CARRIED. )RE DISCUSSING THE SELECTION OF AN ENGINEERING FIRM RE: STREET IMPROVEMENTS, MAYOR FLOOD EXPRESSED APPRECIATION TO BILL MESSERSMITH, DAVE MARSH, FLORENCE PHELAN AND LIBBY REID FOR THE LONG HOURS PUT IN INTERVIEWING THE VARIOUS ENGINEERS. THE COMMITTEE, COMPRISED OF BILL MESSERSMITH, DAVE MARSH AND MAYOR FLOOD SUBMITTED THEIR THREE CHOICES: 1. BILEY, WILD, AND ASSOCIATES, INC. OF ORMOND BEACH, 2. LLOYD & ASSOCIATES OF VERO BEACH, AND 3. POST BUCKLEY, SCHUH AND JERNIGAN, INC. OF WEST PALM BEACH, AND ORLANDO. WHAT IS NEEDED FROM THE COUNCIL TONIGHT IS PERMISSION TO GO AHEAD OR IF THE COUNCIL WOULD LIKE TO NEGOTIATE THE PRICE OF THE SERVICES FOR THE SURVEY THAT IS NEEDED. ACCORDING TO STATE LAW, WE CANNOT ASK ANY OF THEM FOR A PRICE UNTIL WE PUT THEM IN ORDER-#1, 2 and 3. IF WE TAKE #1 AND NEGOTIATE WITH THEM AND ARE NOT SATISFIED, WE CAN THEN PROCEED TO #2. IF THE SAME IS TRUE OF #2, WE CAN THEN PROCEED TO #3. IF THE PRICE OF #3 IS NOT SATISFACTORY TO THE CITY, THEN WE WILL HAVE TO START ALL OVER AGAIN. MAYOR FLOOD EXPLAINED THAT TWO MOTIONS ARE REQUIRED AT THIS TIME: 1. TO OKAY THE PRIORITY ORDER AND 2. IF YOU WOULD LIKE THE COMMITTEE TO PROCEED AND MEGOTIATE WiTH THE ENGINEERING FIRMS AND RETURN TO THE COUNCIL WITH THEIR COSTS TO DO THE SURVEY-THE FEASIBILITY SURVEY OF GOING INTO BONDING ON UNITS #1 AND PART OF #2 AND THE OLD PART OF THE CITY, OR THE COUNCIL MAY WANT TO NEGOTIATE WITH THESE ENGINEERS. AFTER CONDIDERABLE DISCUSSION, THE COUNCIL AGREED (WITHTHE EXCEPTION OF VICE MAYOR GRAY) TO MOVE THAT THE LIST BE REVISED AS FOLLOWS: 1. BRILEY, WILD AND ASSOCIATES, 2. POST BUCKLEY, SCHUH AND JERNIGAN, INC., AND 3. LLOYD AND ASSOCIATES. MOTION WAS MADE BY COUNCILMAN JOACHIM, SECONDED BY COUNCILWOMAN MC KINLEY, TO ACCEPT THE REVISED PRIORITY LISTING WITH POST BUCKLEY,SCHUH & JERNIGAN IN SECOND PLACE AND LLOYD & ASSOCIATES AND THIRD PLACE. MOTION BY VICE MAYOR GRAY, SECONDED BY COUNCILWOMAN MC KINLEY, THE CITY COUNCIL NEGOTIATE WITH THE THREE ENGINEERING FIRMS. ROLL CALL VOTE: AYES: VICE MAYOR GRAY COUNCILWOMAN MC KINLEY MAYOR FLOOD NAYS: COUNCILMAN JOACHIM CARRIED. MOTION BY VICE MAYOR GRAY, SECONDED BY COUNCILWOMAN MC KINLEY, THE COMMITTEE MEMBERS, MESSRS. MESSERSMITH AND MARSH, BE ASKED TO SIT IN ON THE NEGOTIATIONS WITH THE THREE ENGINEERING FIRMS. CARRIED. THE UNSATISFACTORY ~ONDITION OF THE WATER AT THE SWIM LAKE IN SEBASTIAN HIGHLANDS WAS DISCUSSED AND MAYOR FLOOD SUGGESTED iNSTALLATION OF A TWO HORSEPOWER PUMP IN AN EFFORT TO RID THE LAKE OF THE SILT ON THE BOTTOM. IF ONE PUMP DOES NOT DO THE WORK, A SECOND ONE WILL BE INSTALLED. MOTION BY COUNCILMAN JOACHIM, SECONDED BY COUNCILWOMAN MC KINLEY, TO PUT A PUMP AND A TIMER ON ONE OF THE WELLS AT THE SWIMMING LAKE. CARRIED. MAYOR FLOOD OUTLINED HIS REASONS FOR RECOMMENDING THE CITY PURCHASE OF THE WATERFRONT PROPERTY, LOTS 1, 2, 3, 4, AND 5, BLOCK 14, EDGEWATER PARK SUBDIVISION (BOSWORTH ESTATE). HE FELT THE CITY WOULD liKE MORE OF A PROFIT OUT OF THE PROPERTY IN THREE YEARS THAN IT WOULD TO PUT THE RTIFICATE OF DEPOSIT IN THE BANK. MOTION BY COUNCILMAN JOACHIM, SECONDED BY COUNCIL WOMAN MC KINLEY, TO ACCEPT THE RESOLUTION ABANDONING EASEMENTS BETWEEEN LOTS 1 AND 2, BLOCK 72, UNIT 2, SEBASTIAN HIGHLANDS. (NO. R-79-13). CARRIED. COUNICLMAN JOACHIM HAD BEEN COMMISSIONED BY MAYOR FLOOD SOMETIME AGO TO LOOK INTO THE CITY'S HEALTH INSURANCE PROGRAM. HE IS NOW READY TO PROCEED AND REQUESTED PERMISSION TO ISSUE BID NOTICES FOR THE S HEALTH INSURANCE PROGRAM. )TION BY VICE MAYOR GRAY, SECONDED BY COUNCILMAN MC KINLEY, TO ISSUE BID NOTICES FOR THE CITY'S HEALTH INSURANCE PROGRAM. CARRIED. AT A PREVIOUS COUNCIL MEETING THERE WAS DISCUSSION CONCERNING WHO WOULD AND WHO WOULD NOT HAVE TO PAY FOR THE USE OF THE COMMUNITY CENTER AND HOW MUCH. AT THAT TIME, VICE MAYOR GRAY AND COUNCILMAN GASS WERE APPOINTED TO LOOK INTO THE SITUATION AND COME UP WITH THEIR RECOMMENDATIONS. COUNCILWOMAN MC KINLEY ASKED TO SEE A WRITTEN REPORT FROM THE COMMITTEE AS TO WHO WILL BE CHARGED AND HOW MUCH. VICE MAYOR GRAY AND MR. GASS HAVE MET ON THIS MATTER, BUT NO DEFINITE CHANGES HAVE BEEN MADE TO DATE. AS A MATTER OF FACT, VICE MAYOR GRAY COMMENTED ON THE LACK OF INTEREST SHOWN BY THE PUBLIC AT THESE MEETINGS. MAYOR FLOOD ASKED VICE MAYOR GRAY, UPON THE RETURN OF MR. GASS FROM VACATION, TO SUBMIT A WRITTEN REPORT IF ANY CHANGES ARE TO BE MADE IN THE CITY'S PRESENT QUOTE SYSTEM OR RULES AND REGULATIONS. NO CHANGES ARE RECOMMENDED, HE WAS ASKED TO SUBMIT A NEGATIVE REPORT TO THE COUNCIL. MAYOR FLOOD ASKED THAT THE REPORT BE SUBMITTED AT THE JULY 9 COUNCIL MEETING UNDER COMMITTEE REPORTS. IF MAYOR FLOOD ASKED VICE MAYOR GRAY TO GET A BREAKDOWN OF THE ELECTRIC BILLS, MONTH BY MONTH, FOR THE COMMUNITY BUILDING, SEBASTIAN SOCIAL CENTER, LITTLE LEAGUE BALL FIELD AND THE TENNIS COURTS. HE ALSO REQUESTED THE AMOUNT SPENT BY YEAR FOR THE CITY STREET LIGHTS. MAYOR FLOOD ACKNOWLEDGED THE TWO BOYSCOUTS PRESENT AND WELCOMED THEM TO THE MEETING. THE NEXT WORKSHOP MEETING WILL BE SCHEDULED FOR THURSDAY, JULY 5, 1979, AT 7 P.M. IN LIEU OF WEDNESDAY , JULY 4th. CHARLES GAAL, JR., OF 325 VALENCIA STREET, WHO HAS BEEN CITED BY THE CITY FOR VIOLATION OF CITY REGARDING STORING OF JUNK ON HIS PROPERTY, ASKED FOR AN EXTENSION OF 30 DAYS TO COMPLETE THE CLEANUP JOB. MOTION BY COUNCILMAN MC KINLEY, SECONDED BY COUNCILMAN JOACHIM, TO GIVE MR. GAAL AN EXTENSION OF 30 DAYS TO CLEAN UP HIS PROPERTY. CARRIED. ~ MR. GAAL COMPLAINED THAT NEIGHBORS IN THE ORANGE HEIGHTS SUBDIVISION ARE TRESPASSING ON HIS PROPERTY, PEERING OVER THE FENCE TO SEE IF THE DEBRIS IS BEING MOVED, AND IT IS A CONSTANT HARRASSMENT TO HIM. MAYOR FLOOD STATED MR. GAAL DOES HAVE A RIGHT TO KEEP PEOPLE OFF HIS PROPERTY, THAT HE HAS THE RIGHT OF PRIVACY, AND IF AN INDIVIDUAL WILL NOT LEAVE HIS PROPERTY, IT IS MR. GAAL'S PREROGATIVE TO CALL THE POLICE DEPARTMENT AND PRESS CHARGES. AT THE END OF THE 30 DAY EXTENSION, MAYOR FLOOD AND THE BUILDING OFFICIAL WILL VISIT THE PROPERTY TO INSPECT IT. MAYOR FLOOD SUGGESTEDBRINGiNGA MEMBER OF THE ORANGE HEIGHTS PROPERTY OWNERS ASSOCIATION WITH HIM ON THIS rNSPECTION TRIP, BUT MR. GAAL REQUESTED THAT THE MAYOR BRING NO ONE WITH HIM EXCEPT THE BUILDING OFFICIAL. MR. FLOOD AGREED TO RESPECT MR. GAAL'S WISHES. MEETING WAS ADJOURNED AT 9 P.M. CITY CLERK M~YOR
