RANDY JOACHIM, COUNCILWOMAN DOROTHY W. McKINLEY, MAYOR PAT FLOOD, JR., AND CITY ATTORNEY L. B. VOCELLE. THE PURPOSE OF THE PUBLIC HEARING WAS TO CONSIDER THE ADOPTION OF AN ORDINANCE AMENDING ORDINANCE NO. 202, AS AMENDED, THE ZONING ORDINANCE OF THE CITY OF SEBASTIAN, FLORIDA. NOTICE OF PUBLIC HEARING WAS READ BY THE CITY CLERK AS PUBLISHED IN THE PRESS JOURNAL ON APRIL 13, AND MAY 6, 1979. THIS ORDINANCE WOULD RE-ZONE THE FOLLOWING PROPERTY: EDGEWATER PARK SUBDIVISION, LOT 210' X 125', ON THE EAST SIDE, INDIAN RIVER DRIVE, SOUTH OF CITY OF SEBASTIAN SOCIAL CENTER, FROM R-2 (MULTI-FAMILY) TO C-2 (COMM- ERCIAL). - BURT SNELL PROPERTY. MAYOR FLOOD ASKED IF THERE WERE ANY OBJECTIONS. MR. PAUL STEVENSON STATED THAT HE HAD NO OBJECTION TO THE CHANGING OF THE ZONING, BUT THERE WERE A FEW EXCEPTIONS THAT HE PREFERRED-COMMERCIAL FISHING HOUSES, MARINAS AND LUMBER YARDS. MR. VOCELLE'S LEGAL OPINION WAS THAT THESE THREE CANNOT JUST BE EX- CLUDED. AT THE REQUEST OF MR. VOCELLE, MR. SNELL AGREED TO SEND A LETTER TO THE CITY CLERK'S OFFICE STATING THAT HE WISHED TO CONDUCT A MARINE WHOLESALE AND COMMERCIAL FISHING TACKLE BUSINESS ONLY. MR. VOCELLE SUGGESTED THAT THERE BE A FIRST READING OF THE ORDINANCE AND HE WOULD LOOK FURTHER INTO THE MATTER AND BRING UP FOR DISCUSSION AT THE NEXT COUNCIL MEETING. THE CITY CLERK GAVE A FIRST READING OF THE ORDINANCE IN ITS ENTIRETY. MOTION BY COUNCILWOMAN MC KINLEY, SECONDED BY COUNCILMAN JOACHIM, TO PAY APRIL BILLS IN THE AMOUNT OF $17,562.54. CARRIED. MR. RICHARD NORMAN APPEARED BEFORE THE COUNCIL TO INQUIRE WHY HIS DAUGHTER WAS NOT PERMITTED TO BUILD A HOUSE. MR. VOCELLE EXPLAINED THAT THE PERMIT HAD BEEN DENIED SINCE THE YOUNG LADY WAS A MINOR. MR. CRAGG INQUIRED IF ANY ARRANGEMENTS HAD BEEN MADE TO PAVE COOLIDGE STREET. MAYOR FLOOD ADVISED THAT HE WAS TRYING TO GET A LEFT TURN LANE IN FRONT OF THE BANK AND HOPED TO COMBINE THE TWO JOBS. MR. CRAGG SUGGESTED THAT SINCE THERE WERE SO MANY RESIDENTS PRESENT FROM ORANGE HEIGHTS IN CONNECTION WITH THEIR PROBLEM AND ALSO OTHERS INTERESTED IN THE NOISE PROBLEM AT THE AIRPORT, THESE TWO ITEMS SHOULD BE MOVED UP ON THE AGENDA. MAYOR FLOOD REQUESTED PERMISSION OF THE COUNCIL TO DO SO. MOTION BY VICE MAYOR GRAY, SECONDED BY COUNCILWOMAN MC KINLEY, TO MOVE THE NOISE PROBLEM AND THE ORANGE HEIGHTS PROBLEM UP ON THE AGENDA. KEPPLER ADDED THAT HE ALSO HE~CD..fHA~A~T~N¢ A~90,~GRAN.T._FRON_~HF._FEI~ ~L_~O,I~SRNMENT TO MAKE IT POSSIBLE TO HAVE A BIGGER AND BETTER AIRPORT AND THOUGHT THIS WAS WRONG TO USE THE TAX PAYERS MONEY FOR SOMETHING THE TAX PAYERS DON'T WANT. MR. JOHN VAN ANTWERP, AIRPORT MANAGER, EXPLAINED THAT NOT ONE PENNY OF TAX PAYERS MONEY GOES INTO THESE GRANTS. THE MONEY COMES FROM THE 7¢ A GALLON THAT IS CHARGED FOR EVERY GALLON OF GAS USED BY AIRPLANES AND THUS IS PAID FOR BY ALL AIRPLANE OPERATORS, OWNERS AND PEOPLE WHO RIDE THE AIRPLANES. OVER A $1,000,000 A DAY IS COLLECTED. MR. VAN ANTWERP BXPLAINED FURTHER THAT THIS IS A FEDERAL LAND GRANT AIRPORT AND IF THE CITY OF SEBASTIAN DOES NOT INTAIN IT, iT COULD END UP AS PRIVATE PROPERTY SOLD TO SOME INDUSTRY THAT COULD BE EVEN MORE JECTIONABLE. HE STATED THAT TOUCH AND GO TRAFFIC HAS BEEN ELIMINATED AT SOME AIRPORTS, ORMOND BEACH, FOR ONE, BUT DID NOT KNOW WHAT THE PROCEDURE WAS. IT WAS SUGGESTED THAT POSSIBLY ONE OF THE RUNWAYS COULD BE CLOSED, BUT MR. VAN ANTWERP SAID THAT NO CHANGES COULD BE MADE WITHOUT THE CONSENT OF THE FEDERAL AVIATION ADMINSTRATION AND THERE IS NOT MUCH LIKELIHOOD OF THEIR PERMITTING ANY CHANGES IN OPERATION. MR. VOCELLE IS TO CHECK INTO THE ORMOND BEACH AIRPORT ORDINANCE AND ALSO WITH THE FLORIDA LEAGUE OF CITIES TO SEE WHAT POWERS WE HAVE TO REGULATE AIR TRAFFIC AND REPORT BACK AT THE NEXT WORKSHOP MEETING. MR. CRAGG THOUGHT THE PEOPLE SHOULD BE INFORMED THAT WHILE THE STATEMENT HAD BEEN MADE THAT NONE OF THE CITY'S MONEY HWAS USED FOR THE AIRPORT, THE CITY DID PAY FOR THE LIGHTS. MAYOR FLOOD EXPLAINED THAT THIS WAS A LOAN AND WILL BE REPAID. MR. JOHN ROGERS REQUESTED PERMISSION OF THE COUNCIL TO BURY DEBRIS (CONCRETE BLOCK, NOT GARBAGE) IN A HOLE DUG ON THE PROPERTY OF THE AMERICAN LEGION. MOTION BY COUNCILMAN JOACHIM, SECONDED BY COUNCILWOMAN MC KINLEY, TO ALLOW THE AMERICAN LEGION TO BURY THEIR DEBRIS. CAPARIED. MAYOR FLOOD PROMISED TO LOOK INTO THE STATEMENT MADE BY MR. ROGERS THAT CITY VEHICLES ARE USING ABOUT 50-75' OF THE AMERICAN LEGION PROPERTY FOR THE RIGHT OF WAY TO THE CITY GARAGE. MOTION BY COUNCILMAN JOACHIM, SECONDED BE VICE MAYOR GRAY, TO ACCEPT MR. ARNOLD PECHSTEIN AS A MEMBER OF THE BOARD OF ADJUSTMENT. CARRIED. VICE MAYOR GRAY STATED THAT HE AND COUNCILMAN GASS HAD MET A COUPLE OF TIMES TO DISCUSS THE RATE CHANGES AT THE COMMUNITY CENTER, BUT REALLY HAD NOT HAD SUFFICIENT TIME TO DEVOTE TO THE MATTER. THEY WILL CONTINUE WITH THEIR DISCUSSION. MAYOR GRAY GAVE THE FOLLOWING REPORT FOR COUNCILMAN GASS, WHO RECENTLY HAD THROAT SURGERY: MINUTES OF REGULAR COUNCIL MEETING, MAY 14,1979 (CONT'D) #2 556 RECEIVED 3 REQUESTS FOR STREET LIGHTS, DENIED 2, APPROVED 1. HE MET WITH REPRESENTATIVES OF FLORIDA POWER AND LIGHT COMPANY FOR THE PURPOSE OF WORKING OUT A PLAN FOR THE FUTURE LIGHT INSTALLATIONS. THEY ADVISED THAT THEY WERE TRYING TO GET ADDITIONAL HELP, BUT REQUESTED THAT iN THE MEANTIME POLICE OFFICERS SHOULD TRY TO KEEP THEM INFORMED OF ANY LIGHTS THAT ARE OUT. HE HAS AN APPOINTMENT WITH REPRESENTATIVE BAFALIS AND HOPE TO MEET LATER WITH SENATORS CHILES AND STONE TO DISCUSS THE DECLINE OF OUR REQUEST FOR FUNDS FROM THE DEPARTMENT OF HEALTH, EDUCATION AND WELFARE. HE ATTENDED THE FIRST BOARD OF DIRECTORS MEETING OF THE COUNCIL ON AGING AND WAS APPOINTED TO THE PERSONNEL COMMITTEE. COUNCILMAN JOACHIM ANNOUNCED THAT THE CEMETERY BEAUTIFICATION COMMITTEE ORDERED 50 JERUSALEM THORN TREES TO LINE THE NEW ROAD IN THE CEMETERY. IN CONERT WITH THE LIONS CLUB, THE CEMETERY BEAUTIFICATION COMMITTEE HAS PURCHASED TWO WINDOW FANS FOR INSTALLATION IN THE COMMUNITY CENTER. COUNCILWOMAN McKINLEY STATED THAT IN 7 MONTHS THE BUILDING DEPARTMENT HAS ISSUED CONSTRUCTIONS PERMITS IN THE AMOUNT OF $5,810,000. PERMIT FEES $29,957. MAYOR FLOODANNOUNCED THAT HE HAD LEARNED THAT IT IS ILLEGAL TO USE CITY FUNDS TO PROVIDE TRANSPORTATION FOR ANYONE WISHING TO GO TO THE MEETING WITH GENERAL DEVELOPMENT CORPORATION IN MIAMI, BUT THAT ANYONE COULD PROVIDE THEIR OWN TRANSPORTATION, OR GO WITH ANYONE WHO WAS GOING DOWN, IT THERE WAS ROOM. CHIEF JAMES CUMMINS REPORTED THAT DURING THE MONTH OF APRIL THER6WERE 232 COMPLAINTS ANSWERED BY THE POLICE DEPARTMENT, NOT INCLUDING TRAFFIC STOPS. THE POLICE AUXILIARY CLASS IS GOING INTO ITS FINAL WEEK AND ABOUT 14 PEOPLE WILL BE CERTIFIED. MR. DALE WEHR REPORTED THAT THE STREET DEPARTMENT HAS SPENT MOST OF THE TIME THIS MONTH CLEANING OUT A TOTAL OF 11 COMPLAINTS WERE HANDLED. A LOT OF TIME WAS SPENT ON EQUIPMENT REPAIR AND . MR. WEHR REQUESTED PERMIS~OF~HE~I~DVERTISE FOR BIDS FORA TRACTOR. MOTION BY COUNCILMAN JOACHIM, SECONDED BY VICE MAYOR G~AY, \TO/ADVERTISE FOR BIDS FOR A TRACTOR (RIDING MOWER) FOR THE STREET DEPARTMEA~T~RRIED. [I MR. ART MAYER REPORTED THAT THE BUILDING~JIE~ART4~ENT ~4AgUED ~ SINGLE FAMILY HOUSING PERMITS VALUED AT $454,500. TOTAL NEW CONSTRUCTION FOR THE MONTH OF APRIL AMOUNTED TO $598,357. THE PERMIT FEES WERE $3,131.25. THE CONSTRUCTION BOARD iSSUED 2 PE~S C~.PT~FICATES~ OF COMPETENCY THROUGH RECIPROCITY WITH BREVARD COUNTY, 2 PERSONS SUBMITTED APPL~C~"I~N£ ~BE APPROVED TO TAKE THE BLOCK PROCTOR EXAM. BOTH APPLICANTS WERE DENIED AS THEY DID NOT S']B.~$T COM~_TE APPLICATIONS. AN ELECTRICAL CONTRACTOR HAS HAD HIS ELECTRICAL LICENSE SUSPENDED IN THE CITY OF, SEBASTIAN UNTIL FURTHER NOTICE. MR. MAYER ADVISED THE TIME HAS EXPIRED ON THE EMERGENCY E. VFRGY O~{DINANCE AND NEEDS TO BE EXTENDED. MOTION BY COUNCILWOMAN McKINLEY, SECONDED BY CO~7~CILMAN JOACHIM, TO EXTEND THE EMERGENCY ENERGY CODE TO JUNE 15,1979. NAYS: NONE CARRIED. VICE MAYOR GRAY ADVISED THAT AS A RESULT OF INSPECTION BY THE AETNA INSURANCE COMPANY, WHO INSURES THE CITY FOR LIABILITY, THEY RECOMMENDED THAT A "NO DIVING"SIGN SHOULD BE POSTED AT THE SWIM LAKE, A DESIGNATED SWIM AREA IDENTIFIED AND MARKED, AND CONSIDERATION SHOULD BE GIVEN TO PROVIDING A LIFEGUARD. WEHR STATED THAT THE DOCK ITSELF WOULD BE STENCILED. MAYOR FLOOD REMARKED THAT THE COST OF HIRING LIFEGUARD THE YEAR ROUND WOULD BE PROHIBITIVE. MR VOCELLE SUGGESTED THAT SOME RULES SHOULD BE POSTED AS, "CHILDREN MUST BE ACCOMPANIED BY ADULTS", "SWIM AT YOUR OWN RISK", "NO SWIMMING AFTER CERTAIN HOURS". HE WAS REQUESTED TO SUBMIT SUCH A LIST, WHICH WILL BE POSTED. MAYOR FLOOD ADDED THAT THE PARK HOURS ARE FROM SUNUP TO SUNDOWN. MAYOR FLOOD ANNOUNCED THAT WE HAVE RECEIVED THE PERMIT FOR THE DOCK AND WE WILL GO AS FAR AS WE CAN WITH THE $24,000. BUDGETED FOR THIS PROJECT THIS YEAR. CONSIDERATION MIGHT ALSO BE GIVEN TO PURCHASING PILING AND STORING IT, BECAUSE OF THE CONTINUING RISE IN PRICES. LETTER WAS READ FROM MR. AND MRS. BREITWEISER EXPRESSING THEIR THANKS AND APPRECIATION FOR THE CONGREATE MEALS PROGRAM. LETTER WAS READ FROM MRS. RAYMOND HURLEY THANKING MR. WEHR AND THE STREET DEPARTMENT FOR THE GOOD JOB DONE IN CLEARING OUT THE DITCH BEHIND HER HOUSE. LETTER WAS READ FROM MR. THEODORE WILLIAMS REQUESTING THAT WE =OIN IN AN EFFORT TO ELIMINATE TRAIN WHISTLES. MR. VOCELLE STATED THAT THIS COULD POSE A LOT OF LEGAL QUESTIONS. LETTER WAS READ FROM THE AMERICAN RED CROSS OF BREVARD COUNTY INVITING ATTENDANCE AT THEIR 67TH ANNUAL MEETING ON MAY 20. LETTER WAS READ FROM DR. HENRY FISCHER GIVING THE CITY PERMISSION TO USE THE CAV CORPORATION'S BLOCK ACROSS FROM TASTEE-FREESE FOR THE JULY FOURTH CELEBRATION. INVITATION WAS READ FROM THE AMERICAN LEGION TO ATTEND A MEMORIAL DAY SERVICE ON MAY 27. LETTER WAS READ FROM THE VFW REQUESTING THE RETURN OF THE QUIT-CLAIM DEED OF THE PROPERTY OWNED BY THE VFW, NOW HELD IN ESCROW BY THE CITY CLERK OF THE CITY OF SEBASTIAN. MAYOR FLOOD ANNOUNCED THAT MAY 15,1979, WAS THE DEADLINE ON THE ENGINEERING FIRMS INTERESTED IN DOING A SURVEY FOR THE CITy ON OUR ROADS, IF AND WHEN WE GO INTO A BONDING PROGRAM FOR THE ROADS. SINCE THE COST IS UNDER $1,000 IT IS NOT NECESSARY TO PUT IT OUT FOR BIDS. MAYOR FLOOD STATED THAT IT WAS NOT NECESSARY TO MAKE A MOTION AND INSTRUCTED VICE MAYOR GRAY TO MAKE THE PURCHASE. MR. ERROL GREEN HAS BEEN PAYING TAXES ON A ROAD RIGHT OF WAY ON LOUISIANA AVENUE WHICH WAS DEDICATED TO THE CITY OF SEBASTIAN YEARS AGO AND REQUESTED THAT THE CITY HAVE HIS NAME REMOVED FROM THE TAX ROLLS. VICE MAYOR GRAY VOICED THE OPINION THAT SINCE MR. GREEN'S NAME APPEARS ON THE TAX ROLLS, HE STILL LEGALLY IS THE OWNER, AND HE SHOULD BE REQUESTED TO DEDICATE THIS PROPERTY TO THE CITY AGAIN.
