Announcement and Aoenda Modifications Ms. Kautenburg announced that Ms. Matthews, Mr. Carter and Ms. Kinchen were excused from the meeting tonight and Mr. Roberts and Mr. Reno would be voting in their place. V. Approval of Minutes A motion accepting the minutes of the February 6, 2025 meeting was made by Ms. Lorusso, seconded by Ms. Battles and unanimously approved by voice vote. VI. Local Plannino Aoencv (LPA) Public Hearinos A. Public Hearing — Recommendation to City Council — Land Development Code Amendments — TO MAKE A RECOMMENDATION TO CITY COUNCIL REGARDING ORDINANCE 0-25-08 WHICH PROPOSES TO AMEND LAND DEVELOPMENT CODE ARTICLE V ZONING DISTRICT REGULATIONS TO INCORPORATE A NEW ZONING DISTRICT KNOWN AS MIXED -USE ZONING DISTRICT. The City attorney read the title of the quasi -legislative hearing. Ms. Battles stated that Mr. Keppler is her business associate and that she would be filing a Form 86-Memorandum of Voting Conflict. There were no other conflicts or ex-parte communication to disclose. PLANNING AND ZONING COMMISSION/LOCAL PLANNING AGENCY PAGE 2 MINUTES OF REGULAR MEETING APRIL 3, 2025 The Community Development Director explained this new zoning classification called mixed use that is accordance with the adopted 2040 Comp Plan to implement land development regulations for mixed use. There are three separate segments based on acreage of potential different zones. Kelly Keppler, Kimley-Horn, said this was identified during the 202-40 Comprehensive Plan update to create a mixed -use zoning district. In the comp plan there are goals, objectives, and policies for long range visions and the land development regulations implement the specifics of the plan. He said a key is to be consistent with plan or else the City might run a foul with the state. In working with staff, he has come up with a fairly equitable solution of true mixed use where some areas are identified in the comp plan on the future land use map as what is called "paper districts" in that they are not being adopted on a specific piece of property but they could be used for various projects throughout the City depending on the size of the property and context. Mr. Keppler explained that there are mixed use districts along the riverfront because of changing conditions and because of approaches to land development and projects that don't fit into what the normal box this adaptive code will help provide for development outside of the riverfront so one doesn't have to go through a lengthy legislative process in addition to allowing the City to control what and how the properties are developed. He described the designations as Neighborhood Mixed -Use District which is intended to serve as a traditional town center and encourage community activities and pedestrian accessibility. The Community Mixed -Use District would be a mixture of residential and non-residential uses that are on a larger scale and focus on new development. The Regional Mixed -Use District would concentrate on intense retail, employment and high -density uses on larger properties around master plan transportation network. He said some of the core components were pulled from the comp plan to envision this as a long- term growth plan as a true mixed community. He pointed out on the future land use map that someone will need to apply the zoning standards consistent with the designations and complete a map amendment. Ms. Lorusso asked if the parcels already annexed as residential could be changed to mixed use. The Community Development Director said those parcels already have a future land use designation of mixed use. These designations would be the zoning component that would align with the mixed use. Chair Kautenburg noted there wasn't a mention of congregant use which might be considered one of the changing uses that aren't considered multi -family or assisted living but a hybrid in many parts of Florida. Mr. Keppler said that could be considered under the broad use group of residential because it provides for like -mind or like -types of uses. It could also be in conditional use section there is a residential group homes listed. He recommended that this was the time to move those from conditional uses to permitted. Chair Kautenburg said she would like to make easier for people in the future to see if a certain property qualifies for specific uses. The Community Development Director said that could be included. PLANNING AND ZONING COMMISSION/LOCAL PLANNING AGENCY MINUTES OF REGULAR MEETING APRIL 31 2025 PAGE 3 Brent Wohlenberg, Fellsmere, said allowing people to live near their employer would be very beneficial. The Comm Dev Director said this will set Sebastian up for a very bright future. Chair Kautenburg said all over country, people have lived where they work and for a long time, zoning has been in position of eliminating things like that. She is very glad that people will be able to live close to where they work and retirees can age in place. Chair Kautenburg closed the hearing at 6:24 p.m. A motion was made by Ms. Lorusso to recommend that City Council approve Ordinance 0-25-08 proposing to amend Land Development Code Art V zoning district regulations to incorporate a zoning district known as mixed -use zoning district to include congregant living facilities. Mr. Reno seconded the motion. B. Public Hearing — Recommendation to City Council — Land Development Code Amendments — TO MAKE A RECOMMENDATION TO CITY COUNCIL REGARDING ORDINANCE 0-25-10 WHICH PROPOSES TO AMEND LAND DEVELOPMENT CODE ARTICLE VII GENERAL REGULATIONS RELATING TO HOME OCCUPATIONAL LICENSES BY AMENDING LANGUAGE RELATING TO HOME BASE BUSINESSES. The City Attorney read the title of the hearing. The Community Development Director explained that what is in current Land Development Code is in conflict with state legislation. The proposed code will bring the City's code into compliance with state regulations. There was no public input. In response to Mr. Reno, the Community Development Director offered to find out if do home businesses pay extra for trash removal. Ms. Battles, if business came to City for a business license, the City would confirm parking and traffic at that time. The City Attorney said the City would have the ability to regulate to the extent of what is allowed by law. The City Attorney confirmed that home -based businesses could have clients come to the house and have their heavy equipment parked on their property. The Community Development Director said the Building Department and then the Community Development Department would review the applications. Ms. Battles noted that the home day cares, which are beneficial, but cause a lot of traffic. Chair Kautenburg said the proposed code with the mandated changes provides that they can't regulate against any home -based businesses. They would have to rely on Code Enforcement to address any complaints. The Community Development Director said when the state determined they wanted to make this change, the City is required to make sure we are in compliance with state. She noted that Air BnB's are regulated under a different statute. A motion was made by Ms. Battles to recommend approval of the proposed Land Development Code amendment to Article VII general regulations. The motion was seconded by Mr. Roberts.
