ME~TING WAS CALLED TO ORDER BY MAYOR PAT FLOOD, JR., AT 7:00 P.M.
PRESENT: VICE MAYOR LEWIS GRAY, COUNCILMEN EVERETT T. GASS AND JOHN R. JOACHIM, MAYOR PAT FLOOD, JR.,
AND CITY ATTORNEY L. B. VOCELLE.
ABSENT: COUNCILMAN CLIFFORD HOOSE (VACATION).
THE MINUTES OF THE REGULAR COUNCIL MEETING OF APRIL 10, SPECIAL COUNCIL MEETING OF APRIL 20, AND
PUBLIC HEARINGS OF MAY 1 AND MAY 3, 1978, WERE APPROVED.
MOTION BY COUNCILMAN GASS, SECONDED BY VICE MAYOR GRAY, TO PAY APRIL BILLS AMOUNTING TO $10,137.59.
CARRIED.
MAYOR FLOOD STATED THAT AS A RESULT OF DISCUSSION AT THE LAST COUNCIL MEETING, THE MONTHLY BILLS
WERE NOT READ ALOUD, BUT EACH MEMBER OF THE COUNCIL WAS GIVEN A LIST OF THE BILLS FOR APPROVAL.
MEMBERS OF THE PUBLIC WERE ADVISED THAT THE LIST WAS AVAILABLE FOR ANYONE INTERESTED.
MR. WALTER CANDELET INFORMED THE COUNCIL OF THE HEARING TO BE HELD AT THE COUNTY COMMISSION ON
MAY 25 AT 7:30 P.M. WITH REFERENCE TO A 38 ACRE PIECE OF LAND OWNED BY SCHLITT AND MORSE IN THE
COUNTY ON THE WEST SIDE OF U.S. #1 ADJACENT TO CEMETERY PROPERTY. IT WAS AGREED THAT SOMEONE
REPRESENTING THE CITY SHOULD ATTEND THIS MEETING.
COUNCILMAN GASS REPORTED THAT SEVERAL DAYS A WEEK ARE BEING DEVOTED TO STREET REPAIRING. THE
BEAUTIFICATION PROGRAM HAS BEEN COMPLETED AT THE PARK AT THE FOOT OF MAIN STREET AND THE NEW PIER.
COUNCILMAN GASS EXPRESSLY THANKED ARTHUR MAYER, THE BUILDING OFFICIAL, FOR HIS HELP IN OBTAINING
THE TREES AND ASSISTING IN THE PLAN~f~ I~N~B~ADE TO IMPROVE THE AREA EAST OF INDIAN
RIVER DRIVE FROM S.R. #512 NORTH mC C~_~ID~E STWEE~. ~V/
COUNCILMAN GASS REPORTED THAT EQUIP M~N~-~ND SUPPLIES ARE ~EING TRANSFERRED FROM THE CITY GARAGE
TO THE PUBLIC WORKS COMPOUND. ~J__ __ U
COUNCILMAN GASS ALSO REPORTED THAT THE INCOME LEVEL SURVEY HAS BEEN COMPLETED AND THE FIGURES WILL
BE PRESENTED TO THE U.S. HOUSING AND URBAN/~E~T DIVISION AT A MEETING ON MAY 10. HE EXPRESSED
HIS THANKS TO THOSE WHO ASSISTED HIM. ! ~ ~ /
COUNCILMAN JOACHIM ADVISED THAT CHIEF OF PO~3~CE CUShiONS WOULD MAKE A REPORT RELATIVE TO THE POLICE
COMMITTEE. THE CEMETERY COMMITTEE AT THE{R%J~A~T ~TING DISCUSSED VARIOUS MEANS OF IMPROVING THE
GROUNDS AT THE CEMETERY. ~

CHIEF OF POLICE JAMES CUMMINS REPORTED THAT THERE WERE 241 COMPLAINTS ANSWERED DURING THE MONTH OF
APRIL, NOT INCLUDING TRAFFIC STOPS.
CHIEF CUMMINS STATED THAT AT THE ST. JUDE BIKE-A-THON HELD ON MAY 6, 34 PEOPLE PARTICIPATED AND A
QUICK TALLY AMOUNTED TO $4,992. COLLECTED. HE PUBLICLY THANKED EVERYONE FOR THEIR ASSISTANCE,
AND ESPECIALLY THE FELLSMERE CHIEF OF POLICE. MAYOR FLOOD ADDED HIS THANKS TO CHIEF CUMMINS FOR
AN EXCELLENT JOB.
MR. WALTER CANDELET, ZONING AND PLANNING COMMISSION, REPORTED THAT THE COMMISSION HAS GIVEN TENTATIVE
APPROVAL FOR A MINI-WAREHOUSE ON 6 LOTS IN AN M-1 SECTION OF THE HARDEE ADDITION.
MAYOR FLOOD MENTIONED THAT THERE ARE TWO VACANCIES ON THE VARIANCE BOARD AND ANYONE INTERESTED SHOULD
SEND A WRITTEN REQUEST FOR CONSIDERATION.
MAYOR FLOOD REPORTED THAT WE HAVE RECEIVED A GRANT IN THE AMOUNT OF $7,500. FROM THE DEPARTMENT OF
TRANSPORTATION TO BE USED TO LIGHT THE RUNWAYS AT THE AIRPORT.
THE BUILDING OFFICIAL REQUESTED PERMISSION FROM THE CITY COUNCIL TO ALLOW MR. JAMES VANCE TO MOVE
INTO HIS HOUSE AT 1802 LANSDOWNE DRIVE EVEN THOUGH IT WOULD BE A VIOLATION OF THE CITY ORDINANCE
SINCE THE DRIVEWAY HAS NOT YET BEEN BUILT. THIS WHOLE MATTER OF DITCHES AND PROPER DRAINAGE WAS
DISCUSSED AT LENGTH AND MAYOR FLOOD SUGGESTED THAT THIS SHOULD BE BROUGHT BEFORE THE COUNCIL AGAIN,
AFTER ANOTHER MEETING WITH THE REPRESENTATIVES OF GENERAL DEVELOPMENT CORPORATION TO BE ARRANGED BY
THE MAYOR. MR. VANCE~S CASE WAS CONSIDERED TO BE ONE OF HARDSHIP SINCE IT WAS NECESSARY FOR HIM TO
VACATE HIS PRESENT RESIDENCE.
MOTION WAS MADE BY VICE MAYOR GRAY, SECONDED BY COUNCILMAN JOACHIM, TO ALLOW MR. VANCE TO MOVE INTO
HIS HOUSE THROUGH THE ISSUANCE OF A TEMPORARY PERMIT FOR 90 DAYS SUBJECT TO RENEWAL UPON GOOD
CAUSE SHOWN. CARRIED.

THE BUILDING OFFICIAL REPORTED THAT THERE WAS NO TRUTH TO THE RUMORS THAT MR. ESTES WAS GETTING
PERMITS FREE OF CHARGE. MR. MAYER HAS MADE A LIST OF ALL THE HOMES BUILT BY MR. ESTES IN THE PAST
6 MONTHS AND STATED THAT MR. ESTES HAS PAID THE CITY OF SEBASTIAN $8,600. IN BUILDING PERMITS. A
COPY OF THIS LIST iS AVAILABLE TO ANY INTERESTED PARTIES FOR A SLIGHT FEE.
THE BUILDING DEPARTMENT ISSUED 12 PERMITS DURING APRIL FOR SINGLE FAMILY RESIDENCES VALUED AT
$301,000. TOTAL NEW CONSTRUCTION FOR THE MONTH AMOUNTED TO $343,411.
A LETTER WAS READ FROM EMILY C. SCHULTZ EXPRESSING HER APPRECIATION TO THE CITY OFFICIALS AND
ESPECIALLY THE BUILDING OFFICIAL FOR THE COOPERATION IN FOLLOWING THROUGH TO SEE THAT ALL CONDITIONS
IN THE SEBASTIAN TRAILER PARK WERE CORRECTED TO EVERYONE'S SATISFACTION.
A REQUEST WAS RECEIVED FROM THE MISS FLORIDA PAGEANT FOR THE CITY TO PURCHASE AN AD IN THEIR YEARLY
BOOKLET. COUNCILMAN JOACHIM STATED THAT SINCE THERE WILL BE NO MISS SEBASTIAN CONTEST THIS YEAR
IT APPEARED A LITTLE RIDICULOUS TO PLACE AN AD AND IT WAS DECIDED TO INFORM THE MISS FLORIDA
PAGEANT THAT THE CITY OF SEBASTIAN HAD NO INTEREST IN PLACING SUCH AN AD.
A LETTER WAS READ FROM DR. GENEVA ACOR, WESTSIDEANIMAL HOSPITAL, COMMENDING THE COUNCIL FOR THEIR
EFFORTS IN ATTMPTING TO SET UP ANANIMAL CONTROL ORDINANCE, AND OFFERING SOME SUGGESTIONS.
A LETTER WAS READ FROM THE LEUKEMIA SOCIETY OF AMERICA, WHO WILL CONDUCT THEIR FALL RESIDENTIAL
CAMPAIGN BETWEEN SEPTEMBER 8 AND 30, 1978, TO ALERT US THAT THEY WILL BE IN THE AREA.

MAYOR FLOOD STATED THAT THE SUBJECT OF DOUBLE TAXATION SHOULD BE DISCUSSED WITH THE COUNTY COMMISSIONER.
THE CITY IS PAYING FOR DOGS PICKED UP IN T/~O~K-~ND HAS TO TAX ITS CITIZENS TO PICK UP DOGS INSIDE
THE CORPORATE LIMITS.
MAYOR FLOOD STATED THAT AT THE LAST COUNCIL MEBTiN~MR. RICHARD SZELUGA HAD REQUESTED THAT THE
PURCHASE OF BINGO EQUIPMENT BE INVESTIGAT~D%~ /T W~S AN OVERSIGHT THAT THIS ITEM WAS NOT INCLUDED
IN THE AGENDA. AT THE SUGGESTION OF MR. V6~2JFLLE,---A STATEMENT WAS OBTAINED FROM VICE MAYOR GRAY,
COUNCILMEN JOACHIM AND HOOSE, CITY CLERK PHELAN, AND CITY ATTORNEY VOCELLE. MAYOR FLOOD STATED

ANSWERS TO QUESTIONS THAT HAD NOTHING TO DO WITH BINGO EQUIPMENT.
MR. VOCELLE STATED THAT IT WAS HIS UNDERSTANDING THAT MAYOR FLOOD CONDUCTED AN INVESTIGATION AS TO
WHETHER OR NOT COUNCILMAN JOACHIM WAS GUILTY OF ANY WRONG-DOING. SINCE ALL THE STATEMENTS SEEM TO
AGREE THAT COUNCILMAN JOACHIM DID NOT KNOWINGLY VIOLATE ANY PROVISIONS OF THE CITY CHARTER, MR.
VOCELLE VOICED THE OPINION THAT THERE WAS NO REASON TO PROLONG THIS MATTER.
THE FOLLOWING ORDINANCE WAS READ BY TITLE ONLY: ORDINANCE AMENDING CHAPTER 7 OF THE ORDINANCES OF THE
CITY OF SEBASTIAN, FLORIDA, KNOWN AS THE BUILDING ORDINANCE. THiS ORDINANCE IS DESIROUS OF PROVIDING
FOR AND MAINTAINING ADEQUATE DRAINAGE WITHIN THE CITY OF SEBASTIAN. THIS WAS THE FINAL READING.~-$~-

MOTION BY VICE MAYOR GRAY, SECONDED BY COUNCILMAN JOACHIM, TO ACCEPT THE CHAMBER OF COMMERCE WELL
AGREEMENT. CARRIED.
MAYOR FLOOD ADVISED THAT HE WAS TRYING TO ARRANGE A DATE FOR THE DEDICATION OF THE DOCK AND PARK
AREA IN MEMORY OF MRS. BOLINGER'S FATHER, AND HOPED IT WOULD BE EITHER THE 3RD OR 4TH OF JUNE.
HE ALSO SUGGESTED THAT THE COMMUNITY CENTER SHOULD BE DEDICATED TO THE MEMORY OF VICE MAYOR YATES
AND HOPED TO ARRANGE THIS SOMETIME IN JULY. A PLAQUE WILL BE PUT IN BOTH LOCATIONS.

MAYOR FLOOD INFORMED THE COUNCIL THAT THE VICKERS FAMILY HAS GIVEN THE OLD RAILROAD DEPOT TO
THE CITY OF SEBASTIAN. THERE WAS SOME DISCUSSION ABOUT WHERE IT SHOULD BE LOCATED AND VICE
MAYOR GRAY THOUGHT WE MIGHT HAVE TO WAIT UNTIL THE NEXT BUDGET YEAR. COUNCILMAN GASS-STATED
THAT THER~ IS A DIVISION UNDER HOUSING AND URBAN DEVELOPMENT WHICH COVERS RESTO~ATION OF HISTORICAL
SITES AND HE WILL LOOK INTO THIS.
MOTION BY VICE MAYOR GRAY, SECONDED BY COUNCILMAN GASS, TO ACCEPT THE DEPOT FROM THE VICKERS
FAMILY. CARRIED ·
COUNCILMAN GASS SUGGESTED THAT SOME THOUGHT BE GIVEN TO COMPILING A HISTORY OF SEBASTIAN. MAYOR
FLOOD SAID WE HAVE BEEN OFFERED A MAP THAT GOES BACK TO THE 1700'S, THE ORIGINAL LAYOUT FOR THE
CITY OF SEBASTIAN, AND SOMETHING NEEDS TO BE DONE BEFORE IT IS TOTALLY DESTROYED.

INVESTIGATE THE COST OF RESTORING THE MAP. CARRIED.

MAYOR FLOOD STATED THAT THE SIGNS LOCATED AT EITHER END OF THE CITY ARE IN NEED OF REPAIRING AND
REPAINTiNG AND A QUOTATION OF $540. PER SIGN HAD BEEN RECEIVED. MR. VOCELLE SAID THAT SINCE THIS
WAS OVER $1,000. IT WOULD HAVE TO BE PUT OUT FOR BIDS.

BIDS. VICE MAYOR GRAY THOUGHT THAT WE OUGHT TO GET A BID AT THE SAME TIME FOR THE SIGN ON S.R.
#512, THEN IT COULD BE BUDGETED FOR NEXT YEAR. COUNCILMAN GASS AMENDED THE MOTION TO BID ON THE
TWO SIGN AND ALSO A BID FOR THE THIRD SIGN TO BE DONE AT A LATER DATE. MR. VOCELLE SUGGESTED IT
WOULD BE BETTER TO PUT A TIME LIMIT ON IT.
