CARRIED. MR. JAMES CUMMINS, POLICE CHIEF, REPORTED A TOTAL OF 367 COMPLAINTS FOR THE MONTH OF APRIL, 1982, NOT INCLUDING TRAFFIC VIOLATIONS. MR. ARTHUR MAYER, BUILDING OFFICIAL, REPORTED A TOTAL OF 19 SINGLE FAMILY UWELLIAGPERMITS £SSUED FOR THE MONTH OF APRIL, 1982, WITH A TOTAL OF $4,988.25 COLLECTED IN PERMIT FEES. MR. ROBERT DOHERTY, STREET SUPERINTENDENT, REPORTED 29 COMPLAINTS FILED FOR THE MONTH OF APRIL, 1982 AND THAT WATER SAMPLING AT THE SWIN LAKE WOULD BEGIN TOMORROW, MAY 11, 1982. HE ALSO MENTIONED THAT THE DRAINAGE PROJECT ON INDIAN RIVER DRIVE BY THE CITY BOAIfD RAMP WOULD BE COMPLETED BY MAY 25, 1982. - MR. COUNCILMAN VOTAPKA REPORTED THAT HE HELD A CEMETERY COMMITTEE MEETING AND DISCUSSED THE BASE/ FOUNDATION FOR GRAVE STONES. HE ALSO MENTIONED THAT FERTILIZER FOR THE CEMETERY WAS DISCUSSED AND THAT THEY CAN PURCHASE 10~10~10 FERTILIZER MIX FROM THE W. R. GRACE COMPANY, FT. PIERCE, FL. COUNCILMAN VOTAPKA EXPLAINED THAT HE WOULD WRITE A LETTER TO THE SEBASTIAN CEMETERY ASSOCIATION REGARDING THE FERTILIZER TO SEE IF THEY wOULD BE WILLING TO PAY FOR IT. COUNCILMAN VOTAPKA REPORTED THAT THE COMMITTEE DISCUSSED THE POSSIBILITY OF PLANTING ABOUT 15 TREE~'J~ UNIT #2 AND THAT LOT/BLOCKMARKERS WERE LOOKED AT THAT GARRY CHRISTENA, SEXTON, HAS BEE~ MAKING OUT OF CONCRETE FILLED PVC PIPE. THEY ALSO DISCUSSED INSCRIBING NUMBERS OF THE LOTS FOR THE BLOCKS INTO THE CONCRETE BEFORE IT SETS. THE NEED FOR A PART TIME EMPLOYEE WAS DISCUSSED, TO HELP OUT WITH THE MOWING AND MAINTENANCE OF THE CEMETERY FOR ABOUT FIVE MONTHS. COUNCILMAN VOTAPKA REPORTED THAT HE SPOKE TO MR. LEE NUZIE, CIVIL DEFENSE AND THAT BUDGETED MATERIALS WERE ORDERED. HE EXPLAINED THAT HE IS CURRENTLY CHECKING INTO AN APPROPRIATE TYPE OF RADIO THAT CAN BE USED AND THAT IT MAY RESULT IN A BUDGET AMENDMENT OR POSSIBLY BE PUT iN FOR NEXT YEARS BUDGET. HE ALSO MENTIONED THAT TAPES WERE AVAILABLE FROM THE n~_~ICANE PRE- PAREDNESS CONFERENCE FOR THE USE OF ANY ORGANIZATION FOR A $10.00 DEPOSIT FEE AND COULD BE OBTAINED IN CITY HALL. COUNCILMAN VOTAPKA MENTIONED THAT HE WILL TRY TO MAKE ARRANGEMENTS TO HAVE MR. LEE NUZIE OR MR. HARRY WHITAKER TO SPEAK AT THE COMMUNITY CENTER REGARDING HURRICANE PREPAREDNESS TO THE CITIZENS OF THE COMMUNITY SOMETIME IN THE BEGINNING OF JUNE, 1982. COUNCILMAN SCHUM REPORTED THAT THE DONATIONS FOR THE BARBER STREET FIRE STATION ARE COMING ALONG WELL AND THEY HAVE A CONSTRUCTION SUPERINTENDENT WHO IS READY TO START WORK FREE OF CHARGE. MOTION BY COUNCILMAN VOTAPKA, SECONDED BY VICE MAYOR GASS, THAT WE GO AHEAD AND HAVE EARL MASTELLER, CITY ENGINEER AND THE CITY ATTORNEY WORK ON A STREET OPENING ORDINANCE. CARRIED. AFTER SPEAKING TO MR. FRANCHER, JR., ASSISTANT VICE PRESIDENT, FINANCE, GENERAL DEVELOPMENT UTILITIES, INC., REGARDING THE PROPOSED WATER AND SEWER RATE INCREASE AND MAIN EXTENSION/SERVICE AVAILABILITY CHARGE INCREASE, ATTORNEY KILBRIDE REMARKED THAT A POSSIBLE DATE OF MAY 24, 1982 WAS DISCUSSED TO HOLD A PUBLIC HEARING.. HE FELT IF THERE IS STILL GOING TO BE A DEBATE ON WHAT THE RATES ARE TO BE, THAT THIS DATE WOULD BE TO SOON, SINCE HE WOULD NOT HAVE AMPLE TIME TO DRAFT AN ORDINANCE SETTING THE NEW WATER AND SEWER RATES. CARRIED. REGULAR COUNCIL MEETING - MAY 10, 1982 COUNCILMAN OBERBECK NOMINATED COUNCILMAN GEORGE SCHUM AS'AN ALTERNATE REPRESENTATIVE TO THE NORTH COUNTY FIRE TAXING DISTRICT. MOTION BY COUNCILMAN VOTAPKA, SECONDED BY COUNCILMAN OBERBECK, TO CLOSE NOMINATIONS. CARRIED. MAYOR FLOOD EXPLAINED THAT ST. WILLIAMS CATHOLIC CHURCH REQUESTED THE USE OF THE SEBASTIAN COMMUNITY CENTER TO HOLD BINGO GAMES FOR THE PURPOSE OF RAISING MONEY FOR A BUILDING FUND. HE STATED THAT HE CONTACTED MR. GEORGE GEORGIEFF, ASSISTANT ATTORNEY GENERAL, REGARDING THE LEGALITY OF HOLDING BINGO GAMES IN A CITY OWNED BUILDING FOR THE PURPOSE RAISING MONEY FOR A BUILDING FUND AND WAS TOLD THAT SINCE THIS MONEY IS CONSIDERED PUBLIC MONEY THAT THE PROCEEDS COULD NOT BE USED FOR THIS PURPOSE. ALL PROCEEDS ARE TO EITHER BE DONATED TO A CHARITABLE ORGANIZATION OR GIVEN BACK TO THE PEOPLE. AFTER READING THE STATE STATUTE AND REVIEWING OTHER OPINIONS OF SIMILAR CASES, REGARDING ST. WILLIAMS CATHOLIC CHURCH USING THE COMMUNITY CENTER FOR BINGO, ATTORNEY KiLBRIDE STATED THAT THE ONLY PURPOSE THAT THE NET PROFITS CAN BE USED FOR IS TO EITHER RAISE MONEY FOR CERTAIN BROAD CATEGORIES, SOCIAL WELFARE OR JUST PURE RECREATION AND ENJOYMENT OF THE MEMBERS. HE STATED THAT HE HAD NOT HAD THE OPPORTUNITY TOSPEAK TO THE ATTORNEY GENERALS OFFICE, REGARDING THIS, HE ALSO MENTIONED THAT THE USE OF SUCH PROPERTY FOR THE CONDUCT OF SUCH GAMES MUST BE SPECIFICALLY ADOPTED BY A RESOLUTION TO AUTHORIZE THE USE. MOTION BY COUNCILMAN VOTAPKA, SECONDED BY COUNCILMAN SCHUM, THAT WE AUTHORIZE THE CITY ATTORNEY TO CONTACT THE STATE ATTORNEY GENERAL FOR A WRITTEN OPINION TO SEE IF THE ST.
