HomeMy WebLinkAbout07111960Regular Meeting July 11, 1960 Meeting was called to order by President Sembler. Those present were Mayor Rohme, Pres. Sembler, Co~mcilmen 2innegan, Nash, Baxter, Brehmer. Attorney Sullivan was also present. Mr. Buehler met with the Equalization Board for the purpose of obtaining information a~'~ to the method of.assessing homestead property and the rate of millage. The 1960 Tax Roll was presented to the City Council for their approval bY the City Clerk. ~ouncilman F' ~ mnneoan made a motion that the 1960 t~x roll be accepted with a continuation of the present millage of 16 mills operating and 12 mills debt service. This motion was seconded by Co~mcilman Nash. Carried. A tentative budget was submitted by the City Clerk to the Council for their approval. This budget consists of the following departments: 1. Salaries $18,500.00 2. Street Dept. 5,962.00 3. Fire Dept, .800.00 4. Attorney Fees 1,O00.00 5. City Auditor ,750.00 6. City Lights 3,000.00 7. Miscellaneous 2,500.00 8, Engineer ~ees 600.00 9. insurance Policies 2~300.00 Total BudgetS35,412.00 Co~mcilman Fi~egan made a motion to approve and adopt this budget, seconded by Councilman Brehmer. Uouncilman Baxter opposed. Motion was carried. Minute~ of regu~lar meetings of June 13 and June 27, 1960 were ~pproved as read. Nays: None Thereupon said ordinance having, received three-fifths majority vote of all members of the ~ouncil, was declared duly adopted and upon being presented to the Mayor and havir~.~ received his approval was n.umbered as Chapter #. 18'4 of the said City and was theredpon duly posted at the door of the City Hall of the City of Sebastian in accordance with provisions of Section 85 of Chapter lggS] of th~ laws of Florida being Charter of said City. Councilman Baxter introduced an Ordinance entitled: AN 0RDI~ANCE CREATING 0PPICE OF T~tE ~IILDING INSPECTOR OF T!~ CI?Y OF ~B.ASTIAN SETTING PORTH THE PERFOR~NC OF HIS ~TIES, HIS QUALIFICATIONS AND ~THORiTY. Councilman Finnegan moved this Ordinance be read first time in full, second by Councilman Brehmer. Roll was called and the voting was as follows: Ayes: President~ Sembler, Councilmen Finnegan, Ns~sh, Baxter and Brehmer. Nays: None Councilman Brehmer made a motion to read ordinance second time by title only, second by Councilman Nash. R°ll was called and the voting was as follows: Ayes: President Sembler, Councilmen Finnegan, Nash, Baxter and Brehmer. Nays: None Councilman Finnegan made a motion to read ordinance third time by title only, and placed, upon.lits, final.passage. Second ~y. Councilman Nash. Roll was called and the voting was as follows: Ayes: President Sembler, Covmcilmen Finnegan, Nas%~ Bre~er and Baxt~ Nays: None Thereupon said Ordinance havi~ng received the affirmative vote of three-fifths all members of the Covmcil, w"s declared duly adopted and upon being presented to the Mayor and having received his approval was numbered as Chapter #185 of the Ordinance of said City and was thereupon duly posted at the door of the City Hall of the City of Sebastian in accordance with provisions of Section 85 of Chapter 1668~ of the laws of Florida, being Charter of said City. An ordinance was introduced entitled: AN ORDIN~NCE CREATING THE POSITION MUNICIPAL JUDGE ~ITHIN THE CITY LIMITS OF T~ CITY 0F SEBESTIAN, FLORIDA, DESCRIBING HIS P0~,~RS AND DUTIES. Councilman Baxter made a motion ordinance be read first time in ~ll, second by Councilman Brehmer. After a!lengthy discussion this ordinance was tabled for the following provisions to ~ included. 1. Salary for Judge to be incorporated in Ordinance. 2. Judge will~be required to be licensed attorney from Indian River Counl Bills amounting- to ~1,228.73 were approved by the finance committee and aut~orized to be pai~ on motion by Councilman Nash, second by Councilman Baxter . Carried. City Clerk was instr~cted to get a r~port from the Building Inspector on his inspection of the Ruffner house, located North of 2nd street between u.S. #1 and ~.E.C. Railway. Councilma~ Baxter reported that he and City Clerk met with representatives of State Road Dept. in reference to a ~'~.r~in~ge problem lock, ted immediately north of the Church of God on U. S. #1 highway. Clerk was instructed to notify City attorney to acquire a ruling from the Attorney General as to the State Road Dept. legal rights in reference to the draining- of roads onto private property, when such drainage is causing erosion of properties involved. President Sembler appointed himself and Councilman Baxter as ~. committee of two meet with County Commissioners in reference to ac$~iring easements for drainage tQ relieve the above memtioned situation. Clerk read a bid from the Couch Manufacturing Co. in ~e amount of $468.00 for a Deming Pump and 2~0 vol~ motor with 3 phase starter, flexible coupling mounting base. and Clerk was instructed by the Council to advertise for other bids for this pump and motor and at that time a decision could be reached as to the bid from Couch Mfg. Co. Clerk read a request from Earl Roberts, asking the City's aid in opening a drainage ditch along the north property line of t~e Strom property, located where Earl's Bar is situated. Regular meeting July 11, 1960 continued Councilman Baxter was requested to have the street Department open~he city owned drainage ditch along Indian River Drive and also clean out culvert running underneath Indian River Drive to ~sist in the drainage of the Strom property. Councilman Nash made. a motion not to allow any~dvance in s~laries unless request is submitted to the council at a meeting by the department head of the department making the request. Second b~,~ Councilman Brehmer and carried. Councilman Nash registered a complaint of the use of city equipment after working hours. Clerk presented to the Council forms from Continental Casualty Co. in reference to the percentage of streets completed in different units of Sebastian Highlands. Council requested the clerk to for~ard these forms to Arthur Day Engineering Co. in Miami to complete the information.desired, also to request Day Engineering Co. to furnish City of Sebastian a letter certifying the correctness of the information given to the bonding agency. Councilman Baxter st~ted that he could no longer use the City Dump for ~he disposal of garbage. At ~resident Sembler's request Councilman Baxter agreed to check the possibility of using the County Dump.at Roseland. Mayor Rohme requested the Councils sup~ort in closing weekly dances sponsored by the Americ~ Legion Post #189 in the City of Sebastis,n. Clerk was instructed to notify the ~erican Legion Post to have represent~'~tives at the next regular meeting of the council to discuss this matter before making any decision. Mayor Rohme requested that trucks unloading at business places on Main Street were creating a traffic hazard and that he would issue a Police Order that it will be ~n~la~ful for any trucks to park on Main St. in the business district for ~e purpose of unloading ~oods to business Places. Mayor Rohme requested the council to purchase a new police vehicle and to use the present car for patroling at night only. The Council postponed any action on this matter. The possibiliiy of a Police Officers Retirement Fund was discussed and the City Council instructed the clerk to have a representative of the Florida Municipal Pension Sera'ce meet with the Council at the next regular meeting to discuss this matter~further. Mayor Rohme requested the co~ucil to employ a full time secretary to the clerk and also asked for an increase in the secretary's salary. Councilman Daxter made a motion to increase ~,~s. Hickey's salary to thirty dollars per week to become effective July l, 1960. Second by Councilman Nash and carried. Councilman Baxter made a motion to adjourn, second by Councilman Nash. Carried.
