on new contracts. ~8.106 Ge ~ ~)~par~ment and Ambulance Ve]~ici~ Fiain~enanc~ The City Manager said he would have maintenance agreements drawn up. The Assistant Finance Director said the Ambulance Squad no longer wishes to use the City Garage for service. The City Manager said he would investigate who they intend to use for service since the city is the recipient of the squad's assets. 6. Mayor Votapka adjourned the meeting 10:15 P.M.
