GASS, COUNCILMAN RRANK OBERBECK, COUNCILMAN RICHARD VOTAPKA, COUNCILMAN GEORGE SCHUM, CITY ATTORNEY DANIEL KILBRIDE AND MAYOR PAT FLOOD, JR. THE CITY CLERK READ THE NOTICE OF PUBLIC HEARING AS IT APPEARED IN THE VERO BEACH PRESS JOURNAL, APRIL 25 AND MAY 2, 1982, TO CONSIDER THE ADOPTION OF AN ORDINANCE GRANTING TO FLORIDA POWER AND LIGHT COMPANY, IT SUCCESSORS AND ASSIGNS AN ELECTRIC FRANCHISE, IMPOSING PROVISIONS AND CONDITIONS RELATING THERETO, PROVIDING MONTHLY PAYMENTS TO THE CITY OF SEBASTIAN, AND PROVIDING FOR AN EFFECTIVE DATE. ATTORNEY KILBRIDE READ IN i~SENTIRETY AN ORDINANCE GRANTING TO FLORIDA POWER AND LIGHT COMPANY, ITS SUCCESSORS AND ASSIGNS AND ELECTRIC FRANCHISEi, IMPOSING PROVISIONS AND CONDITIONS RELATING THERETO, PROVIDING FOR MONTHLY PAYMENTS TO THE CITY OF SEBASTIAN, AND PROVIDING FOR AN EFFECTIVE DATE. AFTER A BRIEF DISCUSSION REGARDING THE CUT AND COVER METHOD OUTLINED IN SECTION THREE OF THE FLORIDA POWER AND LIGHT FRANCHISE AGREEMENT, COUNCILMAN VOTAPKA RECOMMENDED THAT THE BORING AND JACKING METHOD BE iNCLUDED IN THE FLORIDA POWER AND LIGHT FRANCHISE. EARL MASTELLER, CITY ENGINEER, EXPLAINED THAT THE BORING AND JACKING METHOD SHOULD ONLY BE USED IN CONDITIONS THAT WARRANT THIS PROCEDURE SINCE, IT CAN BECOME VERY EXPENSIVE AND DISRUPTIVE OF SIDEWALKS, SCRUBBERY AND OTHER UNDERGROUND UTILITIES. HE ALSO STATED THAT THIS PROCEDURE WOULD HAVE TO COME UNDER A STREET OPENING ORDINANCE. STATED THAT THE FRANCHISE AGREEMENT IS A GENERALIZED AG_9t~F, WEArT AND IF TH~ XOpNCIL DESIRES TO INCLUDE THE BORING AND JACKING METHOD INTO THE FRANCHISE. ~HAT THEY WOULD HA~/TO IMPLEMENT IT AS PART OF THE CITY'S BUILDING/CONSTRUCTION CODE OF O~9~NCES FIRST.u COUNCILMAN OBERBECK RECOMMENDED THAT TH~--'CIT~NCL~ THIS--BORING AND JACKING METHOD INTO THE CITY'S B ILDING/CONSTRUCTION CODE OF ORDINANCES FOR THE USE OF ALL UTILITY COMPANIES AND TO BS INCLUDED IN ALL UTILITY FmNCHISES. ATTORNEY KILBRIDE READ IN ITS ENTIRETY AN ORDINANCE AMENDING SECTION 23-1 OF THE CODE OF ORDINANCES OF THE CITY OF SEBASTIAN, BY CHANGING THE NA~E OF A PORTION OF SOUTH EASY STREET TO DAHL AVENUE. MAYOR FLOOD EXPLAINED THAT THIS ORDINANCE IS CHANGING THE NAME OF SOUTH EASY STREET TO DAHL AVENUE~ THERE BEING NO FURTHER DISCUSSION, MAYOR FLOOD STATED THAT HE WOULD KEEP THE PUBLIC HEARING OPEN IN ORDER TO HAVE A READING OF THE GENERAL DEVELOPMENT UTILITY WATER AND SEWER RATE INCREASE ORDINANCE. ATTORNEY KILBRIDE READ FOR THE FIRST TIME BY TITLE ONLY AN ORDINANCE AMENDING ORDINANCE 0-81-9, THE SEWER FRANCHISE HELD BY GENERAL DEVELOPMENT UTILITIES BY INCREASING RATES FOR SEWER SERVICE FROM $5.00 PER MONTH TO $10.00 PER MONTH; PROVIDING A SEVERABILITY CLAUSE; ESTABLISHING AN EFFECTIVE DATE. PUBLIC HEARING - MAY 5, 1982 MOTION BY COUNCILMAN OBERBECK, SECONDED BY COUNCILMAN VOTAPKA, TO ACCEPT THE FIRST READING BY TITLE ONLY OF AN ORDINANCE AMENDING ORDINANCE 0-81-9, THE SEWER FRANCHISE HELD BY GENERAL DEVELOPMENT UTILITIES BY INCREASING RATES FOR SEWER SERVICE FROM $5.00 PER MONTH TO $10.00 PER MONTH; PROVIDING A SEVERABILITY CLAUSE; ESTABLISHING AN EFFECTIVE DATE. MAYOR FLOOD EXPLAINED THAT GENERAL DEVELOPMENT UTILITIES REQUESTED THAT A PUBLIC HEARING BE HELD INCLUDING BOTH THE WATER AND SEWER INCREASE IN ORDER TO IMPLEMENT BOTH BILLINGS TOGETHER. MAYOR FLOOD RECOMMENDED THAT THE DATE FOR THE PUBLIC HEARING BE DISCUSSED DURING THE WORKSHOP MEETING TO FOLLOW AND THEN BE MADE AN AGENDA ITEM FOR THE NEXT REGULAR COUNCIL MEETING, MAY 10, 1982.
