THE CITY CLERK WAS ASKED TO READ THE FOLLOWING PROPOSED ORDINANCES: (1) AMENDING CBAPTER 202, ZONING ORDINANCE, SITE PLAN APPROVAL ON C-l, C-2 AND M-1 ZONES. (2) AMENDING CHAPTER 202, ZONING ORDINANCE, SETBACK ON R-1-M ZONE. (3) AMENDING CHAPTER 7, BUILDING ORDINANCE, RE: DRAINAGE OF STREETS. (4) AMENDING CHAPTER 7, BUILDING ORDINANCE, RE: ELECTRICAL FEES. (5) ASSESSMENT OF ADDITIONAL ~l. OI] COST FOR PERSONS CONVICTED IN COUNTY AND CIRCUIT COURTS FOR VIOLATING A MUNICIPAL ORDINANCE OF THE CITY. MAYOR CRAGG EXPLAINED THAT SINCE ALL VIOLATIONS OF A MUNICIPAL ORDINANCE OF THE CITY ARE NOW TRIED IN THE COUNTY AND CIRCUIT COURTS OF INDIAN RIVER COUNTY, THE CITY MUST PASS THIS ORDINANCE TO BE ABLE TO ASSESS THE ADDITIONAL ~1.00 COST FOR THE PURPOSE OF ESTABLISHING A FUND TO PAY FOR THE EDUCATION AND CONTINUED TRAINING OF ITS POLICE OFFICERS. THERE BEING NO RESPONSE FROM THE PUBLIC ON ANY OF THE PROPOSED ORDINANCES, A MOTION WAS MADE TO ADJOURN THE PUBLIC HEARING AT 7:12 REGULAR MEETIN~ - JUNE 10, 1974 MEETING CALLED TO ORDER 8Y MAYOR CRAGG. PRESENT: VICE MAYOR ERVIN YATES, COUNCILMEN JAMES C. KINARD, CLIFFORD BOOSE AND PAT FLOOD, JR., AND MAYOR CRAGG. MIN~'TES OF THE MAY 13, ]974 MEETING WERE APPROVED AS READ WITH ONE CORRECTION - THAT THE WORD "CITY" 8E CHANGED TO "COUNTY" IN COUNCILMAN KINARD'S REPORT ON MANGROVES. MOTION BY COUNCILMAN KINARD AND SECONDED ~Y COUNCILMAN HOOSE TO PAY MAY HILLS IN ~'HE AMOUNT OF ~7,196.72 . CARRIED. VICE MAYOR YATES REPORTED THE BEAMS ARRIVED FOR THE COMe, UNITY BUILDING AND CONSTRUCTION IS COMING RIGHT ALONG. TBE ROOF WAS COMPLETED ON THE CITY GARAGE AND THE SUB-CONTRACTOR DID A FINE JOB. ALSO, PHASE III OF THE DRAINAGE DITCH PROGRAM IS PROGRESSING ~ELL. COUNCILMAN FLOOD REPORTED THE S:~IMMING LAKE IN THE HIGHLANDS HAS BEEN REOPENED. ~JITH REFERENCE TO THE PROPERTY THE CITY IS INTERESTED iN PURCHASING (WATERFRONT PROPERTY AT END OF MAIN STREET), COUNCILMAN FLOOD HOPES TO HAVE THE MATTER SETTLED WITHIN THE NEXT 60 DAYS. A REQUEST TO INSTALL STREET LIGHTS IN THE AREA OF 501 LAKE DRIVE AND 6Ag S~ GAY AVE., SEBASTIAN HIGHLANDS, ',VAS RECEIVED AND TURNED OVER TO THE LIGHT COMMITTEE CBAIRMAN, COUNCILMAN FLOOD. A LETTER WAS RECEIVED FROM SENATOR PHILIP D. LEWIS IN RESPONSE TO THE TELEGRAM SENT TO HIM BY THE CITY COUNCIL REGARDING THE PROPOSED FINANCIAL DISCLOSURE ACT. SEANTOR LEWIS AGREED THAT PROPOSALS ALONG THIS LINE HAVE SEVERE SHORTCOMINGS AND IS ~AITING TO SEE THE FINAL VERSION THAT COMES BEFORE THE SENATE. THE PROPOSED BILL ~AS PASSED 8Y THE HOUSE AND IS ON THE SENATE CALENDAR. A LETTER OF ACKNOWLEDGMENT HAS BEEN SENT TO MRS. HENRY S. SIEBERN FOR THE U. S. FLAG SHE DONATED TO THE CITY. THE FLAG WILL BE FLOWN A'[ THE CITY CEMETERY. MAYOR CRAGG ATTENDED A MEETING OF THE DEPARTMENT OF TRANSPORTATION (DOT) ON MAY 20, 1974 CONCERNING THE REMOVAL OF 23.024 MILES OF STATE ROADS FROM THE PRIMARY HIGHWAY SYSTEM AND TBEIR ADDITION TO THE STATE SECONDARY ROAD SYSTEM. DOT PLANS TO PLACE SR #512, FROM HERE TO FELLSMERE, UNDER THE SECONDARY ROAD SYSTEM, BUT IN RESPONSE TO MAYOR CRAGG'S PLEA TO TAKE THIS UNDER ADVISEMENT BECAUSE OF THE GROWTH OF THE CITY AND THE SURROUNDING AREA, THEY HAVE PROMISED TO REVIEW THE TRAFFIC SITUATION ON SR #512 BEFORE FINAL IMPLEMENTATION OF THE PLAN. IT WILL TAKE ABOUT T,}JO YEARS BEFORE THE PLAN IS ADOPTED AND MAYOR CRAGG FEELS THAT BY THAT TIME THERE WILL BE A NEED FOR FOUR LANES ON SR #512. IN RESPONSE TO ~R. POTTINGER'S COMPLAINT AT THE LAST COUNCIL ~EETING CONCERNING THE LITTERED CONDITION ON THE PROPERTY DIRECTLY ACROSS FROM HIS PROPERTY, A LETTTER ~AS FORWARDED TO THE OWNER · D SINCE TBAT TIME THE AREA HAS BEEN POLICED. MAYOR CRAGG ~ILL CONTINUE TO KEEP AN EYE ON THE AREA. THE PLANNING & ZONING COMMISSION ~ILL MEET ~ITH MR. VOCELLE, CITY ATTORNEY, ON THE TREE ORDINANCE. THE BUILDING DEPARTMENT REPORTED A TOTAL OF ~136,228.50 IN NEW CONSTRUCTION DURING MAY. THE POLICE DEPARTMENT ANSWERED llg COMPLAINTS DURING MAY, NOT INCLUDING TRAFFIC STOPS. CARRIED. ~ITH FURTHER REFERENCE TO THE ANNEXATION SUIT PENDING AGAINST THE CITY OF SEBASTIAN, .JUDGE SMITH RULED LAST WEEK THAT THE CITY OF SEBASTIAN HAD THE RIGHT TO RETAIN THE 17 ACRES OF KEPPLER PROPERTY, BUT THAT THEY MUST DELETE THE 1/4 ACRE BELONGING TO MR. AND MRS. ~VARD. THEREFORE, AN ORDINANCE ,qUST BE PASSED TO REMOVE THAT SECION OF LAND FROM THE PROPERTY ANNEXED. THE CITY CLERK READ THE PROPOSED ORDINANCE.
