REGULAR COUNCIL MEETING CALLED TO ORDER AT 7:00 P.M., BY VICE MAYOR EVERETT T. GASS
PRESENT: COUNCILMAN FRANK OBERBECK, COUNCILMAN RICHARD VOTAPKA, COUNCILMAN GEORGE SCHUM,
CITY ATTORNEY DANIEL KILBRIDE, JR. AND VICE MAYOR EVERETT T. GASS
ABSENT: MAYOR PAT FLOOD, JR. ( VACATION )
COUNCILMAN OBERBECK ANNOUNCED THAT THE SEBASTIAN YACHT CLUB RAMP AND PARKING LOT WILL BE
CLOSED JULY 1, 1982 AT 8:00 P.M., IN PREPARATION OF THE FOURTH OF JULY FESTIVIEIES AND WILL
REOPEN ON JULY 5, 1982.
COUNCILMAN SCHUM REPORTED THAT HE MET WITH ROBERT DOHERTY, SUPERINTENDENT PUBLIC WORKS,
EARL MASTELLER, CITY ENGINEER, ARTHUR MAYER, BUILDING OFFICIAL AND MR. SCHUSSLER, REP-
RESENTATIVE, HEALTH DEPARTMENT, TO DISCUSS THE NEW METHOD OF WATER INLET AND PURIFICATION
OF THE SWIM LAKE AS DESIGNED BY EARL MASTELLER, IT WAS AGREED TO IMPLEMENT THE NEW SYSTEM
AFTER THE FOURTH OF JULY AND THAT WATER SAMPLES WOULD BE CONTINUED TO BE TAKEN.
VICE MAYOR GASS THANKED EVERYONE WHO PARTICIPATED IN THE CELEBRATION OF BAMA LAWSON DAY.
ATTORNEY KILBRIDE READ IN ITS ENTIRETY A RESOLUTION CALLING ON THE INDIAN RIVER COUNTY
SCHOOL BOARD TO RECOGNIZE MEMORIAL DAY AS AN ANNUAL SCHOOL HOLIDAY.
MOTION BY COUNCILMAN OBERBECK, SECONDED BY COUNCILMAN VOTAPKA, TO ADOPT A RESOLUTION CALLING
ON INDIAN RIVER COUNTY SCHOOL BOARD TO RECOGNIZE MEMORIAL DAY AS ANANNUAL SCHOOL HOLIDAY.
CARRIED.
DISTRICT, PALATKA, FLORIDA, CONCERNING THE APPROVAL OF T~E FONSUMPTIVE WATER USE PERMIT

ATTORNEY KILBRIDE REPORTED THAT HE HAS BEEN/IA~ONT~_~WITH GARY BRANDENBURG, COUNTY ATTORNEY,
REGARDING THE DUCK POINT ANNEXATION SUIT, I~0 ~St~JSS~W~ERE THE JURISDICTION LIES REGARDING
THE PROPERTY AS FAR AS LAND USE, CONSTRUCTIOA ;ERMIT~AND DEVELOPMENT DURING THIS APPEAL
PROCESS. SINCE THIS PROPERTY IS UNDER CONTRACT TO B~SOLD AND THE PURCHASER DESIRES TO DEVELOP
IT IN THE NEAR FUTURE, ATTORNEY KILBRIDE REMA~(ED FH~T THE COUNTY ATTORNEY STIPULATED THAT THE
COUNTY WOULD BE WILLING TO EXERCISE JURISDI~T~O~O'_rE_~ THE PROPERTY AND THAT IT WOULD REMAIN
IN THE UNINCORPORATED AREA OF THE COUNTY DURING THE APPEAL PROCESS. HE ALSO STATED THAT THE
COUNTY WILL ACCEPT INPUT AND CONSIDERATION FROM THE CITY OF SEBASTIAN AS FAR AS DEVELOPMENT

COUNTY ON THE DUCK POINT PROPERTY. CARRIED.
THE CITY CLERKREAD A LETTER FROM MR. & MRS. BREWER AND MR. & MRS. SLIGHT, ADDRESSED TO THE
CITY COUNCIL, COUNCILMAN SCHUM, VICE MAYOR GASS AND THE STREET CREW FOR THEIR PROMPT ACTION
IN CORRECTING THE DRAINAGE PROBLEM ON WIMBROW DRIVE.
MR. MCQUEEN, LLOYD AND ASSOCIATES, REPORTED THAT THE WORK ON MARTIN ALLEY HAD BEEN STOPPED DUE
TO SOME DISAGREEMENT REGARDING THE SOIL CEMENT MIXTURE AND ALSO WHETHER THE "V" SECTION SHOULD
BE KEPT OR THE ROAD SHOULD BE SLOPED TO THE WEST.
THERE FOLLOWED A VERY LENGTHY DISCUSSION ON WAYS TO SOLVE THE DRAINAGE PROBLEMS AND STORM WATER
RETENTION/DETENTION.
MOTION BY COUNCILMAN OBERBECK, SEOCNDED BY COUNCILMAN VOTAPKA, THAT THE PLANNING AND ZONING
COMMISSION ADVISE THE COUNCIL, PRIOR TO ANY APPROVAL OR DISAPPROVAL OF AN APPLICATION FOR ANY
DEVELOPMENT ON THE WEST SIDE OF THE ALLEY OFF OF MARTIN LANE. CARRIED.
VICE MAYOR GASS OPPOSED THE MOTION.
MOTION BY COUNCILMAN VOTAPKA, THAT WE AUTHORIZE DARRELL MCQUEEN, LLOYD AND ASSOCIATES, TO WORK
WITH THE CITY ENGINEER, EARL MASTELLER, TO FORMULATE A PROPOSED DRAFT FROM STORM WATER RUN-OFF
RETENTION, DETENTION ORDINANCE FOR THE CITY OF SEBASTIAN.
MOTION DIED, FOR LACK OF SECOND.
EARL MASTELLER, CITY ENGINEER, REMARKED THAT HE IS THE CITY ENGINEER AND FEELS HE SHOULD BE
TOLD WHAT NEEDS TO BE DONE BUT NOT HOW TO DO IT AND THAT HE SHOULD BE FREE TO CONSULT WITH
WHOM EVER HE CHOOSES.
ATTORNEY KiLBRIDE POINTED OUT THAT THE CITY HAS A PLANNING CONSULTANT WHO IS IN THE PROCESS
OF DRAFTING A ZONING ORDINANCE WHICH SHOULD ALSO VOCER DRAINAGE STANDARDS.
THE CITY CLERK REPORTED THAT THE CITY'S ADVERTISEMENT IN THE FLORIDA MUNICIPAL RECORD IS UP
FOR RENEWAL AT A COST OF $62.00 FOR A 1/8 PAGE AD FOR ONE YEAR.

MOTION BY COUNCILMAN OBERBECK, SECONDED BY COUNCILMAN SCHUM, TO RENEW THE 1/8 PAGE AD
IN THE FLORIDA MUNICIPAL RECORD FOR ONE YEAR AT $62.00. CARRIED.
EARL MASTELLER, CITY ENGINEER, REPORTED THAT HE DISTRIBUTED DOCUMENTS REGARDING THE BID
ADVERTISEMENT FOR THE NEW ROOF AT THE OLD SEBASTIAN ELEMENTARY SCHOOL. HE ASKED THAT THE
COUNCIL REVIEW THEM AND TO ADD ANY COMMENTS.
VICE MAYOR GASS STATED THAT THE COUNCIL WOULD BE POLLED ON MONDAY, JUNE 28, 1982, REGARDING
THE BID ADVERTISEMENT SO WE CAN PROCEED.
VICE MAYOR GASS REPORTED THAT HE MET WITH FLORIDA POWER AND LIGHT TO DISCUSS THE DIFFERENT
TYPE OF LIGHTING NEEDED AT THE OLD SEBASTIAN ELEMENTARY SCHOOL AND THAT THEY WILL PROVIDE
HiM WITH SOME COST FIGURES.
COUNCILMAN OBERBECK REPORTED THAT THE 911 SYSTEM EQUIPMENT WILL BE INSTALLED IN JULY, 1982,
AND THAT THE SYSTEM WILL BE PUT INTO EFFECT IN OCTOBER, 1982.
MOTION BY COUNCILMAN VOTAPKA, SECONDED BY COUNCILMAN OBERBECK, TO BRING TO THE FLOOR A DIS-
CUSSION REGARDING THE RECORDING FEE AND COMPLETION OF THE CEMETERY PLAT. CARRIED.
MR. MCQUEEN, LLOYD AND ASSOCIATES, REPORTED THAT THE $500.00 REPRESENTED THE COST OF PREPARATION
AND RECORDING THE CEMETERY PLAT.
MOTION BY COUNCILMAN VOTAPKA, SECONDED BY COUNCILMAN OBERBECK, THAT WE AUTHORIZE LLOYD AND
