PRESENT: COUNCILMAN FRANK OBERBECK, COUNCILMAN RICHARD VOTAPKA, COUNCILMAN GEORGE SCHUM, CITY ATTORNEY DANIEL KILBRIDE AND VICE MAYOR EVERETT T. GASS ABSENT: MAYOR PAT FLOOD, JR. (VACATION) COUNCILMAN OBERBECKANNOUNCED THAT JUNE 15, 1982 WILL BE THE DEADLINE FOR ALL NAMES TO BE TURNED IN FOR THE MAN AND WOMAN OF THE YEAR AND FOR THE RENAMING OF THE BURR PROPERTY PARK. HE ALSO MENTIONED THAT THERE WILL BE A $25.00 BOND GIVEN TO THE WINNER, WHO RE- NAMES THE BURR PROPERTY PARK. COUNCILMAN SCHUM REPORTED THAT AFTER MEETING WITH LEE NUZIE, DIRECTOR, CIVIL DEFENSE, RE- GARDING THE POSSIBILITY OF GETTING FINANCIAL AID TOWARDS THE RENOVATION OF THE OLD SEBASTIAN ELEMENTARY SCHOOL, HE WAS INFORMED THAT THE CIVIL DEFENSE UNIT WILL WORK WITH US AS FAR AS GETTING SOME ASSISTANCE FROM THE FEDERAL GOVERNMENT, STATE GOVERNMENT OR COUNTY. VICE MAYOR GASS REPORTED THAT THE SOCIAL SECURITY OFFICE IS PRESENTLY SENDING A REPRESENTATIVE TO THE CHAMBER OF COMMERCE EVERY FIRST WEDNESDAY OF EACH MONTH, FROM 1:00 P.M. - 3:00 P.M. TO SERVICE THE AREA RESIDENTS. SINCE THERE ARE NOT ENOUGH PEOPLE TAKING ADVANTAGE OF THIS SERVICE, THEY HAVE ASKED IF IT WOULD BE FEASIBLE TO DISCONTINUE THE SERVICE. AFTER DIS- CUSSING THIS WITH DOT MAYER, SECRETARY, CHAMBER OF COMMERCE, THEY FELT THE SERVICE IS NEED- ED AND THAT THIS WAS A BAD TIME OF THE YEAR TO GAUGE ITS VALUE TO THE AREA. ALL OF THE FIREWORKS HAVE ARRIVED AND THERE WILL BE A FOURTH OF JULY DANCE HELD AT THE SEBASTIAN COMMUNITY CENTER, JUNE 19, 1982, TO HELP SUPPORT COSTS INCURRED BY THE FOURTH OF JULY COMMITTEE. AFTER HOLDING A MEETING ON MAY 27, 1982, WITE FH_~ ~E~ASTIAN CEMETERY ASSOCIATION, TO DISCUSS THE CITY'S NEEDS THAT WERE RECOMMENDED BY THF SE3AST1-4W CEMETERY COMMITTEE, COUNCILMAN COUNCILMAN VOTAPKA REPORTED THAT TO DATE, THE TREES HAVE BEEN PLANTED, THE FERTILIZER WILL BE PUT DO N WHEN F* ING AND THEY W LL PROCEED WiTH qE R%Y SEBAS*IAN GIVEN BY BOB ~SHM~D H~R~ W~E~I~~R CC~'TY ~VI~E~S~~TMENT, A SLIDE P~SENTATION WAS ~DE SHOWING A STO~ SURGE WITH PICTURES OF BEFORE AND AFTER A HU~IC~E. HE ~MINDED EVERYONE TO TAKE THE PROPER P~CAUTIONS AND TO STOCK UP ON THE NECESSARY PROVISIONS. COUNCILMAN SCHUM REPORTED THAT THE BOARD OF HEALTH HAS BEEN TAKING WATER SAMPLES FROM THE EASY STREET LAKE, BUT DUE TO HEAVY RAINS THE WATER IS NOT UP TO STANDARD AND iT HAS BEEN TEMPORARILY CLOSED. EARL MASTELLER, CITY ENGINEER, REPORTED THAT HE HAS BEEN REQUESTED BY THE HEALTH DEPARTMENT TO TAKE A SERIES OF EIGHT WATER SAMPLES FROM THE LAKE FOLLOWING THEIR CRITERIA. VICE MAYOR GASS REPORTED THAT FLORIDA POWER AND LIGHT COMPANY HAS INSTALLED 13 STREET LIGHTS IN THE PAST MONTH. JAMES CUMMINS, POLICE CHIEF, REPORTED A TOTAL OF 446 COMPLAINTS FOR THE MONTH OF MAY, 1982, NOT INCLUDING TRAFFIC VIOLATIONS. HE ALSO REPORTED THAT HE IS LOOKING INTO THE POSSIBILITY OF ESTABLISHING A POLICE EXPLORER POST AT THE NORTH END OF THE COUNTY FOR YOUNG MEN AND WOMEN BETWEEN THE AGES OF 13-18. HE MENTIONED THAT HE HAS SPOKEN TO MR. RICE FROM THE BOY SCOUTS AND ALSO SOME YOUNG PEOPLE ALREADY INVOLVED AND FEEL THERE IS ENOUGH INTEREST TO MAKE IT SUCCESSFUL. MR. ROBERT DOHERTY, SUPERINTENDENT, STREET DEPARTMENT, REPORTED THAT SINCE THE HEAVY RAINS THE STREET DEPARTMENT HAS BEEN PRIMARILY WORKING ON DRAINAGE PROBLEMS DURING THE MONTH OF MAY, 1982. MR. ARTHUR MAYER, BUILDING OFFICIAL, REPORTED A TOTAL OF 18 SINGLE FAMILY DWELLING PERMITS ISSUED FOR THE MONTH OF MAY, 1982, WITH A TOTAL OF $3,761.10 COLLECTED IN PERMIT FEES. EARL MASTELLER, CITY ENGINEER, REPORTED THAT HE HAS SPENT THE MAJORITY OF HIS TIME DURING MAY, 1982, ASSISTING ARTHUR MAYER, BUILDING OFFICIAL AND BOB DOHERTY, SUPERINTENDENT, STREET DEPARTMENT, WITH DRAINAGE PROBLEMS. HE INDICATED THAT THE STORM SIEGE WE HAVE HAD GAVE HIM AN OPPORTUNITY TO REALLY PIN POINT SOME OF THE MAJOR TROUBLE AREAS AND HOPED THAT THE CITY COULD GET TOGETHER WITH GENERAL DEVELOPMENT CORPORATION TO TRY TO CORRECT SOME OF THESE REGULAR COUNCIL MEETING - JUNE f~, 1982 PROBLEMS. MR. MASTELLER STATED THAT HE IS GOING TO PHASE OUT OF THE DRAINAGE SITUATION IN ORDER TO CONTINUE WORKING ON THE RENOVATION PLANS FOR THE OLD SEBASTIAN ELEMENTARY SCHOOL. HE ALSO MENTIONED THAT HE HAS SUPPLIED ATTORNEY KILBRIDE WITH A DRAFT, REGARDING THE STREET OPENING PERMIT ORDINANCE. VICE MAYOR GASS EXPLAINED THAT IT WAS REQUESTED THAT THE SEBASTIAN HIGHLAND PROPERTY OWNERS ASSOCIATION SUPPLY THE CITY WITH PROOF THAT THEY FILED THE NECESSARY DOCUMENTS WITH THE STATE, REGARDING ARTICLE #4, OF THE ASSOCIATIONS ARTICLES OF INCORPORATION. AFTER REVIEWING A POST OFFICE DELIVERY RECEIPT DATED MAY 28, 1982, A LETTER DATED MAY 20, 1980 IDENTIFYING THE RESOLUTION ATTACHED AS ENCLOSURE #2, DATED 6-13-80, THERE SEEMED TO BE SOME QUESTIONS REGARDING THE DATES OF THE LETTER AND RESOLUTION THAT WAS MAILED. MR. RICHARD SZELUGA, REGISTERED AGENT, PAST PRESIDENT, SEBASTIAN HIGHLANDS PROPERTY OWNERS ASSOCIATION, STATED THAT HE WOULD TAKE FULL RESPONSIBILITY FOR FAILURE TO ABIDE BY ANY AMENDMENTS THAT WERE MADE BY THE ASSOCIATION AND NOT FILING THEM WITH THE SECRETARY OF STATE AT THAT PARTICULAR TIME THAT THEY WERE MA~E. DUE TO THE FACT THAT THESE AMENDMENTS WERE MADE IN 1980 BY RESOLUTION OF THE ASSOCIATION, HE FELT HE COULD NOT TAKE THOSE DOCUMENTS AND DATE THEM 1982. THEREFORE, HE FILED THE ORIGINAL RESOLUTION THAT THE ASSOCIATION HAD UNDERTAKEN IN ORDER TO AMEND THE ARTICLES OF INCORPORATION. ATTORNEY KILBRIDE REMARKED THAT HE FELT THE SECRETARY OF STATE WOULD HAVE A PROBLEM ACCEPTING THE RESOLUTION AS ADOPTED SINCE, THE RESOLUTION DOES NOT CHANGE THE ARTICLES OF INCORPORATION. ATTORNEY KILBRIDE BRIEFLY EXPLAINED THAT THE COUNCIL ADOPTED AN ORDINANCE IN NOVEMBER, 1981, ALLOWING ADDITIONAL COMPENSATION TO THE VICE MAYOR DURING THE ABSENCE OF THE MAYOR. SINCE THE ORDINANCE HAD AN EXPIRATION DATE OF MARCH 9, 1982, IT WAS THEN PLACED ON A STRAW BALLOT FOR THE MARCH 9, 1982 ELECTION AT WHICH TIME IT WAS VOTED FOR BY THE MAJORITY OF THE PUBLIC. ATTORNEY KILBRIDE REMARKED THAT THE ORDINANCE NEEDED TO BE RECREATED ESTABLISHING AN IMMEDIATE EFFECTIVE DATE AND THAT HE HAD IT PREPARED. ATTORNEY KILBRIDE READ FOR THE FIRST TIME BY TITLE ONLY AN ORDINANCE RE-ENACTING SECTION 2-17 OF THE CODE OF ORDINANCES BY PROVIDING COMPENSATION TO THE VICE MAYOR; PROVIDING AN EFFECTIVE DATE AND SEVERABILITY CLAUSE. BIRTHDAY ON JUNE 22, 1982 AND THAT HE WILL PRESENT HER WITH A PROCLAMATION FROM THE CITY PROCLAIMING JUNE 22, 1982 AS BAMA LAWSON DAY. ATTORNEY KILBRIDE REPORTED THAT THE MOTION FOR REHEARING AND NOTICE OF APPEAL HAS BEEN FILED WITH THE CLERK REGARDING THE COUNTY VERSUS THE CITY IN THE DUCK POINT ANNEXATION CASE AND THAT HE HAS DISTRIBUTED COPIES OF THIS ORDER TO EACH OF THE COUNCIL MEMBERS. A BRIEF DISCUSSION FOLLOWED REGARDING THE RECOMMENDATION OF THE PLANNING AND ZONING BOARD TO APPOINT MR. EISENBARTH TO THE PLANNING AND ZONING COMMISSION. MOTION BY COUNCILMAN VOTAPKA, SECONDED BY COUNCILMAN SCHUM, THAT MR. EISENBARTH BE APPOINTED TO THE PLANNING AND ZONING COMMISSION. CARRIED. THE CITY CLERK READ A LETTER FROM MR. LES SOLIN, CITY PLANNER, REGARDING THE DRAFTING OF THE ZONING CODE. HE INDICATED THAT HE ASSIGNED PRIORITY TO THE PLANNED UNIT DEVELOP- MENT, WATER FRONT COMMERCIAL AND MULTI-FAMILY RESIDENTIAL OFFICE DISTRICT ZONINGS AND HOPED FOR A COMPLETION DATE OF JULY 9, 1982 AND A COMPLETION DATE OF AUGUST 9, 1982 FOR THE COMPLETE ZONING iCODE. VICE MAYOR GASS REPORTED THAT THE ENTRANCE ROAD TO THE GOLF COURSE HAS BEEN COMPLETED AND APPROVAL OF THIS EXPENDITURE WAS NEEDED. MR. JOSEPH LANCASTER, FINANCE DIRECTOR, REPORTED THAT THE TOTAL EXPENDITURE FOR THE ROAD IS $17,578.49 AND THAT THIS MONEY WAS ANTICIPATED AS FAR AS THE CONSTRUCTION OF THE GOLF COURSE. ATTORNEY KILBRIDE REQUESTED THAT THE COUNCIL DEFER CONSIDERATION, REGARDING THE PROPERTY LEASE FOR TOM O'NEAL, SINCE HE NEEDS TO DISCUSS THE MATTER FURTHER WITH MR. O'NEAL AND HIS ATTORNEY. HE FELT HE WOULD BE PREPARED TO DISCUSS THIS FURTHER AT THE WORKSHOP MEET- ING JULY 7, 1982. COUNCILMAN VOTAPKA REPORTED THAT HE HAS CHECKED WITH OTHER CEMETERYS REGARDING THE NECESSITY OF FOUNDATIONS UNDER HEADSTONES AND HAS FOUND THAT THE MAJORITY OF THEM DO NOT USE THESE FOUNDATIONS. HE RECOMMENDED THAT THIS REQUIREMENT BE DELETED FROM THE RULES AND REGULATIONS OF THE CEMETERY ORDINANCE. AFTER CHECKING WITH SHERIFF TIM DOBECK AND THE INDIAN RIVER CORRECTIONAL INSTITUTION FACILITY, COUNCILMAN VOTAPKA REPORTED THAT THERE IS A TRUSTEE WORKERS PROGRAM AVAILABLE THAT COULD PROVIDE US WITH ADDITIONAL HELP AT THE SEBASTIAN CEMETERY. HE iNDICATED THAT THE TRUSTEE WORKERS ARE SUPERVISED BY EITHER THE SHERIFF'S DEPARTMENT OR THE CORRECTIONAL INSTITUTION AND HE FELT IT WOULD SAVE THE CITY .QUITEA BIT OF MONEY AND WOULD BE BENEFICIAL TO THE CITY. HE RECOMMENDED THAT WE USE THE TRUSTEE PROGRAM AND THAT IT BE LEFT UP TO GARY CHRISTENA, SEXTON, AS TO WHEN HE WILL NEED THIS ADDITIONAL HELP. MOTION BY COUNCILMAN VOTAPKA, SECONDED BY COUNCILMAN OBERBECK, THAT WE TRY THE TRUSTEE PROGRAM AND TO HAVE THE TRUSTEES OF EITHER SHERIFF TIM DOBECK'S DEPARTMENT OF THE INDIAN RIVER COUNTY CORRECTIONAL INSTITUTION TO DO WORK FOR THE SEBASTIAN CEMETERY ON A AS NEEDED BASIS.
