CITY COUNCIL CHAMBERS 1225 MAIN STREET, SEBASTIAN, FLORIDA Mayor Barnes called the workshop to order at 7:00 p.m. The Pledge of Allegiance was recited. ROkL CALL Ciw C0~mcil Present: Mayor Walter Barnes Vice Mayor Richard Taracka Mrs. Louise Cartwright Mr. Larry Paul Mrs. Ruth Sullivan Staff Present; City Manager, Thomas Frame City Attorney, Valerie Settles Deputy City Clerk, Sally Maio Secretary, Ann Brack It was the consensus of City Council to allow public input. City Council Workshop 16, 1997 Two 4. WORKSHOP ITEMS 97.054 A. Proposed Telecommunications Ordinance The City Manager distributed a revised 7/16/97 draft of the proposed telecommunications ordinance; said he had received a copy of the proposed Indian River County telecommunications ordinance today and stated he would be meeting with representatives of Indian River County and municipalities within Indian River County on August 4, 1997 to try to develop cohesive language among all the agencies; and proceeded to give a brief general overview of the proposed ordinance he had distributed. When the review was completed he said his goal was to get the telecommunications ordinance in place prior to approval of a franchise agreement but to proceed cautiously, to have the City Engineer look at the City's right-of-way ordinance for updating, to continue working with Indian River County and to begin negotiating with Falcon Cable. He suggested that he may ask for assistance with the franchise negotiation and had contacted Florida League of Cities and local consultants to get ideas of levels of service and costs. He recommended that unless the City Council had a strong desire otherwise, this ordinance not be delved into too deeply since it is subject to change based on his forthcoming meetings with Indian River County. Brief discussions followed on the current City franchise for Southern Bell which is no longer in existence, the current $2.50 cap for utility tax, establishing franchise fees by resolution, and bonding. J.W. Thompson, 125 Main Street, Sebastian, was informed that any franchise would be non- exclusive. 97.183 B. Proposed Ouil~j.-Judicial procedures Resolution The City Attorney reviewed the amended quasi-judicial procedures resolution; recommended a system used in Riviera Beach whereby the City provides notice of anything quasi-judicial and parties are required to sign up prior to the hearing to qualify as affected persons; discussed the possibility of hiring a hearing officer to review quasi-judicial matters and recommend to the City Council for an average cost of $75 to $100; said she would have the Orange County ordinance copied to City Council. TAPE I - SIDE II (7:48 P.M.) Discussion took place on allowing homeowners' associations to be considered affected parties; and requiring proof of incorporation and a resolution of the board as a recommendation on the matter. 2 City Council Workshop 16, 1997 Three It was the consensus of City Council to require that all parties sign up prior to the meeting; that the City Attorney explain procedures to the public prior to the start of the hearing; to direct the City Attorney to review the Orange County ordinance relative to using hearing officers; to require homeowners associations to provide documentation and pass a resolution reflecting the recommendation of the board; to remove paragraph (c) in Section l; add "or parties" to paragraph (b) in Section l; to switch paragraphs 2 and 3 in Section 3 and add inquiry of applicant after applicant presentation and inquiry of staff after staff presentation; to change the time limit in paragraphs 5 and 7 in Section 3 to fifteen minutes since opponents and proponents are both affected parties; to add "affected parties" to paragraph 8 in Section 3; to delete paragraph l0 in Section 3, and add a provision for closing the hearing in paragraph 15 in Section 3. 5.
