Mayor Harris called the meeting to order at 7:00 P.M. 2. Attorney Palmer led the Pledge of Allegiance. 3. invocation was given by Bishop Anthony Varano. 4. ROLL CALL Present: Vice Mayor Kenneth Roth Councilman Robert McCarthy Councilman George Metcalf Councilman Peter Vallone Mayor L. Gene Harris Attorney Thomas C. Palmer 5. P, EQ~LAMA~IQ~/~NOU~CEMENTS Mayor Harris announced the Planning and Zoning meeting on August 6, 1987 at 7:00 P.M.; the fact that he would be attending the Labor Relations Forum in Clearwater on August 7, 1987 and that Vice Mayor Roth would be in charge; the Budget Workshop schedule of August 10, 14, 17 and 21, 1987 at 8:30 A.M. Councilman Vallone said he would be unable to attend the meeting on August 10. Vice Mayor Roth requested that items (9)(B), (9)(D) and (9) (E) be referred back to staff for further study, but it was decided to discuss them under the agenda item. 1 Counci±man ~cCar'~ny £aquest~d tha~ item (13) (L) (1) be sent back to Parks and Recreation for a cost and feasibility study and (13) (L) (2) be referred to Public Works since it is not Council business. Council concurred with this request. Employee of th~ Month ~ August 1987 ~ Debbie W~t Attorney Palmer read a proclamation, proclaiming Debbie West employee of the month for August 1987. Mayor Harris presented Ms. West with the proclama- tion and a plaque. Jim Gallagher, Sebastian General Partnership, B.F.T., with the help of former Councilman Lloyd Rondeau, presented the City with the deed to approximately 2.12 acres at Chesser Gap donated by Sebastian General Partnership, B.F.T. Mayor Harris thanked Mr. Rondeau for his service to the City in acquiring the property for a Police Station. 6. COMMITTEE REPORTS Mayor Harris requested that a request from the Vehicle Maintenance Foreman for purchase of two pickups be placed on this agenda. Councilman Vallone objected and requested that it be discussed at the August 12, 1987, meeting after backup is presented. 7. !N~QD~C~IO~ OF BUSINESS FROM THE PUBLIC Mayor Harris requested that the public address issues and not personalities. He said the purpose of the introduction of business was to bring new items to the agenda and if Council does not wish to discuss it they can move it to the next meeting. He then opened the "Introduction of Business from the Public" at 7:20 P.M. Victor Regan requested that the following three items be discussed 1) the Sheriff's department probe of the Police Department, 2) action by the City Attorney 3) a meeting he had with Mayor Harris. Mayor Harris instructed Mr. Regan to obtain documentation and bring it back to Council. Councilman Vallone said for the record that Mayor Harris had denied a citizen access to the Council. MOTION by Vallone/Roth I move we challenge the Chair for denying a citizen access to speak to Council. Vice Mayor Roth stated that Mr. Regan did not follow proper procedure since he did not present his comments to Council in writing. Councilman McCarthy and Councilman Metcalf agreed. ROLL CALL: Vice Mayor Roth - Nay Councilman McCarthy - Nay CoUncilman Metcalf - Nay Councilman Vallone - Aye Mayor Harris - (did not vote) MOTION CARRIED. William Barber, Prudential Builders, Inc., requested advice on a Model Home sign. Attorney Palmer said he must refer the matter to the Building Official. Dr. Henry Fischer said Huber Graders are one of the finest instruments for leveling asphalt. He also said the City Attorney is highly qualified and one of the best in the State of Florida and the City cannot be run without a full-time attorney. Former Councilman Lloyd Rondeau spoke in support of the City Attorney. Dr. Beller said Charles Cannon will bring further division to the Golf Course and recommended rejecting the lease proposal. Shirley Regan, former employee of C.J. Cannon, stated that Mr. Cannon can make money for the City. Kathleen Geyer said the Council had not followed proper procedure by allowing Charles Cannon to visit the Golf Course and speak to employees before the proposal was presented. She said if this had not been done there would be no conflict now. She said that Bill Vincent acted in the best interest of the employees. Charles Cannon after commenting on his visit to the Golf Course withdrew his proposal for lease of the Golf Course restaurant. Vice Mayor Roth, Councilman McCarthy and Mayor Harris asked Mr. Cannon to reconsider his withdrawal. Mr. Cannon said it was not practical to pursue the lease at this time. 8. CONSENT Each item was removed for discussion. A. kpprove Minutes - 7/22/87 Regula~ Q~ncil councilman Metcalf questioned whether the owner's letter had been received regarding Pelican Pawn and Gun's request for a Special Use Permit. The City Clerk said it had not yet been received. MOTION by Metcalf/McCarthy I move we approve the 7/22/87 Regular meeting minutes. Recommendation m ~Har~ Bid for Ye~i!i~r MOTION by Vallone/McCarthy I move we award the bid for 16.5 tons of fertilizer to Estech for $5385.60 based on Bill Vincent's recommendation. Councilman Metcalf questioned whether this was the low bid. Bill Vincent said it was not but that it was the only one that met specifications. ORDINANCE NO. 0-87-19 - Discussion Only AN ORDINANCE OF THE CITY OF SEBASTIAN, FLORIDA, ENACTING A NEW SECTION 20A-5.20 TO THE CITY OF SEBASTIAN LAND DEVELOPMENT CODE AND THEREBY PROHIBITING THE CONSTRUCTION OF SINGLE FAMILY RESIDENCES AND DUPLEXES NEAR OTHER SIMILIARLY OUTWARDLY APPEARING SINGLE FAMILY RESIDENCES OR RESIDENTIAL DUPLEXES; PROVIDING AN EFFECTIVE DATE. Building Official, Bruce Cooper said he and Attorney Palmer had met with General Development Corporation and the outcome was that they feel housing similarities can be handled in house. They said a 87.146 87.138 87.192 letter will be received from GDC by Friday and will be presented at the next meeting. C. ORDINANCE NO. 0-87-18 - Discussion Only AN ORDINANCE OF THE CITY OF SEBASTIAN, FLORIDA, ENACTING A NEW CHAPTER 24, AND THEREBY PROVIDING FOR LOCAL PROVISIONS FOR IMPROVEMENTS BY ASSESSMENTS PURSUANT TO CHAPTER 170, FLORIDA STATUTES; PROVIDING AN EFFECTIVE DATE. After some discussion, Mayor Harris instructed Attorney Palmer to meet with Vice Mayor Roth for a redraft of the Ordinance. NW Co~n~ o~ u.s. 1 i ~xa~on Avenu~ Building Official, Bruce Cooper, said that model homes are not allowed in CG zone and questioned whether Council wanted to amend the Ordinance on model homes or rezone the property. Mayor Harris referred back the request to the Building Official, Planning and Zoning Commission and Attorney Palmer. 2. Within Park P~Ge ~0bilg Home PUD Building Official, Bruce Cooper, said that the zone Mobile Home PUD does not fall into zone criteria for model homes. MOTION by Roth/Metcalf I move we refer this request back to the Planning and Zoning Commission for their review and recommendation. Councilman McCarthy recommended using the City's auditors as a screening committee. Mayor Harris requested that the City Clerk give Council copies of the City Manager applications as they come in. CITY ~0U~IL MATTERS Councilman Vallone requested that a letter be sent to Quiett Power for information on the purchase of an automatic transfer system for the emergency generator, i.e., advantages vs. disadvantages, costs. Councilman McCarthy requested from the Finance Director a final budget proposal from each department by line item. Councilman Metcalf requested the Mayor review the City Charter to see what proper procedures the City should take to investigate whether the Police Chief has acted in an appropriate and ethical manner. Q~DINANQ~ NO. 0-~7-20 - Discussion Only AN ORDINANCE OF THE CITY OF SEBASTIAN, FLORIDA, ENACTING A NEW PARAGRAPH 6 TO SECTION 7-17, ARTICLE II, TO CHAPTER 7 OF THE CODE OF ORDINANCES OF THE CITY, AND THEREBY PROVIDING THAT LOT SURVEYS SHALL BE REQUIRED IN ALL CASES BEFORE A BUILDING PERMIT WILL BE ALLOWED FOR ANY PRINCIPAL STRUCTURE TO BE BUILT ON ANY PREMISES AND A SLAB SURVEY SHALL BE REQUIRED IN CERTAIN SPECIFIED CASES; PROVIDING AN EFFECTIVE DATE. ROLL CALL: Vice Mayor Roth - Aye Councilman McCarthy - Aye Councilman Metcalf - Aye Councilman Vallone - Aye Mayor Harris - Aye MOTION CARRIED Discus~ioB Re: Purcha~ of ~uber Grader Councilman Vallo~e Councilman Vallone said the Huber Grader is not cost efficient and he could not see spending $8000 for a new rear end as requested during budget workshops. He suggested getting rid of the Huber Grader and buying a backhoe. 10 Vehicle Maintenance Foreman, Tony Clopein, said he was requested by the former City Engineer to look into purchase of the rear end and that he personally didn't care if it was purchased. Superintendent of Streets, A1 Peltier, said the grader is doing the work it was purchased to do. Councilman Vallone requested that Public works provide an hourly use per day schedule for the Huber Grader. MOTION by Roth/McCarthy I move we extend the meeting to 11:00 P.M. This item was referred back to the Building Official and Attorney Palmer for their review and report back to Council at the August 12, 1987 meeting.
