A VERY LENGTHY DSICUSS!ON FOLLOWED, REGARDING THE PROPOSED ZONING CHANGE FROM COMMERCIAL, OFFICE
RESIDENTIAL (.COR) TO COMMERCIAL GENERAL (CG) SINCE IT IS THE INTENTION TO CONSTRUCT A JIFFY MART
CONVENIENT STORE AT THIS LOCATION.. THE FOLLOWING CITIZENS AND LOCAL RESIDENTS RAISED
OBJECTIONS: ANN DEWHURST, FLORENCE PHELAN, ATTORNEY STEVEN HENDERSON, REPRESENTING
TRINITY LUTHERN CHURCH, WHICH IS ADJACENT TO THE PROPOSED RE-ZONING, PASTOR WILDE REV. MCQUIRE,
AND SEVERAL PARISHONERS OF LOCAL AREA CHURCHES.
MR. RICHARD VOTAPKA, CITY RESIDENT, CIVIL ENGINEER, PRESENTED A GRAPHIC DISPLAY SHOWING THE .~i~
PROPOSED JIFFY MART CONVENIENT STORE AND OTHER RENTAL STORES PROPOSED FOR THIS AREA ALONG
~TB A TRAFFIC FLOW. MR. VOTAPKA POINTED OUT THAT THIS ZONING CHANGE WOULD CERTAINLY CREATE
AyERY' DANGEROUS TRAFF!'C $I]YUATI'ON, SINCE THERE IS NOT PROPER SIGNALIZATION AT THE INTERSECTION
OF SCHUMANN DRIVE AND U.S. #1 MR. ¥OTAPKA ALSO MENTIONED THAT THERE IS A CONVENIENT STORE
LOCATED ON THE WEST SIDE OF U.S.#l, ONLY .9 MILES SOUTH OF THE INTERSECTION AND ANOTHER
CONVENIENT STORE ON THE EAST SIDE OF U.S. #1 ONLY 1.6 MILES NORTH ON U.S. #1 AND FELT NOT
BUILDING THIS PROPOSED JIFFY MART CONVENIENT STORE WOULD NOT CREATE A HARDSHIP'FOR THE
RESIDENTS OF SEBASTIAN.
IT WAS THE OVERALL CONCENSUS OF THE LOCAL RESIDENTS AND PARISHONERS THAT THIS TYPE OF
ZONING WOULD NOT BE ADVANTAGEOUS FOR THE COMMUNITY IN THAT PARTICULAR AREA AND THAT THE
PROPOSED TYPE OF BUSINESS WOULD ONLY CREATE A LOCAL HANGOUT, DOWNGRADE THE ADJACENT R-1
COMMUNITY AND SET A PRECEDENT AS FAR AS REZONING PROPERTIES ADJACENT TO THE'CHURCH. THE
RESIDENTS WERE OF THE OPINION THAT THE INTENT OF C.O.R. ZONING WAS ORIGINALLY PLANNED TO
ACT AS A BUFFER ZONING, SURROUNDING RESIDENTIAL AREAS AND THAT IT STAY THAT WAY.
MINUTES PUBLIC HEARING MAY 8, 1985
JACK SPIRA, REPRESENTATIVE, JIFFY MART STORES, INC., INDICATED THAT THE JIFFY MART CONVENIENT
STORE WILL NOT CREATE ANY UNDUE AMOUNT OF CRIME IN THIS AREA AS OPPOSED TO ANY OTHER ENTERPRISE.
MR. SPIRA AGREED THAT THE INTERSECTION WILL GENERATE ALOT OF TRAFFIC AND THAT A TRAFFIC PROBLEM
ALREADY EXISTS AT THE INTERSECTION. ON BEHALF OF HIS CLIENT, MR. SPIRA STATED THAT SHOULD A SIGNAL
BE WARRANTED, HE WOULD BE MORE THAN WILLING TO PAY HIS FAiR SHARE OF THE PRO RATA COST OF THE
SIGNALIZATION.
MR. AL DAVIS, ENGINEER, AGREED WITH MR. VOTAPKA'S TRAFFIC FIGURES AND CALCULATIONS CONCERNING THE
TRAFFIC FLOW AT THIS INTERSECTION AND ALSO INDICATED THAT A SIGNAL IS WARRANTED.

MAYOR GALLAGHER REPORTED THAT HE AND THE ENVIRONMENTAL HEALTH DEPARTMENT WiTH THE AUTHORITY
OF MIKE GALANTIS INSPECTED THE RIVER'S EDGE WATER SITUATION SINCE THE LAST MEETING. A
LICENSED OPERATOR HAS BEEN OPERATING THE PLANT AND THE HIGH IRON CONTENT WAS FOUND TO BE FROM
THE FLUSHING OF THE TANKS TO FREQUENTLY BY THE OPERATOR. THE WATER IS PRESENTLY CLEAR FOR
CONSUMPTION. MAYOR GALLAGHER REMINDED THE COUNCIL THAT DEVELOPER MR. ELLIOT KEPPLER IS
UNDER CODE ENFORCEMENT ORDER OF MARCH 24, 1985 TO BRING BOTH WASTE WATER AND WATER TREATMENT
PLANT UP TO STATE STANDARDS AND TO BE APPROVED BY THE STATE WITHIN 60 DAYS. HE ALSO STATED THAT
IN ADDITION TO WHAT ALREADY HAS BEEN ISSUED BY THE CODE ENFORCEMENT BOARD, PERTAINING
TO THE WASTE WATER PLANT AND WATER TREATMENT PLANT, THE STAFF IS PRESENTLY PREPARING
ADDITIONAL CHARGES REGARDING THE DRAINAGE PROBLEMS IN THE RIVER's EDGE SUBDIVISION.

IN RESPONSE TO VICE MAYOR HARRIS'S QUESTIONS CONCERNING THE BUILDING PROCESS OF THE
BARBER STREET FIRE SUBSTATION, ATTORNEY PALMER EXPLAINED THAT THE CITY WILL ONLY OVERSEE
THE CONSTRUCTION AND THAT THE WORK IS COMPLETED PROPERLY AND THEN FUNDS WILL BE DISPUSED.
HE EXPLAINED THAT THE FIRE DEPARTMENT WILL HAVE TO BID ALL THE WORK BECAUSE OF FEDERAL
MONEY BEING USED.
1N RESPONSE TO COUNCILMAN ROTH'S QUESTION CONCERNING THE PROGRESS OF THE F.A.A. APPRASIAL
MAYOR GALLAGHER REPORTED THAT THE APPRASIAL COST WILL BE $1,500.00 AND IS EXPECTED TO BE
COMPLETED WITHIN 30 days.

REPEALING THE RESTRICTIONS THEREIN WHICH RESTRICTIONS APPLY TO PROHIBIT THE ERECTION,
DEMOLITION ALTERATION OR REPAIR OF ANY BUILDING DURING CERTAIN HOURS OF WEEKDAYS AND SATURDAYS,
AND ON SUNDAYS: PROVIDING AN EFFECTIVE DATE.
MOTION BY COUNCILMAN ROTH, SECONDED BY COUNCILMAN VALLONE TO ACCEPT THE FIRST READING BY
TITLE ONLY OF AN ORDINANCE OF THE CITY OF SEBASTIAN, FLORIDA REPEALING SECTION 15-4 OF THE CODE

AFTER SOME DISCUSSION, MAYOR GALLAGHER STATED THAT IT IS THE STRONG OPINION OF THE PUBLIC TO'
EAVESECTION 15-4 AS IS ON THE BOOKS, EVEN THOUGH OUR CURRENT ORDINANCE IS QUESTIONABLE AS FAR
S TIMES. ATTORNEY PALMER RECOMMENDED THAT THE EXISTING ORDINANCE BE TIED UP AND DEFINED, SINCE'
