Mayor Conyers called the meeting to order at 7:02
p.m.

A. Approval o__f Minutes - June 27, 1990 Regular
Meeting
Councilman Rondeau noted an error in the tally of the
roll call for the motion on page eight which should
read 4-1 instead of 5-0.
MOTION by Oberbeck/Rondeau
I move we approve the June 27, 1990 Regular
meeting minutes with correction as noted.
VOICE VOTE on the motion carried 5-0.

Emergency Management Committee - FPL Request to
use Community Center in event of a hurricane.
(City Manager Recommendation dated 7/3/90; FPL
request dated 5/22/90)
Following a brief explanation of the request by the
City Manager, Councilman McCollum questioned the
city's liability.

MOTION by McCollum/Oberbeck
I move we approve the request of FPL for use of
the Sebastian Community Center in the event of a
hurricane with FPL signinG a waiver regardinG
the city's liability and that they are responsible
for cleanup.
VOICE VOTE on the motion carried 5-0.
OLD BUSINESS

Report and Recommendation on DER Fine Re:
Asbestos Removal (City Manager Recommendation
dated 7/5/90; Cooper letter to Environmental
Resources Associates dated 5/4/90; DER Worksheet)
The Director of Community Development reported on the
status of the city's DER fine and said a formal
settlement agreement will be brought to City Council
for review and approval.
MOTION by Oberbeck/Powell
I move we accept the recommendation from staff
and the city's total liability in this matter not to
exceed 8197.
The Director of Community Development said, for the
record, the amount of the fine will be $4,200 but
that $4,003 will be deducted from money due the
contractor.

The Director of Community Development explained
current procedures and fees for contractors
Grandfathered under Ordinance No. 0-90-04 which, he
explained, are less stringent than reported at the
last City Council meetinG.

Report on Golf Course Restaurant Bids
(City Manager Recommendation dated 7/3/90)
The Assistant City Manager reported that no bids were
received and explained options that Council may
consider as stated in her recommendation dated July
3, 1990 (see attached).
It was the consensus of Council that if option #3 is
approved staff would generate a time frame to resolve
the matter before the winter season begins.
MOTION by Rondeau/Powell
I move we accept staff recommendation #3 and go
out and see what we can come up with.
VOICE VOTE on the motion carried 5-0.
13. NEW BUSINESS

14. MAYOR'S MATTERS

Mayor Conyers discussed the recent murder of a
convenience store clerk and questioned what further
measures can be taken to prevent such incidents.
The City Attorney said Senate Bill 612 regarding
requirements for convenience stores open after
certain hours had been passed, would go into effect
on September 1, 1990 and would pre-empt local laws,
therefore, any amendments to the city's current
ordinance would have to be adopted prior to that
time. He said he could copy the new law to City
Council.
COUNCIL MATTERS
A. Vice Mayor Oberbeck
Vice Mayor Oberbeck reported on the Indian River
County Transportation Planning Committee meeting.
B. Councilman McCollum
Councilman McCollum reported that the Economic
Development Council meeting had been cancelled for
this month.

C. Councilman Powell
Councilman Powell reported on the Indian River County
Ad HOC Fire Committee meet±ng and requested Council's
recommendation on the upcoming vote for a County-wide
fire district.
Following a brief discussion it was the consensus of
Council to vote in the affirmative.
D. Councilman Rondeau
Councilman Rondeau questioned the status of the
drainage problem in the Easy Street area, in
particular 291 Easy Street. The City Manager said
staff is addressing the matter.
Councilman Rondeau requested an agenda item for the
August 1, 1990 workshop to consider the requirement
of a unanimous vote of Council to amend the city's
Standard Operating Procedures.
CITY ATTORNEY MATTERS
The City Attorney read a letter from him to Council
letter dated June 29, 1990 regarding the Police
Officer's Bill of Rights.
17. CITY MANAGER MATTERS
Recommendation to Reschedule Budget Hearings
(City Manager Recommendation dated 7/3/90; Carol
Carswell memo dated 6/2/90)
The City Manager noted that there is a conflict with
indian River County School Board public hearings and
requested the dates for the city's public hearings be
rescheduled to September 10 and 17, 1990.
MOTION by Oberbeck/McCollum
I move we set the public hearings for budget and
millage rate for Monday, September 10, 1990 and
on Monday, September 17, 1990 at 7:00 p.m.
VOICE VOTE on the motion carried 5-0.
B. Other Matters
The City Manager announced the receipt of the signed
mortgage deed from Carl Julian which when finalized

by the City Attorney's office will allow the city to
issue a notice to proceed on the realignment of Main
Street.
The City Manager discussed the possibility of
engaging an engineer to develop plans and
specifications for paving and possibly expanding the
Golf Course parking lot and adjacent area. He said
staff, with Council's concurrence, would present a
recommendation to City Council to engage an engineer
to do necessary permitting requirements and design
for a parking lot and sewer installation.

Being no further business, Mayor Conyers ad3ourned
the meeting at 8:25 p.m.

SUMMARY STATEMENT
At its May 23rd meeting, the City Council approved the Request
for Proposals for a Golf Course Restaurant and directed staff to
issue it. A legal notice was published in the Veto Beach Press
Journal, the Sebastian Sun, the Orlando Sentinel, and the Miami
Herald (state-wide edition). Additionally, copies of the RFP
were sent to individuals who had expressed an interest in leasing
the restaurant as well as to holders of City restaurant
occupational licenses.
The deadline to submit a proposal was Friday,
p.m. However, we received no proposals.
