board and to review Tax Roll for the year 1950.
Meeting was calied to order by President Anderson.
Those answering roll call were Mayo~: Mlddleton,President Anderson and 0ouncilmen
Sembler,Let chworth,Ellingsen and Park., Attorney. Vocelle present.
Minutes of the last meeting were approved as read.
Bills to the amount of $1073..76 approved by the finance committee were ordered
paid on motion by Councilman Sembler and seconded by Councilman Ellingsen.
The following resolution was introduced by Councilman Sembler, who moved its adoption:
Whereas,The City Council of the City of Sebastian, Florida did on the End. day of May
1950,adopt ordinance No. 132 providing fornthe issuance cT $ 188.000.00 in refunding bonds
of the said City,to be dated ~anuary 1,1950; and
Whereas,it is provided 'by Section 10 of said ordinance that said refunding Bonds shall
after validation and execution,be deposited with a ~ank or trust compan[ to be designated by
the City Council for the purpose of exchange for a prior issue of 1939 Hefunding Bonds, and
Whereas, Guaranty Trust Company of New York, has been acting on behalf of the City of
Sebastian as its exchange agent under the terms of s&ld Ordinance;
Now therefor be it resolved by the City Council of the City of Sebastian,Florida that
Guaranty Trust Company of New York~ a banking corporation of the State of New York,0e and i~
l~hereby designates 0y ~e ~ ~ouncil of the City of Sebastian,~'lorlda as exchange agent
f~said Oity on exchange of its 1950 issue of refunding bonds,for its 1~39 issue of refunding
b~s and all matters incident to and connected therewith.
Be it further resolved that all acts and transactions done by said Guaranty Trust company
of New York,in ,connection with the exchange of Refunding Bonds of said City,prior to the adop-
tion of this resolution,be,and the same are herebY,ratified and confirme~ in all respects
whatsoever.
The forgoing resolution was duly seconded by Councilman Ellingsen and upon being put
to a vote was unanimously adopted.
Councilman Sembler introduced an ordinance entitled,tN ORDINANCE PROVIDING FOR THE
LEVY OF T.~x~,S IN THE CiTY O~~ o..~ao.i'i~ FLORIDA?FOR THE YEAR 1950--
~E IT 0RD~iiNED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF SEBASTIAN,FLORIDA:?
Section 1~ That the City of Sebastian,Florida levy a ~ax of ~-8 mil~ upon, ea0h dollar
valuation of real and personal property within the City limits of said City subject to
taxation on the 1st day January,l~50,which tax shall be assessed and collected in the manner
provided by law.
Sectioh 3. Tha~t the total of ~.8 mills herewith levied,18 mills shall be segrated in a
seperate fund'~s the sanle, iS 5ollected and shall be used for the purpose of providing 'funds
for the Gemerai fund.of .said01ty; that 12 mill's of the B8 mills herewitholeved shall be
segrated in a seperate and speclls fund as collected and shall be used solely for the purpose
of paying lntrest' and providing a sinking fund for Bonds of the said"City e~titled "City of
Sebastian Refunding Bonds,Issue of January 1,1~50." Said tax levy of 12 mills for the intrest
and sinking fund purposes shall be levied and colledted upon all taxable property within said
January l, 1950, including homestead property.
Section 3. It shall be the duty of the of the City Tax Collector and the the Oity
~reasurer to devlde the proceeds of said taxes into seperate funds as above set forth and to
keep such accounts as shall be from time.to time directed by the City Council.
Section 4. This ordinance shall be in full force and effect immediately upon its
passage and approval or upon its becoming a law without such approval.
Upon motion made by Oouncilman Sembler and seconded by ~ouncilman Ellingsen and unan-
imously carried,said Ordinance was read the first time in full

Apon motion made by Councilman Sembler seconded by Councilman mllingsen said Ordinance was read

NAYS: None.
Thereupon said Ordinance heving received an affirmative vote o~ three-fifths of all
nembers of the Council was declared duly adopted and upon being presented to the Mayor and
~aving received his approval was numbered A~3. chapter 1~.3 of the Ordinances of said City and was
~hereupon duly posted at the door of the City Hall of the City of Sebastian in accordance with
;he provisions of section 85 of chapter 18683 of the laws of ~'10rida,being the charter of said
~ity.
~ullding permit was granted to John S.Nash on motion by Councilman Park which was
seconded by Councilman Ellingsen.Carried
Councilman ~lii~ig~n'~.m~ed.~tha$'~th~e City Council set aside $500.00 for advertising
which was seconded by Councilman Sembler and carried.
The City Oouncil set up a budget of $ 16,998.00 for the year of 1950 and was passed
on motion by Councilman Sembler which was seconded by Councilman Letchworth and carried.
Councilman Ellingsen introduced an Ordinance entitled, An Ordinance providing for the
issuance of permits for the construction of private driveways in the Olty of Sebastian,Florida
under certain conditions and restrictions,and providing f~r the removal of existing street
cutbing and replacemeht thereof, and moved its adoption.
~e it ordained by the Mayor and City Council of the City of Sebastian, Florida:
Sectloh 1. That all property owners in .the City of Sebastian,Florida,desiring to constr
and maintain private driveways' to permit access between private property and public streets or
alleys of said City,may apply in 'writing for the issuance of a permit for said construction in
accordance with conditions and restrictions as set forth herein. No private driveway shall be
hereafter constructed in the City of Sebastian,Florida unless a permit in accordance with this
Ordinance has been duly issued by. the City.
Section 2. Permits for construction of private driveways shall be issued under the foil
terms, conditiohs and restrictions:.
A. All driveways should have a width of tWelve feet,provided,however,that where
the owner so dislres,drtveways l0 feet wide shall be permitted.
~. All driveways must be constructed of concrete,asphalt,or similarly flni
material from the outer edge of the street curb' for a distance of thirty inc~s (**~"
G. The drivewa]~ must begin one inch (1") above the normal level of the street
gutter at'inner .edge so as to provide a minimum recess of one 1rich (1") between the outer edge
of the driveway and She inner edge of the street gutter for drainage~ purpose~.
D. The driveway must ha~e a rise in elevation of three (3"$ inches through the
thirty 1rich (30") section as referred to in subsection (B).
E. The street curb shall be rebuilt and rounded off in the arc so as to Join th
driveway at a point thirty inches ($0") from the outer edge of the curb. The normal curb height
of five inches (5") shall be nmintained when such curb is rebuilt so that the curb at a point
thirty inches (3~) from the gutter will be I inch (l") greater in height than the constructed
driveway. The curb shall be rounded aS prOvided herein using a distance of two and one-half
feet (~. ~') as a radius for the arc.
F. The balance of the driveway continuing away from the street across the publl
sidewalk may be constructed with hard inproved surface and finished with the material known as
marl or similar materials of the~same quality. The continuation of the driveway ~hall have a
rise in elavatlon of one-quarter of an inch to every foot in length.The driveway throughout its
remaining construction shall also have a minimum width ofneight feet (8')
G. All driveways shall have a minimum thic~mess of four (4") for residential
use and five inches (5") for commercial and trucking use.
Section ~. The City Clerk of the ~lty.of Sebastian is authorized and empowered ti
permits for the construction of driveways in the City upon application therefor,upon the
conditions and restrictions of this Ordinance.
Section 4. In the event that a driveway shall be constructed in the City of Sebastian 1~.
violation of this"ordlnance or any permit issued ~hereunde~,and the party so wXola~ng this
section refuses to repair said driveway so as to conform with this ordinance; The City of
Sebastian reserves the right to perform or have performed for it,the necessary alterations. In
the event it is necessary for the City to expend the time,labor.materials or money for such
alterations,the party for whose ben%fit the alterations is m~de,and the party or parties who ~.:.
obtained the original permit,shall by the acceptance of such permit agree and covenant that
they will repay the City the value of such service furnished by the City.
Ail permits issued by the City Clerk hereunder shall be issued with the forgoing conditions
as a part thereof.
Section 5. Any person vi61ating an~ :provision of this ordinsmce shall upon conviction
thereof be punished by fine not exceeding $ 500.00 or by imprisonment for a period of not more
than sixty days or by both such fine and imprisonment in the discretion of the court trNlng
the offender.
