MOTION BY COUNCILMAN HIERS THAT JUNE BILLS OF $1,867.06 BE PAID. SECONDED BY COUNCILMAN YATES. CARRIED. FIFTEEN MINUTES FOR PUBLIC. COMMITTEE REPORTS WERE GIVEN. MOTION BY COUNCILMAN HIERS THAT RECOMMENDATION OF ZONING COMMISSION TO AMEND ORDINANCE #202, BE ACCEPTED. SECONDED BY COUNCILMAN THOMAS. CARRIED. SPECIAL MEETING TO BE HELD WEDNESDAY, JULY 10, 1968, FOR ACTION ON BURT SNELL'S REQUEST FOR DREDGING PERMIT. MOTION BY COUNCILMAN YATES THAT ACTION ON BIDS FOR WORK ON LOUISIANA AVENUE BE TABLED UNTIL JULY 15, 1968. SECONDED BY COUNCILMAN HIERS. CARRIED. MOTION BY COUNCILMAN HIERS THAT TOMMY HOUSCH BE APPOINTED A RESERVE AUXILIARY POLICEMAN, VICE ROBERT BUCKLEY. SECONDED BY COUNCILMAN YATES. CARRIED. MOTION BY COUNCILMAN YATES THAT ~300.00 BE TRANSFERRED FROM POLICE SALARIES TO POLICE UNIFORM FUND. SECONDED 8Y COUNCILMAN HiERS. CARRIED. THOSE PRESENT: MAYOR ZIMMER, COUNCILMEN YATES, HIERS, THOMAS AND JOHNSON. MOTION BY COUNCILMAN THOMAS THAT APPLICATION OF BURT SNELL, FOR DREDGING IN THE INDIAN RIVER BE APPROVED SUBJECT TO THE FOLLOWING TERMS AND CONDITIONS: 1. THE PROPOSED CHANNEL SHALL NOT HAVE MORE THAN AN AVERAGE WIDTH OF 50 FEET. 2. ALL FILL SHALL BE DEPOSITED ON THE ROACH PROPERTY, OR LOT 18, BLOCK l, LOCATED NORTHWEST OF THE INLET MARINA, OR THE JOHN PALMER PROPERTY. IF FILL SHALL BE DEPOSITED ON THE 30HN PALMER PROPERTY, THE PROPERTY MUST BE BULKHEADED. A WRITTEN CONSENT SHALL BE OBTAINED FROM THE OWNER OF THE PROPERTY ON WHICH FILL SHALL BE DEPOSITED WHICH SHALL ALSO CONTAIN THE OWNER'S AGREEMENT TO HOLD THE CITY OF SEBASTIAN HARMLESS FROM ANY CLAIMS WHATSOEVER IN CONNECTION WITH THE DREDGE AND FILL OPERATION. 3. PROPER DIKING SHALL BE MAINTAINED TO KEEP SILTING TO A MINIMUM; NO FILL SHALL BE DEPOSITED OUTSIDE THE EXISTING BULKHEAD. 4. ALL BULKHEADING SHALL BE A PERMANENT STEEL OR CONCRETE CONSTRUCTION. 5. A SAVE-HARMLESS CLAUSE SHALL BE MADE A PART OF ANY BUILDER-OWNER CONTRACT, IN FAVOR OF THE CITY OF SEBASTIAN, AND ADEQUATE LIABILITY INSURANCE SHALL BE MAINTAINED. 6. PRIOR WRIITEN APPROVAL BY THE CITY ENGINEER OF THE CITY OF SEBASTIAN. 7. PRIOR WRITTEN APPROVAL OF THE LAND OWNER, AND THE LAND OWNER'S WRITTEN AGREEMENT TO HOLD THE CITY OF SEBASTIAN HARMLESS FROM ANY CLAIMS WHATSOEVER. 8. PRIOR WRITTEN APPROVAL BY THE TRUSTEES OF THE INTERNAL IMPROVEMENT FUND. 9. PRIOR WRITTEN APPROVAL BY THE CORPS OF ENGINEERS OF THE UNITED STATES. 10. THIS PERMIT MAY BE REVOKED AT ANY TIME FOR NON-COMPLIANCE. WITH THE AFORESAID OR SUBSEQUENT~RMS AND CONDITIONS OF THE CITY ENGINEER, THE TRUSTEES OF THE INTERNAL iMPROVEMENT FUND OR THE U.S. CORPS OF ENGINEERS. 11. THE "THOMAS COMMITTEE" OR A PERMANENT STANDING COMMITTEE OF THE CITY OF SEBASTIAN SHALL REMAIN INTACT TO SEE THAT THE ABOVE CONDITIONS ARE COMPLIED WITH AND TO MAKE PERIODIC REPORTS TO THE CITY COUNCIL OF THE CITY OF SEBASTIAN DURING THE TIME THE WORK IS IN PROCESS.
