CITY COUNCIL CHAMBERS 1225 MAIN STREET, SEBASTIAN, FLORIDA Vice Mayor Taracka called the Special Meeting to order at 7:00 p.m. The Pledge of Allegiance was recited. He said the City had requested consideration relative to Gibson Street right-of-way and aviation easements at the time of the original agreement. He said this agreement requires development of a management plan, and that while he was concerned that there was nothing in the agreement to protect the City, it would not be in the best interest of the City to negate the agreement. The Director of Community Development said he had been assured by Robert Keating and Roland DeBlois that the City's concerns had been addressed in the application, and by the County's consultant that those concerns would be addressed in the management plan. MOTION by Cartwright/Sullivan I move to approve the conceptual approval agreement for the state-cost share reimbursement to Indian River County and authorize the Mayor to execute with the understanding that the issues raised in the Community Development Director's memorandum of May 8, 1997 to Mr. Roland DeBlois will be addressed in the management plan contemplated by this agreement. Cub Scouts Use of Riverview Park for Ceremoay -3/29/97 - 6:30 pm to 8 The City Manager presented the request by the Cub Scouts for use of Riverview Park for a ceremony on May 29, 1997 and noted the request included use of electricity and a waiver of the $100 security deposit. 2 City Council Meeting May 21, 1997 Page Three Discussion followed on the issue of security waivers and what policy was currently being followed for these types of requests. The City Manager said staff was bringing these requests to Council in accordance with guidelines for use of the park established by Council at its February workshop. Vice Mayor Taracka received a consensus to allow public input. Harry Thomas, 654 Balboa Street, Sebastian, objected to a security waiver. Discussion continued on the security deposit, when it is submitted and returned and if it can be held. The Deputy Clerk said it was her understanding that it was the policy of the Finance Department that security checks must be deposited. The City Manager said he would check with the Finance Department on policy. He suggested that the Scouts be asked to submit the check and it will be held. Following further discussion on use policy, the City Manager urged that the use policy be workshopped and fmalized. MOTION by Sullivan/Taracka I would move that we approve the Cub Scouts' use of Riverview Park for the ceremony on 5/29/97 from 6:30 p.m. to 8 p.m. with the collection of the standard fee following our standard policy but that it will be refunded immediately after the ceremony, the next day after the ceremony, and we'll have to include the use of electricity, all they're going to have it for is a PA system and they're only going to be there from 6:30 p.m. to 8 p.m., with the understanding Cub Scouts will be cleaning up the area. (~.o.r~unity Development Transmittal 5/13/97, propg~d 0-97-47) In response to Mrs. Sullivan, the Director of Community Development said he would check with other communities on the standard square footage for efficiencies. In response to Mr. Taracka, the Director of Community Development said he could research other communities on a maximum size for garages. In response to Mrs. Cartwright, the Director of Community Development said the code does not require garages or carports in multiple family districts. He said this fact could be added to those sections for clarification. The City Manager suggested that the excluded areas listed in single-family could be listed for duplexes. Mrs. Cartwright added that the 60 foot storage area should be added to the exclusion list. The Director of Community Development said all zoning districts will have to be amended in accordance with these suggestions. Discussion took place on size requirements for garages and accessory buildings. Review Proposed Ordinancg No. O-9Y-48 - R~idential Use Screening - Section 20A-3.1 l.D.7.(c) (Communil/~ DevelopIl]~l~[ Tral~smittal 5/13/97, Proposed 0-97-48) The Director of Community Development said Planning and Zoning recommends deferring this item for further review. 97.144 C. l~yiew proposed Ordinance No. O-97-49 - Req~iri~ Ac~ory ]5~ilding Permits to be Consistent with Comprehensive Plan - LDC Section 20A-~5~7~1).4~ (Community Development Transmittal 5/13/97, Prol~o~cd Q-97-49) Mrs. Cartwright suggested "and/or" be added prior to Comprehensive plan. 97.145 D. Review Propo_jed ~)rclirlance No. O-97-50 - Visibility Triarlgles - J~I)C Section 20A-13.13 (C0.II~0nity Development Transmittal 5/13/97, Propo~ed Q-97-50) The Director of Community Development demonstrated the two different visibility triangle requirements in the Land Development Code and recommended using the method in 20A-5.12. City Council Workshop 21, 1997 Page Three 97.146 E. Review Proposofl Ordin~w,~V No. 0-97-51 - Screening for Drjy~ Through Restaurants - LDC Section 20A-6.1.c.25. (Communi~v ~v,lopment Transmittal 5113J97. PrOposed 0-97-51) Discussion took place on types of screening. Mrs. Sullivan suggested an eight foot wall at the rear rather than plantings or other opaque screen, in response to the City Manager, the Director of Community Development said a property line with right-of-way between it and residential is not considered adjacent to residential. TAPE I - SIDE II (7:55 p.m.) Discussion continued on the type of buffer needed, which property lines buffer would be required for, defmition of residential use, and the need to define finish material for walls. Vice Mayor Taracka received a consensus to allow public input. Sal Neglia, 461 Georgia Boulevard, Sebastian, said he would want to see screening to the rear of CR 512 properties. Mrs. Cartwright reminded him this ordinance would address screening CG uses when they abut residential and the area he was referring to was CR 512 zoning. The Director of Community Development summed up Council direction to change the requirement to an eight foot wall on the rear property line when abutting residential uses; defining style, maintenance and windloading for walls; and requiring landscaping with the walls. 97.096 F. Review Proposed Ordinate No. O-97-52 - Residential M~rlllfactured Homes as Permittefl..U~ iu_ PUD-MH Zoning District - I, DC Section 20A-4.8. (Conulllmj~y Development Transmill[al 2113197, Proposed 0-97-52) City Council concurred with language to add to PUD-MH and RMH districts to allow "residential manufactured buildings" with a definition of same from Florida Statutes. The Director of Community Development noted that this would require two public hearings since it is an amendment to permitted use in a zoning district. 97.147/ G. 96.191 Review Proposed OrdJlllmce No. 0-97-53 - RegulgltioIl of Mini-Storage Facilities - I, DC Section 20A-5.47 (Director of Conulll~iW Development Transmi[hal 5/13/97, Proposed 0-97-f~) The Director of Community Development explained the proposed amendments and a lengthy discussion followed relative to mini-storage and self-service storage facilities. It was noted that self- service would be considered a special use in CG, PUD(C) and IN, but it could be a conditional use. There was no consensus on the recommendation. Mrs. Cartwright suggested adding "side, front and back" in paragraph B4 relative to setbacks; and asked several other questions relative to requiring opaque screen when not abutting residential, difference in wall height and limiting office space to 400 square feet. Discussion followed on adding electricity to provide lights only in storage units; adding new City Council Workshop ~ 21, 1997 Page Four TAPE II - SiDE I (8:43 p.m.) language to provide outdoor storage under strict conditions; adding water service for fire protection if required; and defining "management office" only. 97.148 H. Open Discussiorl by ~ouncil Members Re: Miscellaneous Issues and M~t~r~ (No Backup) Mr. Paul asked when a consensus or a motion of Council is required and when to table or not to table an item. Discussion followed on when a consensus can be given for direction on informal matters, adoption of Roberts Rules of Order in the City's procedures resolution, and whether tabling is to a time certain. The Deputy Clerk said she would get with the City Clerk upon her return. Mr. Paul then asked if Council members can address items as private citizens during a meeting if a matter affects them. Vice Mayor Taracka said Council members can address any item under his or her matters. 5.
