PRESENT: VICE MAYOR ROBERT FITZMAURICE COUNCILMAN RICHARD SZELUGA COUNCILWOMAN DOROTHY MCKINLEY COUNCILMAN JIM GALLAGHER MAYOR PAT FLOOD, JR. CITY ATTORNEY DANIEL KILBRIDE MAYOR FLOOD EXPLAINED THAT THE PURPOSE OF THE SPECIAL EMERGENCY MEETING WAS TO ALLOW MR. GENE HARRIS, THE NEWLY APPOINTED BUILDING OFFICIAL, TO BRING SOMETHING TO THE COUNCIL. MR. HARRIS STATED THAT DURING THE COURSE OF HIS INTERVIEW ON WEDNESDAY, JUNE 22, HE MENTIONED THAT HE HAD A BUSINESS CALLED "CONSTRUCTION SERVICES." AFTER ALOT OF CONSIDERATION AND PERSONAL THOUGHT, HE WOULD LIKE TO CONTINUE TO DEVELOP THIS BUSINESS. SINCE THE TYPE OF WORK INVOLVES DRAWING PLANS FOR BUILDERS, ETC. , IT WOULD BE A CONFLICT OF INTEREST WITH THE JOB OF BUILDING OFFICIAL AND HE THOUGHT IT WOULD BE IN THE BEST INTEREST OF HIMSELF AND OTHERS TO DECLINE THE BUILDING OFFICIAL JOB, SINCE THERE IS ANOTHER QUALIFIED PERSON AVAILABLE, HE DID NOT THINK THIS WOULD CREATE A HARDSHIP. HE EXPRESSED HIS DEEPEST THANKS FOR THE VOTE OF CONFIDENCE AND WOULD LIKE TO CONTINUE SERVING THE CITY WHEREVER THERE WOULD BE NO CONFLICT OF INTEREST.~ -- C---~ ~ MOTION BY COUNCILWOMAN MCKZN~.k-T, SECONDED B~Y' ~OUNCILMAN GALLAGHER, TO ACCEPT THE RESIGNATION OF GENE HARRIS. BLAIR IS ABLE TO HANDLE THE JOB. COUNCILMAN SZELUGA AGREED WITH THE MOTION BUT STATED HE WOULD LIKE TO ADD ANOTHER STIPULATION THAT MR. BLAIR BECOME AN EMPLOYEE OF THE CITY AS SOON AS POSSIBLE OR SHOULD A DATE BE SET FOR THAT. MAYOR FLOOD STATED THAT AT THE TIME OF MR. BLAIR'S INTERVIEW HE HAD ADVISED THAT IT WOULD BE NECESSARY FOR HIM TO RETURN TO OHIO FOR TWO WEEKS TO SETTLE UP HIS AFFAIRS. MAYOR FLOOD ADDED HE WOULD LIKE FOR MR. RESOP TO BE WITH HIM FOR AT LEAST FOUR WEEKS. COUNCILMAN GALLAGHER AMENDED THE MOTION, SECONDED BY COUNCILWOMAN MCKINLEY, TO INCLUDE A FOUR WEEK PERIOD OF TIME FOR MR. RESOP TO WORK WITH MR. BLAIR AFTER WHICH TIME HE WILL BECOME THE FULL-FLEDGED BUILDING OFFICIAL. ROLL CALL VOTE: AYES: VICE MAYOR FITZMAURICE COUNCILMAN SZELUGA COUNCILWOMAN MCKINLEY COUNCILMAN GALLAGHER MAYOR FLOOD NAYS: NONE MOTION CARRIED. MINUTES SPECIAL EMERGENCY MEETING JUNE 24, 1983 MAYOR FLOOD ADVISED THAT IN 1946 THE CITY OF SEBASTIAN AGREED TO SWAP LAND WITH THE FIRST METHODIST OF SEBASTIAN - LOTS 3,4 AND 5 IN SCHOOL PARK SUBDIVISION IN EXCHANGE FOR ALL OF BLOCK A SHOWN IN PLAT BOOK 3, PAGE 12, RECORDS OF ST. LUCIE COUNTY, PROPERTY BEING PART OF LOT 6, SEC. 6, TOWNSHIP 31, SOUTH R39E AND LOT 16 A.G. ROSE SUBDIVISION. THE CHURCH HAS NOW SOLD THE PARSONAGE AND REQUESTED THE CITY TO SIGN A QUIT CLAIM DEED. ATTORNEY KILBRIDE EXPLAINED THAT THERE WAS A DEED RESTRICTION THAT THE PROPERTY COULD ONLY BE USED FOR A CHURCH OR PARSONAGE AND THERE WAS NO REVERTER CLAUSE. NORMALLY, WHEN THIS IS DONE AND YOU WANT THE LAND BACK, THE TITLE WOULD COME BACK, BUT THIS WAS NOT DONE. THE CITY WAS PAID FULL VALUE IN 1946. IN ORDER FOR THE CHURCH TO GIVE TITLE TO THE BUYER, THEY NEED A QUIT CLAIM DEED FROM THE CITY. MOTION BY VICE MAYOR FITZMAURICE, SECONDED BY COUNCILMAN GALLAGHER, THAT THE CITY COUNCIL AUTHORIZE THE MAYOR TO EXECUTE A QUIT CLAIM DEED TO SUBJECT PROPERTY. ROLL CALL VOTE: A YES: VICE MAYOR FITZMAURICE COUNCILMAN SZELUGA COUNCILWOMAN MCKINLEY COUNCILMAN GALLAGHER MAYOR FLOOD NAYS: NONE MOTION CARRIED. MEETING ADJOURNED 1:30 P.M.
