PURPOSE: ADOPTION OF EMERGENCY ORDINANCE NO. 0-90-05 - IMPOSING MANDATORY RESTRICTIONS ON WATER USAGE IN THE CITY Mayor Conyers called the Special Meeting to order at 7:00 p.m. 2. The Pledge of Allegiance was recited. 3. ROLL CALL Present: Absent: Mayor W.E. Conyers Councilman Robert McCollum Councilman Lonnie Powell Councilman Lloyd Rondeau Vice Mayor Frank Oberbeck (excused) Also Present: City Manager, Robert McClary Acting City Attorney, Richard Torpy Interim City Engineer, David Fisher City Clerk, Kathryn O'Halloran Deputy City Clerk, Sally Maio 4. PUBLIC INPUT ON AGENDA ITEMS None. 5. ORDINANCE NO. 0-90-05 - Imposing Mandatory Restrictions on Water Usage in the City AN ORDINANCE OF THE CITY OF SEBASTIAN, INDIAN RIVER COUNTY, FLORIDA, ADDING CHAPTER 10 TO THE CODE OF ORDINANCES OF THE CITY OF SEBASTIAN; ADDING NEW SECTIONS 10-1 THROUGH 10-18 PERTAINING TO A WATER SHORTAGE PLAN FOR EXISTING LANDSCAPE IRRIGATION RESTRICTIONS, DOMESTIC AND COMMERCIAL, NEW LANDSCAPE IRRIGATION RESTRICTIONS, DOMESTIC AND COMMERCIAL; ESSENTIAL USE RESTRICTIONS; HOUSEHOLD AND DOMESTIC TYPE USE RESTRICTIONS; WATER UTILITY USE RESTRICTIONS; COMMERCIAL AND INDUSTRIAL USE RESTRICTIONS; AGRICULTURAL USE RESTRICTIONS; NURSERY USE RESTRICTIONS; GOLF COURSE USE RESTRICTIONS; DEWATERING USE RESTRICTIONS; WATER BASED RECREATION RESTRICTION USE (INCLUDES POOLS, WATER SLIDES, SWIM AREAS); MISCELLANEOUS USE RESTRICTIONS; PROVIDING THAT THE ORDINANCE IS SUPPLEMENTAL; PROVIDING FOR INCLUSION IN THE CODE OF ORDINANCES OF THE CITY OF SEBASTIAN; PROVIDING A SEVERABILITY CLAUSE; PROVIDING AN EFFECTIVE DATE; AND PROVIDING FOR REPEAL. The City Manager said the City Attorney would be fifteen minutes late. The Interim City Engineer explained that there is currently a St. Johns River Water Management District (SJRWMD) Phase I voluntary water restriction in effect and that SJRWMD had no objection to adoption of this ordinance as long as it is not less restrictive than what they have. He said SJRWMD is meeting June 12 and 13, 1990 to review current conditions and decide what further action it should take. Lu Richards, St. Johns River Water Management District, explained the water monitoring system, said water in this vicinity is at its lowest point in fifty-four years of monitoring and stated if the district does not receive required rainfall SJRWMD may have to go to a mandatory restriction. Attorney Rick Torpy arrived at 7:13 p.m., distributed copies of Ordinance No. 0-90-05 to City Council and staff, explained the content of the ordinance, which he said was taken from SJRWMD, explained that the ordinance expires on the ninety-first day following adoption and advised that the ordinance can be amended to remain in effect permanently and be turned on and off by resolution. George McCullers, Jr., Dwight Pridgen and George McCullers, Sr. of Reliable Well Drilling addressed Council regarding the severity of the water shortage. J.W. "Tommy" Thompson, 125 Main Street, Sebastian questioned the content of the ordinance. Attorney Torpy read Ordinance No. 0-90-05 by title only. MOTION by Rondeau/Powell I move we adopt Ordinance No. 0-90-05 as read by title only. ROLL CALL: Mayor Conyers - aye Councilman McCollum - aye Councilman Powell - aye Councilman Rondeau - aye MOTION CARRIED 4-0.
