HomeMy WebLinkAbout05231979SPECIAL MEETING, MAY 23,1979 WAS CALLED TO ORDER BY MAYOR PAT FLOOD, JR., AT 3:15 P.M. PRESENT: COUNCILMEN EVERETT T. # PAT FLOOD, JR. GASS AND J. RANDY JOACHIM, COUNCILWOMAN DOROTHY W. McKINLEY AND MAYOR ViCE MAYOR LEWIS GRAY EXCUSED. (OUT OF TOWN) MEETING WAS CALLED TO DISCUSS SIGNING OF A CONTRACT TO GIVE THE CONGREGATE MEALS PROGRAM FREE USE OF THE COMMUNITY CENTER FOR A YEAR. MAYOR FLOOD READ A LETTER FROM VICE MAYOR GRAY STATING THAT HE HAD NO OBJECTIONS TO GRANTING THIS FREE USE OF THE CENTER. COUNCILMAN JOACHIM OBJECTED TO THE FACT THAT MEALS ON WHEELS WERE'OBTAiNING THE MEALS THROUGH THE CONGREGATE MEALS PROGRAM (WHICH IS FEDERALLY FUNDED) BUT IT WAS EXPLAINED BY MR. GEORGE ARMSTRONG THAT THEY WERE ORDERED AS A SAVING STEP AND CONGREGATE MEALS BILLED HIM FOR THE MEALS. COUNCILMAN JOACHIM STATED THAT THE WHOLE MATTER OF FREE USE OF THE COMMUNITY CENTER IS BEING CONSIDERED BY VICE MAYOR GRAY AND COUNCILMAN GASS. IT TAKES TWO MEN THE MAJORITY OF THE DAY CLEANING UP AND SETTING UP AND THERE's THE USE OF ELECTRICITY. MAYOR FLOOD VOICED THE OPINION THAT iF WE WERE GOING TO ALLOW FREE USE BY ANYONE, IT WOULD BE FOR THE CON- GREGATE MEALS PROGRAM. COUNCILMAN GASS ADDED THAT IN HIS DISCUSSIONS WITH VICE MAYOR GRAY THE ONE THING THEY AGREED ON WAS THAT THEY WOULD NOT CHARGE CONGREGATE MEALS. MOTION BY COUNCILMAN GASS, SECONDED BY COUNCILMAN JOACHIM, WHO ADDED:"I~ YOU PUT IT TO A VOTE",-TO GRANT THE CONGREGATE MEALS FREE USE OF THE COMMUNITY CENTER FOR THE COMING YEAR. ROLL CALL VOTE: AYES: COUNCILMAN GASS COUNCILWOMAN McKINLEY MAYOR FLOOD MAYOR F OD STATED THAT HE WOULD SIGN CONTRACT A.VD ASK 'HEN THE DEADLINE WAS. MR. CARRIED. BY COUNCILMAN JOACHIM, SECONDED BY COUNCILWOMAN McKINLEY, TO PERMIT THE USE OF ALCOHOLIC BEV- BY THE INDIAN RIVER COUNTY BOWLING ASSOCIATION AT THE COMMUNITY CENTER ON MAY 26. CARRIED. MR. MAYER EXPLAINED THAT MR. KEPPLER CALLED HIM STATING THAT HE HAD 2 UNDERSIZED LOTS. WE GENERALLY GO BY 80' X 125' AND IN READING OUR ORDINANCE IT SAYS: "ANY LOTS WITH A WIDTH OF 75' OR MORE MUST HAVE A 10' SIDE YARD. ANY LOTS LESS THAN 75' ARE ALLOWED 10% OF THE FRONTAGE WIDTH." HIS ARE 75.8' THERE WAS A MISUNDERSTANDING ON THE PART OF BOTH MR. KEPPLER AND MR. MAYER. WHEN MR. MAYER READ IT HE ASSUMED 75' OR MORE HAS TO HAVE A 10' SIDE YARD, BUT THEN IN READING THE REST OF IT, IT SAID 75' OR LESS, SO THE 75' WAS USED TWICE. COUNCILMAN JOACHIM POINTED OUT THAT 75.8 iS MORE THAN 75. MR. MAYER SAID THIS IS WHAT WE'RE TALKING ABOUT. WOULD WE ALLOW 7%'? AT THAT TIME, HE ISSUED HIM A PERMIT. IT WAS BROUGHT TO MR. MAYER'S ATTENTION WHAT WAS HAPPENING. HE WENT DOWN WITH THE MAYOR AND MEASURED THE LOTS. WITH 75' IN MIND HE WAS LOOKING FOR 15' THESE MEASURED 17.2' or 17.3', BUT IN READ- ING THE ORDINANCE THE WAY IT'S WRITTEN, THEY SHOULD BE 20' MAYOR FLOOD ELABORATED FURTHER: OUR ORDINANCE SAYS THAT WITH LOTS 75' OR MORE THERE HAS TO BE 10' ON EACH SIDE OF THE HOUSE, SO IF YOU HAVE TWO LOTS, THE LOT LINE IS IN THE MIDDLE, SO YOU HAVE TWO SIDE LOT LINES AND THERE SHOULD BE 20' BETWEEN THE HOUSES AND THERE IS ONLY 17' MR. MAYER WAS ASKED TO RED TAG IT BY MAYOR FLOOD SINCE IT WAS NOT UP TO PAR ON THE SETBACKS. MR. VOCELLE ADVISED THAT SINCE THERE WAS A MISINTERPRETATION, THIS CREATED A HARDSHIP AND IT IS UP TO THE COUNCIL TO DECIDE WHETHER THIS MATTER SHOULD BE PASSED ON TO THE VARIANCE BOARD. THERE PROBABLE IS $2500. AT LEAST INVESTED SO FAR. MAYOR FLOOD STATED THAT IF IT IS PASSED TO THE VARIANCE BOARD, ANOTHER PROBLEM WILL BE CREATED. THERE ARE ONLY 3 MEMBERS ON THE VARIANCE BOARD AND HIS WIFE, SYLVIA FLOOD, IS THE CHAIRMAN OF THE BOARD. BEFORE HE KNEW THIS REQUEST WAS GOING TO COME UP, HE HAD TOLD MRS. FLOOD ABOUT THE PROBLEM, AND HE WAS AFRAID THIS WOULD PREJUDICE HER POSITION. THEREFORE, IT IS NECESSARY TO OBTAIN ANOTHER MEMBER TO SERVE ON THE BOARD. MOTION BY COUNCILWOMAN McKINLEY, SECONDED BY COUNCILMAN GASS, TO ALLOW MR. KEPPLER TO TAKE HIS PROBLEM TO THE VARIANCE BOARD. ROLL CALL VOTE: AYES: COUNCILMAN GASS COUNCILWOMAN McKINLEY MAYOR FLOOD NAYS: COUNCILMAN JOACHIM CARRIED. FLOOD STATED THAT PLANS WERE SUBMITTED BY VARIOUS ENGINEERING FIRMS AND SOME WERE ELIMINATED BECAUSE THEY WBRE TOO FAR AWAY. THE FOLLOWING ARE TO BE CONSIDERED: BRiLEY, WILD & ASSOCIATES; VTN, INC.; POST BUCKLEY, SCHUB & JERNIGAN; LLOYD & ASSOCIATES; CARTER ASSOCIATES. INTERVIEWS HAVE BEEN SET UP FOR NEXT WEEK. MAYOR FLOOD ADDED THAT IF THE COUNCIL MEMBERS WOULD LIKE TO CONDUCT THE INTERVIEWS, THEY ARE WELCOME TO DO IT, BUT MR. VOCELLE SUGGESTED THAT A COMMITTEE OF 3 PEOPLE SHOULD BE SET UP. HE RECOMMENDED DAVID MARSH, THE COUNTY COMMISSION PLANNER, AND MAYBE ONE OF THE ENGINEERS WHO LIVES IN THE CITY. COUNCILMAN JOACHIM WONDERED WHY WE COULD NOT HIRE A CONSULTANT THE WAY WE DID WITH THE PENSION PLAN? MAYOR FLOOD EXPLAINED THAT MR. VOCELLE THOUGHT THAT THOSE PERSONS ALREADY MENTIONED ALONG WITH THE BONDING COMPANY COULD DO THE JOB CAPABLE. MOTION BY COUNCILMAN GASS, SECONDED BY COUNCILWOMAN McKINLEY, TO GIVE MAYOR FLOOD PERMISSION TO APPOINT A COMMITTEE TO INTERVIEW THE ENGINEERS, WHICH WOULD CONSIST OF HIMSELF, DAVID MARSH, AND THE TWO ENGINEERS WHO ARE MEMBERS OF OUR ZONING AND PLANNING COMMISSION. CARRIED. WITH REFERENCE TO THE APPOINTMENT OF SOMEONE TO NEGOTIATE WITH GENERAL DEVELOPMENT CORPORATION, COUNCILWOMAN McKINLEY MENTIONED THAT SHE WOULD LIKE TO BE AN ASSISTANT. MOTION BY COUNCILMAN JOACHIM, SECONDED BY COUNCILMAN GASS, TO APPOINT MAYOR FLOOD AS THE NEGOTIATOR WITH GENERAL DEVELOPMENT CORPORATION. MEETING ADJOURNED AT 4:20 P.M. CLERK MAYOR _
