THE CITY CLERK READ THE NOTICE OF BID AS IT APPEARED IN THE VERO BEACH PRESS JOURNAL, ON JULY~i AND 4, 1982, REQUESTING A NEW BUILT UP ROOF OVER THE EXISTING ROOF, INCLUDING ALL NECESSARY CAULKING, FLASHING AND ACCESSORIES AT THE OLD SEBASTIAN ELEMENTARY SCHOOL, SEBASTIAN, FLORIDA. JOSEPH L~NCASTER, FINANCE DIRECTOR, REPORTED THAT HE HAS PREPARED A SUIV~ARy OF THE 1982- 1983 PROPOSED BUDGET AND THAT IT IS TENTATIVELY SET AT $1,174,000.00 NITH THE TAX RATE BEING REDUCED ABOUT 15-15~% AS COMPARED TO LAST YEAR AND A FEDERAL REVENUE SHARING BUDGET IN THE AMOUNT OF $72,000.00. HE ALSO RECOMMENDED THAT THE COUNCIL PROPOSE A MINIi~M TAX MILLAGE RATE OF ABOUT 5]~ MILLS. MOTION BY COUNCILMAN VOTAPKA, SECONDED BY COUNCILMAN SCHUM, TO BRING TO THE FLOOR A DISCUSSION REGARDING THE TENTATIVE MILLAGE RATE AND ESTABLISH A RATE FOR THE FIRST PUBLIC HEARING. CARRIED. MAYOR FLOOD SUGGESTED THAT THE PUBLIC HEARING BE SET FOR AUGUST 11, 1982,'AT 7:00 P.M., IN THE SEBASTIAN COMMUNITY CENTER, WITH AN ALTERNATE DATE OF AUGUST 17, 1982. MOTION BY COUNCILMAN VOTPAKA, SECONDED BY COUNCILMAN SCHUM, TO AUTHORIZE JOE LANCASTER TO SET THE TENTATIVE MILAGE RATE AT 5~% AND TO SET THE DATE OF AUGUST 11, 1982 FOR THE PUBLIC HEARING, TO BE HELD AT THE SEBASTIAN COMMUNITY CENTER, AT 7:00 P.M., AND AN ALTERNATE DATE OF AUGUST 17, 1982. CARRIED. MR. EARL MASTELLER, CITY ENGINEER, REPORTED THAT THE NEW WATER SYSTEM AT THE SWIM LAKE HAS BEEN INSTALLED AND EXTENDED THANKS TO THOSE WHO HELPED IN IMPLEMENTING THE SYSTEM. HE STATED THAT THE APPROXIMATE EXPENDITURE FOR THE PROJECT WAS $300.00 AND HOPED THAT THE QUALITY OF THE WATER WOULD BE IMPROVED SO THAT THE SWIM AREA WOULD BE OPENED ON A MORE FREQUENT BASIS. REGULAR COUNCIL MEETING - JULY 21, 1982 MR. EARL MASTELLER, CITY ENGINEER, REPORTED THAT HE HAD BEEN NOTIFIED BY GENERAL DEVELOPMENT UTILITIES THAT THEY WILL BEGIN TO RE-TELEVISE THE SEWERS AND PORTIONS OF UNIT 17, BEGINNING MONDAY, JULY 26, 1982. HE INDICATED THAT HE WOULD BE AT THE LOCATION AS MUCH AS POSSIBLE AND THAT HE CONTACTED LLOYD AND ASSOCIATES RECOMMENDING THAT THEY SEND A REPRESENTATIVE TO THE AREA ALSO. MR. EARL MASTELLER STATED THAT HE HAS PREPARED AN ORDINANCE ON STREET OPENING PERMITS AND REQUIREMENTS FOR THE COUNCILS REVIEW AND DISCUSSION AND THAT HE iS ALSO ASSEMBLING DATA WITH REGARDS TO THE STORMWATER DRAINAGE ORDINANCE. MR. MASTELLER MENTION THAT HE WOULD LIKE TO WORK WITH ATTORNEY KILBRIDE ON AN ORDINANCE CONCERNING ENGINEERING INSPECTION FEES SINCE HE IS PHASING INTO INSPECTIONS MORE AND HAS SOME RECOMMENDATIONS. MR. EARL MASTELLER, REPORTED THAT THE STORM WATER DRAINAGE LETTER WILL BE HAND DELIVERED THROUGHOUT THE CITY ON SATURDAY, JULY 24, 1982 AND THAT A COPY WILL APPEAR IN THE SEBASTIAN SUN NEWSPAPER AND THE VERO BEACH PRESS JOURNAL. MAYOR FLOOD STATED THAT THE GOLF COURSE HAS RECEIVED THE CONSUMPTIVE WATER USE PERMIT AND THAT HE WOULD MAKE COPIES AVAILABLE TO THE CITY ATTORNEY AND MEMBERS OF THE COUNCIL. MR. JAMES CUMMINS, POLICE CHIEF, REPORTED THAT HE AND MAYOR FLOOD CHECKED iNTO THE POLICE PACKAGE VEHICLES OFFERED BY T.A.L. COMPANY AND FOUND THEM TO BE VERY SOUND AND IN GOOD RUNNING CONDITION. HE INDICATED THAT THEY CHOSE THREE POLICE VEHICLES AT $3,451.66 PER CAR FOR A GRAND TOTAL OF $11,250.00, iNCLUDING SHIPPING. IN RESPONSE TO COUNCILMAN OBERB C ' -- U S IO THE BON S TO BE POSTED BY ELLIOTT KEPPLER , I ATTORNEY KILBRIDE REMARKED THAT THE WA~E~ S$SgEM--~AS BEEN ISSUED A PERMIT AND THAT A NEW SYSTEM HAS BEEN CONSTRUCTED TO MEET THE STANDARTk~ OF T~]~ DEPARTMENT OF ENVIRONMENTAL REGULATION. ATTORNEY KILBRIDE ALSO MENTIONED THAT ~HF~ CiTI' ~ILL FILE IN THE FO~ OF A ~W SUIT, THE SAME AS THE RIVER'S E~E PROPERTY O~E~ AS~TI~AND INTERVENE WITH A CIVIL SUIT, SINCE MR. KEPPLER HAS NOT APPLIED FOR A WATER AND SEWER F~NCHISE. COUNCILMAN SCHUM REPORTED THAT HE HAS PREPARED A LIST OF PERSONS INTERESTED TO SERVE ON A SWIMMING POOL COMMITTEE, REGARDING THE POSSIBILITY OF BUILDING AN OLYMPIC SIZE SWIMMING POOL IN SEBASTIAN. MOTION BY COUNCILMAN SCHUM, SECONDED BY COUNCILMAN OBERBECK, TO HAVE THE MAYOR AUTHORIZE THIS COMMITTEE. CARRIED. MAYOR FLOOD EXPLAINED THAT THIS COMMITTEE WILL DO A FEASABILITY STUDY PERTAINING TO THE COST AND OPERATION OF A MUNICIPAL SWIMMING POOL. MAYOR FLOOD REPORTED THAT THE PLANS FROM GENERAL DEVELOPMENT CORPORATION ARE AVAILABLE PERTAINING TO THE BIKE PATH AND THAT HE WILL DISTRIBUTE COPIES TO THE COUNCIL. HE INDICATED THAT HE COULD HAVE GENERAL DEVELOPMENT CORPORATION HOLD UP ON THE CONSTRUCTION UNTIL THE MEETING OF AUGUST 9, 1982, BUT THAT THE COUNCIL WOULD HAVE TO INSTRUCT HIM AT THAT TIME WHETHER TO PROCEED OR NOT SO THE BIKE PATH COULD BE COMPLETED BY THE REOPENING!OF SCHOOL. GREENE WAS HAVING ANOTHER APPRAISAL MADE AT HIS EXPENSE, SINCE HE FELT THE PROPERTY WAS WORTH MORE, BUT THAT THE PURCHASE PRICE OF $50,000.00 WOULD STILL REMAIN FOR THE CITY. LES SOLIN, CITY PLANNER, WOULD BE AT CITY HALL ON TUESDAY, JULY 27, 1982, AT 7:00 P.M., TO DISCUSS THE "PUD" AND "WATERFRONT" COMMERCIAL ZONING ORDINANCE. MAYOR FLOOD REPORTED THAT HE AND EARL MASTELLER, CITY ENGINEER, INSPECTED A DRAINAGE PROBLEM ON THE BACK SIDE OF THE AIRPORT ALONG ROSELAND ROAD AND FEELS THE COUNTY NEEDS TO CUT, RE-CUT SOME DRAINAGE DITCHES. MAYOR FLOOD INDICATED THAT AS A TEMPORARY SOLUTION HE WOULD MEET WITH DOUG SCURLOCK, COUNTY COMMISSIONER, TO SEE IF A SHORT TERM RELIEF CAN BE ARRIVED AT WITH THE COUNTY AND THE CITY. ATTORNEY KILBRIDE STATED THAT HE HAD PREPARED A PROPOSED STREET OPENING ORDINANCE FOR THE COUNCIL TO REVIEW AND THAT IT INCLUDED A FEE STRUCTURE. MAYOR FLOOD STATED THAT IT WOULD BE DISCUSSED FURTHER AT THE WORKSHOP MEETING, AUGUST 4, 1982. ATTORNEY KILBRIDE STATED THAT EACH COUNCIL MEMBER HAS BEEN SERVED WITH THE NECESSARY PAPERS REGARDING THE LAW SUIT IN CONNECTION WITH THE SEBASTIAN HIGHLANDS PROPERTY OWNERS ASSOCIATION AND ASSUMES THAT HE HAS AUTHORITY TO RESPOND ON BEHALF OF THE CITY COUNCIL. ATTORNEY KILBRIDE STATED THAT HE WILL PREPARE A NOTICE OF AUCTION TO ADVERTISE AND SET A DATE FOR LOT 17, BLOCK 4, SEBASTIAN GROVE ESTATES. MAYOR FLOOD STATED THAT THERE IS ALOT OF MISCELLANEOUS ITEMS IN THE CITY GARAGE THAT CAN BE AUCTIONED OFF AND SUGGESTED THAT AN oRDINANCE BE DRAFTED TO ALLOW THE CITY TO PROCEED. ATTORNEY KILBRIDE STATED THAT HE HAS NOT HAD TIME TO RESEARCH AND DRAFT AN ORDINANCE SINCE HE HAS HAD OTHER IMPORTANT CITY BUSINESS TO HANDLE. REGULAR COUNCIL MEETING - JULY 21, 1982 ~FTER A VERY LENGTHY DISCUSSION REGARDING, THE RE-ZONING OF RIVER OAKS ESTATES (DILAURO), FROM .GRICULTURAL TO SINGLE FAMILY RESIDENCE, ATTORNEY KILBRIDE EXPLAINED THAT THE PROBLEM IS THAT THE CITY ONLY HAS ONE R-1 SINGLE FAMILY RESIDENCE ZONING CLASSIFICATION AT THIS TIME, BUT THAT THE COUNCIL HAS INDICATED THAT THEY WILL ADOPT AN AMENDMENT, REGARDING THE COMPREHENSIVE CHANGE TO THE ZONING ORDINANCE. THIS CHANGE WILL ALLOW AND CREATE A NEW ZONING CLASSIFICATION THAT WOULD PROVIDE LARGER LOTS. ATTORNEY KILBRIDE REMARKED THAT WHEN THIS CHANGE IS COMPLETED THAT THE PROPERTY CAN BE REZONED. HE FELT IF THIS PROPOSAL IS BROUGHT BEFORE THE COUNTY NOW THEY WOULD DENY IT SINCE THE DENSITY WOULD CHANGE. ATTORNEY RENE VAN DEVOORDE, STIPULATED THAT THERE IS A TIME ELEMENT INVOLVED, SINCE HIS CLIENT (MR. DILAURO) WOULD NOT BE ABLE TO SELL PARCELS UNTIL JANUARY, 1983. COUNCILMAN OBERBECK SUGGESTED THAT AN AGREEMENT BE PREPARED TO PROTECT THE ZONING AND ZONING CHANGES AND TO ALLOW THE DEVELOPER TO PROCEED WITH HIS PLANS. ATTORNEY KILBRIDE STATED THAT HE WOULD REQUEST FROM MR. VAN DE VOORDE AN AFFIDAVIT FROM HIS CLIENT, INDICATING THAT IT WOULD BE HIS INTENTION TO DEVELOP THIS SITE AT 1/2 ACRES, OR AVERAGE DENSITY NOT TO EXCEED 2 HOUSES PER ACRES. MOTION BY COUNCILMAN OBERBECK, SECONDED BY COUNCILMAN VOTAPKA, TO AUTHORIZE THE ATTORNEY TO PROCEED WITH MR. DiLAURO, RIVER OAKS ESTATES, PROPERTY IN QUESTION AND PROCEED WITH ENTERING INTO ANAGREEMENT WITH AN AFFIDAVIT FROM MR. DILAURO WITH REGARD TO THE R-1 ZONING, DENSITY AS REQUESTED BY MR. DILAURO REMAIN 2 UNITS PER ACRE AND SAME DENSITY BE SUBJECT UPON ANY SALE OF PROPERTY. CARRIED. MOTION BY COUNCILMAN OBERBECK, SECONDED BY COUNCILMAN VOTAPKA, TO PERMIT AMERON HOMES, INC~, WILLIAM PRESIDENT, TO ERECT A MODEL HOME ON LOT 24, BLOCK 185, UNIT 8, SEBASTIAN HIGHLANDS. REGULAR COUNCIL MEETING - JULY 21, 1982 FLOOD SAID THAT IS SOMETHING THAT I NEED TO CLARIFY, IT HAS BEEN PART OF DISCUSSION OVER A ~37,000.00 CHECK. THEY WERE TOLD DOWN THERE THAT YOU WERE NOTIFIED AND ALL THAT GENERAL DEVELOPMENT CORPORATION WAS WAITING FOR WAS FOR YOU TO COME BACK AND SAY THAT EVERYTHING WAS COMPLETE. EARL MASTELLER, STATED THAT HE WAS NOTIFIED LAST WEEK WHEN HE INITIATED A TELEPHONE CALL AND DURING THE COURSE OF THAT CONVERSATION HE ASKED FOR THE STATUS AND WAS TOLD THAT THEY WERE ALL DONE AND I' ASKED FOR A LETTER TO THAT EFFECT, MAKING IT FORMAL AND REQUEST ME TO MAKE A FINAL INSPECTION FOR ACCEPTANCE. MAYOR FLOOD STATED THAT HE HAS DISTRIBUTED A COPY OF THE AMBULANCE SQUAD BUDGET AND ASKED THE COUNCIL TO REVIEW IT SO IT COULD BE DISCUSSED FURTHER AT THE BUDGET HEARING ON AUGUST 11, 1982.
